CIVIL ACTION -- COMPLAINT IN MORTGAGE FORECLOSURE
1. The Plaintiff, Champion Mortgage, a Division of Key
Bank USA, National Association, successor to the interests of
Champion Mortgage Co. ,Inc. is a corporation having been organized
under the laws of the United States of America and having its
principal place of business at 2 Gatehall Drive, Parsippany, NJ
07054.
2. (a) Defendant, Jason D. Paxton is an individual whose
last known address is 171 Beetem Hollow Road, Newville, PA 17241.
(b) Defendant, Jason D. Paxton, holds an interest in the
subject property as mortgagor and record owner.
(c) If any of the above named Defendants are deceased,
this action shall proceed against the deceased Defendant's heirs,
assigns,
successors,
administrators,
personal

3. (a) The residential mortgage being foreclosed encumbers
property located at 171 Beetem Hollow Road, Newville, PA 17241
Cumberland County, Pennsylvania.
(b) All documents evidencing the residential mortgage
have been recorded in the Recorder of Deeds' Office in Cumberland
County, Pennsylvania.
(c) The Mortgage was executed on October 9, 2001, and
was recorded on December 17, 2001, in Book 1742, page 3334.
(d) The legal description for this parcel is attached
hereto and incorporated herein as Exhibit "A" (Legal Description) .
(e) Pursuant to Pa. R.C.P. 1147 (1) and 1019(g)
plaintiff is not obliged to append copies of the above mentioned
publicly recorded documents to this mortgage foreclosure action.
These documents are, however, appended hereto and incorporated
herein by reference as Exhibit "B", Mortgage.
(f) The Combined Notice has been sent to the
Defendant(s) by regular and certified mail as required by 35 P.S.
~1680.403c on the date(s) set forth in the true and correct copy of
such notice(s) attached hereto as Exhibit "C".
4. The mortgage is in default because the Defendant, Jason
D. Paxton, failed to timely tender the monthly payment of $390.36
due September 15, 2003, and thereafter failed to make the monthly
payments.
5. As authorized under the mortgage instrument, the loan
obligation has been accelerated.
6. Plaintiff seeks entry of judgment in rem on the following
sums:
(a) Principal balance of mortgage

(b) Interest due and owing at the

7. The attorney's fees set forth above are in conformity
wi th the Mortgage documents and Pennsylvania Law, and will be
collected in the event of a third party purchaser at Sheriff's
Sale. If the Mortgage is reinstated or satisfied prior to the
Sale, reasonable attorney's fees will be charged.
WHEREFORE, the Plaintiff demands:
Entry of Judgment in rem against the Defendants
above named in the total amount of $50,263.62 as
stated at Paragraph 6, plus all additional
interest and late charges accruing through date of
judgment entry; and
Foreclosure and Sheriff's Sale of the subject
mortgaged property.

Charge
Booower shall promptly pay when due the principal of and Interest on the debt evidenced by the
Note and any prepayment and lale charges due under tha Note. If Borrower makes a payment by check,
draft or money order and such check, draft or money order Is dishonored on the second presentment,
Borrower shall pey a dishonored check charge of $20.00.
2. Funds for Taxes and Insurance
Subject to applicable law, upon written notice from Lender requiring that Borrower escrow funds
for the payments of taxes and insurance on the Property. Borrower shall pay to Lender on Ihe day
monthly pal'fTlents are due under Ihe Note. until the Note Is paid In full, a sum ("Fundsj for: (a) yearty
taxes and assessments which may attain priority over IlIIs security InstNment as a lien on the Property;

estate tax reporting service used by lender in oonnectlon with the loan, evidenced by the Nole, unless
applicable law provides otherwise. Unless an agreement is made or applicable law requires Interest to be
paid, Lender shall not be required to pay Borrower any Interest or earnings on the Funds. Borrower and
Lender may agree in writing, however, that intarest shall be paid on the Funds. Lender shall give to
Borrower. without charge, an annual accounting of the Funds; showing credits and debits to the Funds
and the purpose for which each debito the Funds was made. The Funds are pledged as additional
security for all sums secured by this Security Instnmenl.
If the Funds held by Lender exceed the amounts pennilled to be held under applicable law,
Lender shall account to Borrower for the excess Funds in accordance with the requirements of applicable
law. If the amount of the Funds held by lender at any time is not suffICient to pay the Escrow llems wilen
due, Lender may so notify Borrower In writing end, in such case, Borrower shall pay to Lender the amount
necessary to make up the deficiency. Borrower shall make up tho deficiency in no more than twelve (12)

Lender shall acquire or selllhe Property, Lender, prior to the acquisition or sale of the Property, shall
apply any Funds held by Lender at the time of acquisition or sale as a credit against the sums secured by
this Security Instrument.
3. Application of Payments
Unless applicable law provides otherwise, all payments received by Lender under paragraph 1
shall be applied in accordance with the tenns of the Note.
4. Charges; U.ns
Borrower shall payor cause to be paid, when due, all taxes. assessments, charges. fines and
impositions attributable to the Property which may altain priority over this Security Instrument, and
leasehold payments or ground rents, if any. Borrower shall pay these obligatiOns in the manner provided
in paragraph 2, or If not paid In that manner, Borrower shall pay them on time dlreCUy to the person owed
payment. Borrower shall promptly furnish to Lender all notices of amounts to be paid under lhis
paragraph. If Borrower makes these payments directly. Borrower shall promptly furnish to Lender
receipts evidendng the payments.
Borrower shall promptly discharge any lien which has priority over this Security Instrument unless
Borrower. (a) agrees in writing to the payment of the obligation secured by the len in a manner
acceptable to Lender; (b) contests In good faith the lien by, or defends ageinst enforcement of the lien in,
Iegel proceedings which in the Lender's opinion operate to prevent the enforcement of the lien; or (c)
secures from the holder oIlhe lien an agreement satisfactory to Lender subordinating the lien to this
Security Instrument. If lender detennines that any part of the Property is subjeclto a lien that may attain
priority over thiS Security Instrument, lender may give Borrower a notice identifying the lien. Borrower
shall satisfy the lien or lake one Or more of the actions set forth above within ten (10) days of the giving of
notice.
6. Hazard or Property Insurance
Borrower shall keep the Improvements now existing or hereafter erected on lhe Property insured
against loss by fire, hazards Included withIn the term "extended coverage" and any other hazards,
including floods or flooding, for which lender or applicable law requires insurence. This insurance shall
be maintained In the amounts and for the periods that Lender. or applicable law requires. The insurance
carrier providing the insurance shall be chosen by Borrower subject to Lender's approval which shall not
be unreaso1lllbly withheld. If Borrower fails to maintain coverage described above, Lender may, at
Lender's option, obtain coverage to protect lender's rights in lhe Property in eccordance with paragraph
7. Any insurance Lender oblllins may. but need not. protect lhe interests of Borrower and may not pay
any claim made by or against Borrower. In addition, Insurance coverage that lender obtains hereunder
may be significantly more expensive Ihan similar cOI/erage Borrower could obtain for himself or herself.
All insurance pOlicies and renewals shall be acceptable to Lender and shall Include a stendard mortgage
clause. Lender shell have the righlto hold the policies and renewals. If lender requires, Borrower shall
promptly give to Lender all receipts of paid premiums and renewal notices.
In the event of loss, Borrower shall give prompt notice to the insurance carrier and lender.
lender may make proof of loss if not made prompuy by Borrower. Unless Lender and Borrower

damaged, if the restoration or repair Is economically feasfble and Lender's securtly Is not lessened. If the
restoration or repair Is not economlcaDy feasible or Lender's security would be lessened, the Insurance
proceeds sllall be applied to the sums secured by this security Instrument, whether or not then due, with
any excess paid to Borrower.
If Borrower abandons the Property, or does not answer within thirty (30) days a notice from
Lender that the Ins~rance carTier has offered to settle a claim. then Lender, may collect the insurance
proceeds. Lender may ~se the proceeds received by Lender to repair or restore the Property or to pay
sums secured by this Security Instrument, whether or not then due. The thirty (30) day period will begin
when the notice Is given. Unless Lender and Borrower othelWise agree In writing. any application of
proceeds to principal shall not extend or postpone the due date of the monthly payments referred to in
paragraphs 1 and 2 or change the amount of the paymen~, under paragraph 19, the Property Is
acquired by Lender, Borrower's right to any Insurance policies and proceeds resulling from damage to the
Property prior to the acquisition shall pass to Lender to the extent of the sums secured by Ihls Security
Instrument Immediately prior to the acquis~ion.
6. Occupancy, Preservation, Maintenance and Protection of the Property; Borrower's Loan
Application: Leaseholds
Unless Borrower's loan application and the Lender's loan approval provided that the Property was

Joseph Giuliano, of full age, being duly sworn, deposes and
states the following:
1. I am a Legal Assistant with the firm of Pluese, Becker &
Saltzman, LLC, local counsel to the Plaintiff in the above-
referenced mortgage foreclosure action. I make this Certification
predicated upon personal knowledge, matters of record and
documents maintained in our firm's file.

Diligent
efforts
have
been
made
to
identify
all
persons/enti ties holding mortgages, judgments, liens, or other
interest in the subj ect premises of the foreclosure proceeding.
The efforts made include, but are not limited to a review of the
Court dockets and those interests or encumbrances disclosed by
the records of the Recorder of Deeds Office in the County wherein
the subj ect property is located. Due to circumstances beyond
Plaintiff's control, such land records are accurate and report
liens or interests recorded through the applicable "cover" or
"board" date only, and it is not possib:e to ascertain the
identity of any subordinate lienors whose interests have been
recorded after the said cover date.

other interest in the subj ect premises, and as limited by the
circumstances
