STIPULATION AGAINST LIENS
WHEREAS, Bradley L. Beecher and Joanne M. Beecher, of Cumberland,
Pennsylvania, is about to execute contemporaneously herewith, a contract with Michael L. Martin,
Inc., a Pennsylvania Corporation of York County, Pennsylvania, for the erection of a dwelling upon
a lot of land situate as follows:
ALL THAT CERTAIN piece or parcel of land, situate in Hampden Township,
Cumberland County, Commonwealth of Pennsylvania, bounded and described in accordance with
Final Subdivision Plan prepared by Haman & Associates, a copy of which in recorded in the
Recorder of Deeds Office in and for Cumberland County, Pennsylvania in Plan Book 84, Page 80,
bounded and described as follows, to wit:
BEGINNING at a point on the western right-of-way line of Cherokee Drive at the
common front property comer of Lot No. 8 and Lot No. 9 as shown on the above referenced plan of
lots; thence along said right-of-way line of Cherokee Drive South 52 degrees 19 minutes 45 seconds
East, a distance of 55.51 feet to a point; thence by a curve having a radius of 300 feet and an arc
length of 94.25 feet to a point; thence continuing along said right-of-way line of Cherokee Drive
South 34 degrees 19 minutes 45 seconds East, a distance of 27.30 feet to a point at the dividing line
between Lot No, 9 and lands now or formerly of George M. Baltozer; thence along said dividing line
South 40 degrees 03 minutes 15 seconds West, a distance of 104,90 feet to a point at the dividing
line between Lot No. 9 and lands now or formerly of Albert A. Mammola; thence along said dividing
line North 50 degrees 26 minutes 45 seconds West, a distance of 175.00 feet to a point at the
dividing line between Lot No, 8 and Lot No. 9; thence along said dividing line North 40 degrees 03
minutes 15 seconds East, a distance of 122.28 feet to a point, said point being the Place of
BEGINNING.
BEING Lot No. 9 on the Final Subdivision Plan of Michael A. Ryan and Joyce M.
Ryan, said plan recorded December 27,200l in Plan Book 84, Page 80.
CONTAINING 20,950.911 square feet or 0,4810 acres.
UNDER AND SUBJECT to deed of easement and right-of-way to Albert Mammola
and Mary Mammola as set forth in Miscellaneous Book 482, Page 745.
NOW, the '~ '"'~day of April, 2004, at the time of and immediately before the
execution of the principal contract, and before any authority has been given by the said Bradley L.
Beecher and Joanne M. Beecher, to the said Michael L. Martin, Inc., a Pennsylvania Corporation
to commence work on the said building, or purchase materials for the same in consideration of the
making of the said contract with Michael L. Martin, Inc., a Pennsylvania Corporation and the further
consideration of One Dollar, to Michael L. Martin, Inc., a Pennsylvania Corporation paid by Bradley
L. Beecher and Joanne M. Beecher, it is agreed that no lien shall be filed against the building by the
contractor, or any sub-contractor, nor by any of the material men or workmen or any other person
for any labor, or materials purchased, or extra labor or materials purchased for the erection of said
building, the right to file such liens being expressly waived.
WITNESS, our hand and seals the day and year aforesaid.
