Plaintiff herein is DELLINGER'S AUTO BODY, INC., a corporation duly organized and existing under the laws of the Commonwealth of Pennsylvania, having its place of business at 2410 South Market Street, Mechanicsburg (Upper Allen Township), Cumberland County, Pennsylvania. 2. Defendant herein is RONALD L. GOODNOE, an adult individual who lives and resides at 242 Lumber Street, Highspire, Dauphin County, Pennsylvania. 3. Plaintiff operates, and at all times relevant and material to this cause of action has operated, an automobile body repair shop for the purpose of repairing automobiles that have been damaged in collisions. 4. On or about March 25, 2008, Defendant towed his 2004 Lexus LAW OFFICES MARLIN R. McCALEB LS430 Custom Luxury 4-door sedan to Plaintiff's place of business as described in Paragraph 1, above, and requested Plaintiff's services in repairing damage resulting from an 7 lautomobile collision. 5. Defendant's automobile insurance carrier sent a Irepresentative to Plaintiff's place of business to examine the (damage and estimate the cost of repair. 6. Defendant's insurance carrier estimated that the total cost of repair would be $16,945.56, of which the carrier was willing to pay $16,909.36. See Exhibit 1 attached hereto, incorporated Iherein and made a part hereof by reference thereto. 7. Plaintiff, at Plaintiff's place of business as described in Paragraph 1, above, informed Defendant of the insurance carrier's estimate and payment and that Plaintiff was willing to make the said repairs for the amount of the estimate, and Defendant authorized Plaintiff to proceed and agreed to pay such amount or whatever portion thereof his insurance carrier failed to pay. 8. On or about April 4, 2008, while in the course of such repairs at Plaintiff's place of business as described in Paragraph 1, above, Plaintiff discovered additional damage to the interior of the vehicle that required additional repair and Plaintiff notified Defendant's insurance carrier. LAW OFFICES MARLIN R. McCALEB -2- f 9. Defendant's insurance carrier estimated that the cost of such additional repairs would be $360.18 and authorized Plaintiff to make such additional repairs. See Exhibit 2 attached hereto, incorporated herein and made a part hereof by reference thereto. 10. On or about June 10, 2008, while in the course of such repairs at Plaintiff's place of business as described in Paragraph 1, above, Plaintiff discovered additional damages to the wiring system that required additional repairs and Plaintiff notified Defendant's insurance carrier. 11. Defendant's insurance carrier estimated that the cost of such additional repairs would be $1,227.48 and authorized Plaintiff to proceed with such repairs. See Exhibit 3 attached hereto, incorporated herein and made a part hereof by reference thereto. 12. On or about June 23, 2008, while in the course of such LAW OFFICES MARLIN R. McCALEB repairs at Plaintiff's place of business as described in Paragraph 1, above, Plaintiff discovered additional damage to the bumper and grille that required additional repairs and Plaintiff notified Defendant's insurance carrier. -3- 13. Defendant's insurance carrier estimated that the cost of such additional repairs would be $1,152.35 and authorized Plaintiff to proceed with such additional repairs. See Exhibit 4 attached hereto, incorporated herein and made a part hereof by reference thereto. 14. On or about July 1, 2008, while in the course of such repairs at Plaintiff's place of business as described in Paragraph 1, above, Plaintiff discovered that the sunroof on the vehicle did not operate properly and would have to be replaced and Plaintiff notified Defendant's insurance carrier. 15. Defendant's insurance carrier estimated that the cost of replacing the sunroof would be $2,860.68 and authorized Plaintiff to proceed with such additional repairs. See Exhibit 5 attached hereto, incorporated herein and made a part hereof by reference thereto. 16. As the result of the additional repairs described in Paragraphs 9, 11, 13 and 15, above, the total cost of repairing Defendant's automobile is $22,546.25. 17. Defendant's insurance carrier has paid to Plaintiff, on LAW OFFICES MARLIN R. McCALEB account of the additional repairs described in Paragraphs 9, 11 -4- and 13, above, the total sum of $2,740.01, leaving a balance due and owing by Defendant to Plaintiff in the amount of $19,806.24. 18. Plaintiff believes and therefore avers that Defendant's insurance carrier has paid to Defendant, on account of the original estimate and on account of the additional repairs described in Paragraph 15, above, the total sum of $19,770.04 but Defendant has failed and refused to pay any part thereof to Plaintiff. 19. The prices charged by Plaintiff for the labor and materials provided to Defendant's automobile are fair and reasonable for the services and materials provided, are the prices approved and authorized by Defendant's insurance carrier and are the prices that Defendant agreed to pay. WHEREFORE, Plaintiff demands judgment in its favor and against Defendant in the amount of $19,806.24, together with interest thereon and costs of suit. Date: December 7 2008 Marlin R. On March 4, 2009, at Plaintiff's request, the Prothonotary of Cumberland County, Pennsylvania ("the Prothonotary") reinstated the said Complaint. LAW OFFICES MARLIN R. McCALEB 5. On March 27, 2009, the Reinstated Complaint was personally served by the Sheriff of McKean County, Pennsylvania, upon Defendant at the address set forth in Paragraph 2, above. 6. On May 29, 2009, at Plaintiff's request, the Prothonotary entered judgment by default against Defendant and in favor of the Plaintiff in the amount of $19,806.24, with interest and costs of suit. 10. That same day, pursuant to Pa.R.C.P. No. 236, the Prothonotary mailed Notice of Entry of Default Judgment to the Defendant by First Class United States Mail, postage prepaid, addressed to the Defendant at the address set forth in Paragraph 2, above; said mail was not returned to the Prothonotary. On August 5, 2009, at Plaintiff's request, the Prothonotary issued a Writ of Execution to the Sheriff of Cumberland County, Pennsylvania ("the Sheriff"), and against the Defendant herein. 12. On August 12, 2009, the Sheriff served the Writ of Execution and levied upon the automobile described in Paragraph 3, above. 13. On August 13, 2009, pursuant to Pa.R.C.P. No. 3108, the Sheriff mailed a copy of the Writ of Execution to Defendant at the address set forth in Paragraph 2, above, by First Class United States Mail, postage prepaid; said mail was not returned to the Sheriff. 14. On September 3, 2009, at Plaintiff's request, the Sheriff scheduled a sale of the automobile levied upon as described in Paragraph 12, above, for Monday, September 21, 2009, at 10:00 o'clock A.M. 15. On September 4, 2009, the Sheriff mailed Notice of the LAW OFFICES MARLIN R. McCALEB sale described in Paragraph 14, above, to the Defendant at the address set forth in Paragraph 2, above, by First Class United States Mail, postage prepaid; said mail was not returned to the Sheriff. 16. The Sheriff conducted said sale on September 21, 2009, at 10:00 o'clock A.M., which sale the Defendant did not attend, and the Sheriff sold the automobile described in Paragraph 3, above, to the Plaintiff for the sum of One ($1.00) Dollar. Despite the Sheriff's sale described in Paragraph 16, above, the Pennsylvania Department of Transportation refuses to transfer the title to said automobile from the Defendant to the Plaintiff without an Order of Court awarding ownership of the automobile to Plaintiff and extinguishing the right, title and interest therein of the Defendant.
