Thomas Richard Clapsadl of 18 Auburn Circle, Boiling Springs, Cumberland County, Pennsylvania, died on January 15, 2006. B. On February 8, 2006, Letters Testamentary were granted to Gladys June Clapsadl at File No. 2;006-00130 in the Register of Wills Office for Cumberland County, Pennsylvaniia. C. Executrix has administered the estate until the present time rind has paid all debts of the estate. There is no inheritance tax due in this estate since the onlly asset was a Certificate of Deposit with Members First Federal Credit Unit in the amount of $43,677.03. Executrix was sole beneficiary and is not subject to inheritance tax. Questions involving ownership a~f assets were resolved with credit union and Revenue. D. Decedent died testate, copy of will being attached hereto, providing for the entire estate to pans to his wife, whose name is subscribed hereunder. E. Executrix desires to forego a formal account and schedule of distribution and desires to conclude the estate by virtue of filing of this Statement. NOW, THEREFORE, the said party intending to be legally bound sets forth the following: 1. Executrix of the estate of deceased will not file a formal accounting or schedule of distribution. 2. The estate is not subject to Inheritance Tax. 3. The 6~eneficiary designates this Statement as a "satisfaction of award" and hereby authorizes and directs the Clerk of Orphans' Court to mark satisfiedf of record any award which may subsequently be made by the Court with respect to the distribution made to the distributee in this Statement. 4. The said beneficiary acknowledges that this Final Settlement Statement shall be filed with the Clerk of Orphans' Court in final settlement of the estate of decedent Thomas Richard Clapsadl, and to close the estate. ITEM ONE: I direct that all my debts and funeral expenses, including my gravemarker shall be paid from my residuary estate as soon as practicable after my decease as a part of the expene~e of the administration of my estate. ITEM Z'WO: I give, devise and bequeath my entire estate to my wife Gladys June Clapsadl if she survives me by 60 days. In the event, that.: Gladys .,Tune Clapsadl predeceases me or is not then living' on the 61st day after my death, then I give, devise, and bequeath my entire estate to my children Larry Richard Clapsadl and Roberta Sue Stoner, equally, to share and share alike, per stirpes. ITEM THREE: I appoint my wife Gladys June Cla~~sadl Executrix of this my last will. Should my wife Gladys June Clapsadl fail to qualify or cease to act as Executrix, I appoini~ my children Larry Richard Clapsadl and Roberta Sue Stoner to act as Co-Executors with the same rights, powers and duties. ITEM FiDUR: I appoint Mellon Bank of Carlisle, Pennsylvania guardian of any property which passes to any person under the age of 21 ,years and with respect to which I am authorized to appoint a guardian and have not otherwise specifically done so. Said guardian shall have the power to use income from time to time for the beneficiary's education, support and welfaz-e without regard to his or her parent's ability to provide for :such education, suppori~ or welfare, or to make payment for the:;e purposes, withoui~ further responsibility, to the beneficiary or to the benefic:iary's parents or to any person taking care of the beneficiary. Said guardian shall administer th.e separate and equal :hare of each beneficiary until he or she becomes 21 years of age,, at which time the share of each beneficiary remaining in the guardianship account shall be paid to said beneficiary in full. In the event of the death of any beneficiary after my decease' and prior to reaching the age of 21 years, his or her share shall be distributed equally to the surviving children or child t:o be administered in accordance with this guardianship provision. ITEM FIVE: All estate, inheritance, succession and other taxes, imposed or payable by reason of my death, and interest and penalties thereon, with respect to all property comprising my gross estate for tax purposes, whether or not such property passes under this will, shall be paid out of the principal of my residuary estate, without apportionment or right of reimbursement. Page One of Three ITEM ;SIX: I direct that my personal represeni~ative or guardian shall not be required to give bond for the fa:Lthful performance of th~air duties in any jurisdiction. ITEM SEVEN: In addition to the rights and powers given to the fiduciaries by law or elsewhere in this will, I give to my Executor during the full time necessary and fc~r the administration of my estate the following rights and powers to be exesrcised in his sole discretion. A. To retain any real or personal property which may at any time i`orm a part of my estate so long as he or~ she deems it advisable. B. To invest in any real or personal property without restrictions to legal investments. C. To repair, alter, improve or lease for any period of time any real or personal property and to give options for leases. D. To sell at public or private sale, for cash or credit, with or without security, to exchange or to partition real or personal property, and to give options for. leases. E. To make distribution in kind. F. To compromise claims.
