THIS AGREEMENT made the 19th day of April, 2004, by and between M. Jeffrey Strickland
hereinafter referred to as Contractor, and Strickland Brothers Construction, hereinafter referred to
as Owner, whereby the former undertook and agreed to erect and construct a custom built home on
that certain lot of ground situate at Lot 27 Prickly Pear Drive, Carlisle, North Middleton Township,
Cumberland County, Pennsylvania, known as more fully described in Exhibit "A" attached hereto
and made a part hereof.
NOW THEREFORE, WITNESSETH: That the said Contractor, for and in consideration of
the sum of ($1.00) Dollar to Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the agreement aforesaid, for themselves
and their subcontractors, and all parties acting through or under them, covenant and agree that no
mechanic's liens or claims shall be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on account of any work done or materials
furnished by them or any of them under said contract or otherwise, for, towards, in, or about the
erection and construction of the said buildings on the lot above described, and the said Contractor,
for themselves, their subcontractors and others under them hereby expressly waive and relinquish
the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any
of them, and agree that this instrument, waiving the right of lien, shall be an independent covenant.

acknowledged that he executed the same for the purposes therein contained.

ALL THAT CERTAIN unimproved tract of land situate in North Middleton Township, Cumberland
County, Pennsylvania, being more fully bounded and described according to a Final Subdivision
Plan for Phase I of Hillcrest Farms West, prepared by R.J. Fisher & Associates, Inc., being recorded
in the Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania, in Plan Book
86, Page 57, as follows:
BEGINNING at a point along the southern side of a 50.00 foot wide right-of-way known as Prickly
Pear Drive, along the dividing line between Lots Nos. 27 and R1 (which is land reserved for future
development as Phase II of Hillcrest Farms West); thence continuing along same, South 73 degrees
56 minutes 01 seconds West, a distance of 201.02 feet to a point; thence continuing along same,
South 11 degrees 15 minutes 12 seconds West, a distance of 83.00 feet to a point along the dividing
line between Lots Nos. 27 and 28 of the hereinafter mentioned Subdivision Plan; thence continuing
along same, South 76 degrees 02 minutes 45 seconds East, a distance of 229.76 feet to a point along
the northeastern side of Prickly Pear Drive; thence continuing along same by a curve to the fight,
having a radius of 235.00 feet, an arc length of 139.44 feet on a chord beating of North 00 degrees
55 minutes 56 seconds East, and a chord length of 137.40 feet to a point; thence continuing along
same, North 16 degrees 03 minutes 59 seconds West, a distance of 57.30 feet to the point and Place
of BEGINNING.
