The Plaintiff, Graystone Bank, is a Pennsylvania financial institution with an office located at 112 Mazket Street, Harrisburg, PA 17101 (the "Plaintiff") 2. The Defendant, Coliseum Real Estate Group, Inc., is a Pennsylvania corporation with an office address of 415 St. Johns Church Road, Suite 205, Camp Hill, PA 17011 (the "Defendant"). 3. The Defendant executed and delivered to the Plaintiff a Promissory Note dated March 19, 2008, in the original principal amount of One Million Three Hundred Thousand Dollars ($1,300,000), as amended by a Change in Terms Agreement dated May 29, 2008 (together, the "Note"), true and correct photostatic reproductions of the originals of which aze attached hereto as Exhibit "A" and made a part hereof. 4. The Defendant executed and delivered to the Plaintiff a Disclosure for Confession of Judgment, a true and correct photostatic reproduction of the original of which is attached hereto as Exhibit "B" and made a part hereof. 5. The Defendant is in default of the Defendant's obligations to make payment to the Plaintiff as required in the Note. 6. Judgment is not being entered by confession against a natural person in connection with a consumer credit transaction. 7. There has not been any assignment of the Note. 8. Judgment has not been entered on the Note in any jurisdiction. 9. The amount due to the Plaintiff as a result of the Defendant's default is as follows, as of December 12, 2008: a.
