WHEREAS, C. KEITH FRYE and RAQUEL C. MORALES of 1227 BAILEY STREET,
HARRISBURG, PA 17103, Pennsylvania, is about to execute contemporaneously herewith, a contract,
with MICHAEL MANNING & ASSOCIATES of
Pennsylvania, for the erection of a building upon premises commonly known as 3591 (LOT No. 81)
GOLFVIEW DRIVE, Township EAST PENNSBORO, CUMBERLAND County, Pennsylvania, as set
forth in the deed dated , recorded at Deed Book , Page , in the
Recorder's Office for CUMBERLAND County, Pennsylvania, as more specifically described in Exhibit
"A" which is incorporated herein and attached hereto.
NOW, April 19, 2004, at the time of and immediately before the execution of the principal
contract, and before any authority has been given by the said Owner to the said Contractor to commence
work on the said building, or purchase materials for the same in consideration of the making of the said
contract with Contractor and the further consideration of One Dollar ($1.00), to Contractor paid by
Owner, it is agreed that no lien shall be filed against the building by the Contractor, or any subcontractor,
nor by any of the materialmen or workmen or any other person for any labor, or materials purchased, or
extra labor or materials purchased for the erection of said building, the right to file such liens being
expressly waived.

All that certain piece or parcel ofland situate in the Township of East Pe~msboro, Cumberland
County, Co~nmonweaith of Pennsylvania, being more fully described as follows:
Beginning at a point said point being located on the dedicated right-of-way line of Oolfview
'Drive at the dividing line of Lot No. 80 and Lot No. 81.
Thence by the same, South 80 degrees 31 minutes 58 seconds East a distance of 114.43 feet to a
point on the legal fight-of-way line of Acri Road.
Thence by the same, South 05 degrees 07 minutes 41 seconds East a distance of 149.72 feet to a
point on the legal right-of-way line of Acri Road at the dividing line of Lot No. 82 and Lot No.
$1.
Thence by the same, South 84 degrees 52 minutes 19 seconds West a distance of 43.34 feet to a
point on the dividing line of Lot No, 82 and Lot No. 81.
Thence by.the same, North 51 degrees 53 minutes 05 seconds West a distance of t50.00 feet to a
point on the dedicated right-of, way line of Golf-view Drive.
Thence by the saaue by a curve to the leR, having a radius of 175.00 feet, an arc distance of 87.50
feet to a point, the place of beginning.
Being Lot No. 81, containing 18,136.5 sq. ff., as shown on Final Subdivision Plan of HJckoc,'
tLidge, Phase III - Revised, recorded in Planbook . , Page , and being subject to all
easements of record.
