PETITION FOR APPOINTMENT OF EMERGENCY PLENARY GUARDIAN OF THE PERSON AND ESTATE AND NOW COMES THE PETITIONER, the Area Agency on Aging in and for Cumberland County, Pennsylvania, who represents and avers as follows: The Petitioner is the Area Agency on Aging, in and for Cumberland County, with its office located at 16 West High Street, Carlisle, Cumberland County, Pennsylvania. The alleged incapacitated person is Lee Cmll, age 81, who resides at 14 Fickes Road, Newville, Cumberland County, Pennsylvania and has resided there for a period exceeding one (1) year prior to the filing of this Petition. The known relatives of the alleged incapacitated person are: bo Co Sonya Cmll - Daughter 14 Fickes Road Newville, PA Fred Cmll - Brother 148 Opossum Lake Carlisle, PA 17013 Jack Cmll - Brother 1 West Penn Street, Apt. 521 Carlisle, PA 17013 eo ho Joseph Crull - Brother 3275 Enola Road Carlisle, Pennsylvania 17013 Ruth Stambaugh - Sister 17 Hosfeld Road Carlisle, Pennsylvania 17013 Erma Finkenbinder - Sister 30 Westlake Drive Carlisle, Pennsylvania 17013 Elma Woods - Sister 92C Fairview Street Carlisle, Pennsylvania 17013 Mabel Mackey- Sister 415 Opossum Lake Road Carlisle, Pennsylvania 17013 Lee Crull has, for at least three (3) months, been incapable of managing and caring for himself and his financial affairs. 5. Lee Crull exhibits symptoms of mental incapacity, including but not limited to dementia, severe dementia. 6. Lee Crull's mental incapacity prevents him from managing and caring for the affairs of his person and estate. 7. On or about August 26, 2003, the Petitioner received a report for need of protective services for Lee Crull based on the fact that his daughter, Sonya Crull with whom he resided, had left the area without making any provisions for his care or the care of her 2 cats and 2 large dogs. 8. The daughter, Sonya Crull, had left the home around August 10, 2003 and did not return until October 6, 2004. 9. While away, it is believed that the daughter traveled to the Detroit, Michigan, Lexington, Kentucky and Pittsburgh, Pennsylvania areas and had been admitted to mental health facilities in Detroit and Pittsburgh. 10. During this period of time, the Petitioner, through its authorized caseworker, assisted Lee Crull. 11. On April 6, 2004, the Petitioner received a report that the daughter, Sonya Crull, had been admitted to the mental health unit at Holy Spirit Hospital. 12. Petitioner's authorized representative visited Lee Crull on April 6, 2004 and made the following observations: a. There were two (2) home delivered meals sitting out and were defrosted and warm but he indicated that he could not heat them up; and b. His medication was almost all out and, according to the dates on the labels, he had not been taking them correctly. 13. Since April 6, 2004, the Petitioner has been taking meals to him and doing limited grocery shopping for him. He has been unable to tell the Petitioner's authorized representative what he wants and appears to be eating mainly snack type foods. 14. Since August 26, 2003, Petitioner believes and therefore avers, that Mr. Crull's ability to care for himself has declined in that: a. He is less communicative and is unable to do any type of meal preparation; b. He is unable to sufficiently care for the pets and has worn the same clothes for two (2) weeks; c. He is unable to state when he had taken a shower last and was unable to renew his prescriptions or make arrangements for them to be picked up; d. He is unable to remember from one day to the next that Office of Aging workers were there to deliver food; and e. He was unable to remember being taken to visit a personal care home and the house is dirty and in disarray. 15. An options assessment was conducted by the Petitioner and it has been determined that Mr. Crull requires nursing home level of care due to his Parkinson's disease and dementia. 16. The daughter, Sonya Crull, is 39 years of age and has been appointed as his attorney-in-fact pursuant to a Power of Attorney. 17. The daughter, Sonya Crull, was admitted to Holy Spirit Hospital involuntarily and it appears that this is the third mental health hospitalization for her within 8 months. 18. When visiting the house of Mr. Crull on April 15, 2004, the Petitioner's authorized representatives observed the following: a. There were 3 holes in the plaster in the living room, the cause of which could not be explained by Mr. Crull except to say that Sonya had done it; b. A knife, a hatchet and a hammer were observed stuck in her wall by the door; c. Seven (7) butcher knives and one (1) hunting knife were observed on her dresser; and d. Her bedroom door had a large area that had been hacked to shreds on both sides and there were holes in a wall in her bedroom. 19. On or about April 16, 2004, arrangements were made for Lee Crull to be admitted to the Thomwald Home located at 442 Walnut Bottom Road, Carlisle, Pennsylvania and he agreed to be placed there. 20. Petitioner believes and, therefore, avers that the title to the house had been conveyed to Mr. Crull's daughter several years ago. 21. Mr. Crull appears to be unaware of his financial affairs, cannot state his income, assets or outstanding bills nor is he able to write checks and pay his bills. 22. Petitioner believes and, therefore, avers that Lee Crull's income for 2003 is as a. Public School Employees Pension - $1,091.28 b. Social Security- 3,308.40; c. Federal Pension - 11,748.00 follows: Total Income $16,147.68 23. Petitioner believes that the daughter, Sonya Crull, will have a heating under the Mental Health Act on April 26, 2004. 24. In the event that the daughter, Sonya Crull, is released from the mental health unit at Holy Spirit Hospital on April 26, 2004, then and in such event, she could seek to remove Lee Crull from the Thornwald Home pursuant to the Power of Attorney that she has. 25. Petitioner believes and, therefore, avers that Lee Crull will be at risk of death or irreparable harm if he is discharged from the Thomwald Home by his daughter pursuant to the Power of Attorney. 26. Petitioner believes and, therefore, avers that the placement of Lee Crull at the Thornwald Home represents the least restrictive environment for him. 27. Less restrictive alternatives are not available because there is no one able to care for him. 28. Petitioner is willing to accept the appointment of Emergency PlenaryGuardian of the Person and Estate of Lee Crull. 29. The nature of Petitioner's interest is that of a welfare agency. 30. Petitioner has no interest that is adverse to the alleged incapacitated person. 31. To Petitioner's knowledge, no previous application has been made for the Order herein requested or for a similar Order. 32. No other Court has ever assumed jurisdiction in any proceeding to determine the incapacity of Lee Crull. 33. The failure to appoint Petitioner as Emergency Plenary Guardian of the Person and Estate of Lee Crull will result in irreparable harm to the person and estate of Lee Crull. Guido appointed the Cumberland County Office of Aging Temporary Guardian of Person for Lee Crull. Following this appointment, Mr. Crull returned to the Thornwald Home where he had been admitted on April 16, 2005. He was admitted to the Thornwald Home because he could no longer care for himself. His daughter, Sonya Crull, had been his caregiver but left the area for several months without making adequate arrangements for his care. His daughter also had several mental health hospitalizations. On May 13, 2004 the Cumberland County Office of Aging was appointed permanent Guardian of Person. Mr. Crull continues to reside at Thornwald Home. At the time of his admission, Mr. Crull was diagnosed with dementia, hypertension and congestive heart failure. No new diagnoses have occurred. Mr. Crull has adjusted well to the nursing home. Recently, however, hehas become a little more antagonistic toward some other residents. He has only been attending a few activities. In February, after gaining our approval the Home started Lee in the Special Programming for Alzheimer's patients. In this program he is given special tasks to do to keep him active during the day. So far, he seems to be doing well in this program. Mr. Crull had gained considerable weight once he was in the home and now the nutritionist is working to get his weight down. She reported that it is slowly going down. He continues to ambulate well but needs cueing with most of his activities of daily living He is occasionally exit seeking and therefore continues to wear a Wanderguard bracelet. Around some of the holidays, his nephew and one brother take him out overnight. They must notify our office ahead of time, letting us know when they are coming to pick him up, where are they going, and when are they bringing him back. There was one unfortunate incident over the holiday season. While walking into the church where his nephew is pastor, Lee stumbled and fell. He refused to be taken to the doctor. When he was returned to the Home, the staff at the Home called me and reported that his nose was cut up and they thought it might be broken. In addition his 0- l,OOlr-3qy , - left hand is swollen. Mr. Crull was taken to the emergency room at Carlisle Regional Medical Center and had x-rays taken. He sustained a broken finger. We took Lee to three appointments with an orthopedic doctor. It was decided surgery would not be beneficial. He received physical therapy and currently the swelling in the finger has been reduced greatly and his ability to use his finger is much better. The Office has begun to work with the Egger Funeral Home in Newville to make some funeral pre-planning. Since his daughter's last mental health hospitalization, she seems to be doing much better. The letters she writes to him are rational. She is now living in Shippensburg and she has not tried to visit. It is the request of the Cumberland County Office of Aging that the agency retains Guardianship of Person for Lee Crull. The Thornwald Home has demonstrated an adequate quality of care for his medical and mental problems. Guido appointed the Cumberland County Office of Aging permanent Plenary Guardian of Estate for Lee Crull. Subsequently the Office of Aging became Mr. Crull's Representative Payee for his social security and Fiduciary for the Veteran's Administration. At the time of the guardianship, the Office of Aging closed Mr. Crull's personal checking account and opened a guardian checking account at M& T. Initial balance was $276.05. Current balance is $1839.87. Mr. Crull's monthly income includes $218.00 from Social Security, $112.00 from VA compensation, $941.18 from his civil service pension and $90.94 from his Public School Employee pension. His monthly net total was $1362.12. The Agency also filed his 2005 income taxes. During most of the year, Mr. Crull's payment to the Thornwald Home, the nursing home where he is residing, was $1295.99. In addition there were some payments made for personal items, supplies, and clothing. Mr. Crull needed new glasses and these were purchased. In addition, pre-funeral arrangements were made with the Egger Funeral Home in Newville. An initial deposit of $800.00 was made for this purpose. Attached is a financial summary of Lee Crull's income and expenses. Guido appointed the Cumberland County Office of Aging permanent Plenary Guardian of Estate for Lee Crull. Subsequently the Office of Aging became Mr. Crull's Representative Payee for his social security and Fiduciary for the Veteran's Administration. At the time of the guardianship, the Office of Aging closed Mr. Crull's personal checking account and opened a guardian checking account at M& T. Initial balance was $276.05. Current balance is $1633.07 Mr. Crull's monthly income includes $218.00 from Social Security, $115.00 from VA compensation, $977.85 from his civil service pension and $90.94 from his Public School Employee pension. His monthly net total was $1401.79. The Agency also filed his 2006 income taxes. During most of the year, Mr. Crull's payment to the Thornwald Home, the nursing home where he is residing, was $1316.12. The Petitioner is the Area Agency on Aging, in and for Cumberland County, with its office located at 16 West High Street, Carlisle, Cumberland County, Pennsylvania. ,., .<.. On April 22, 2004, Petitioner filed a Petition for the Appointment of Emergency Plenary Guardian of the Person and Estate of Lee Crull, and for Permanent Plenary Guardian of the Person and Estate of Lee Crull. 3. On April 29, 2004, after a Hearing, Petitioner was appointed Temporary Plenary Guardian of the Person and Estate of Lee Crull. 4. C'j ~-- '_.J 5. On May 13, 2004, Lee Crull was adjudicated an incapacitated person and Petitioner was appointed Permanent Plenary Guardian of the Person and Estate of the said Lee Crull. A copy of the appointment of the Petitioner is attached hereto, marked as Exhibit "A" and incorporated herein by reference. 6. Medical Assistance regulations as set forth in Nursing Care Handbook instructions allow for the payment of Guardian fees as a deduction when determining contribution toward cost of care. 7. The amount of the Guardian's fee that is allowable as a deduction is the actual fee paid subject to a maximum of 10% of the person's gross monthly income or $100.00 per month, whichever is less. 8. The said Lee Crull receives monthly social security benefits which, at the time of the filing of the Guardianship Petition, was $1,345.64 per month and is now higher. 9. Petitioner believes and, therefore, avers that it is entitled to receive payment of a Guardianship fee as allowed by Medical Assistance regulations and that said fee be a deduction toward the cost of the care of Lee Crull. Guido appointed the Cumberland County Office of Aging temporary Guardian of Person for Lee Crull. Following this appointment, Mr. Crull returned to the Thornwald Home where he had been admitted on April 16, 2005. He was admitted to the Thornwald Home because he could no longer care for himself. His daughter, Sonya Crull, had been his caregiver but left the area for several months without making adequate arrangements for his care. His daughter also had several mental health hospitalizations, including some out of state. On May 13, 2004 the Cumberland County Office of Aging was appointed permanent Guardian of Person. Mr. Crull continues to reside at Thornwald Home. At the time of his admission, Mr. Crull was diagnosed with dementia, hypertension and congestive heart failure. The only new diagnoses is hypercholesterolemia. His medications currently include atenolol 50 mg QD, furosemide 40mg QD, lipitor 10mg QD, lisinopril 5 mg QD, Tylenol 325mg 2 every 4 hours PRN. Mr. Crull adjusted well to the nursing home. He continues to ambulate well but needs cueing with most of his activities of daily living. The at latest care plan meeting, staff advised that there have been no major changes in his care needs. His diet is the same and his weight is stable. He is occasionally exit seeking and therefore continues to wear a Wanderguard bracelet. He is also considered a fall risk. There have been no significant changes in behavior and he still occasionally taunts certain staff and residents. According to the social worker's notes he does not actually attend group activities but comes in after they start and sits in the chair right inside the door observes. The Office set up funeral arrangements with the Egger Funeral Home in Newville several years ago. It is the request of the Cumberland County Office of Aging that the agency retains Guardianship of Person for Lee Crull. The Thornwald Home has demonstrated an adequate quality of care for his medical and mental problems. Guido appointed the Cumberland County Office of Aging permanent Plenary Guardian of Estate for Lee Crull. Subsequently the Office of Aging became Mr. Crull's Representative Payee for his social security and Fiduciary for the Veteran's Administration. At the time of the guardianship, the Office of Aging closed Mr. Crull's personal checking account and opened a guardian checking account at M&T. Balance at the beginning of May 2007 was $1633.07. His monthly income during 2008 was $222.00 from social security, $117.00 in Veterans Administration Compensation, $992.34 in Federal Civil Service Pension and $90.94 in Public School Pension for a total of $1422.28 per month. During most of the year, Mr. Crull's payment to the Thornwald Home, the nursing home where he is residing, was $1356.02 per month. There were some payments made for personal items, supplies, and clothing. In addition, the final payments were made to Egger Funeral Home in Newville for funeral pre-arrangements. The balance at the end of April 2008 was $1306. 41. Attached is a financial summary of Lee Crull's income and expenses. Also attached is a spread sheet representing his checking account register. Guido appointed the Cumberland County Office of Aging permanent Plenary Guardian of Estate for Lee Crull. Subsequently the Office of Aging became Mr. Crull's Representative Payee for his social security and Fiduciary for the Veteran's Administration. At the time of the guardianship, the Office of Aging closed Mr. Crull's personal checking account and opened a guardian checking account at M&T. Balance at the beginning of May 2008 was $1315.97. His monthly income during 2008 was $222.00 from social security (May -Dec 2008) and $240 (Jan -May 2009), $117.00 (May - Dec 2008) and now $12300 from Jan -May 2009) in Veterans Administration Compensation, $992.34 (From May-Dec 2008) and $1039.94 (Jan -May 2009) in Federal Civil Service Pension and $90.94 in Public School Pension. The total per month is currently $1494.00. The balance at the end of April 2009 was $2354.82. During most of the year, Mr. Crull's payment to the Thornwald Home, the nursing home where he is residing, was $1277.39 per month. There were some payments made for personal items, supplies, Christmas gifts (mostly clothing). Payments toward funeral pre-arrangements were finalized during 2007-2008. They were made with Egger Funeral Home in Newville. As we have done since becoming his guardian, we took his income tax to AARP to be completed. Although he does not have to pay any or gets any refund, he has to file because of his income. He received the stimulus payment for $300 in July 2008. Starting in July 2008, after petitioning the court for permission, the Cumberland County Office of Aging began receiving $100 out of his income for guardianship fees. s Attached is a financial summary of Lee Crull's income and expenses. On April 29, 2004 Judge Edward E. Guido appointed the Cumberland Cgb%~i~fficof Aging temporary Guardian of Person for Lee Crull. Following this appoirfflnt, Mr,,~, Crull returned to the Thornwald Home where he had been admitted on A~T~16, 20~. He was admitted to the Thornwald Home because he could no longer care for ~' himself. His daughter, Sonya Crull, had been his caregiver but left the area for several months without making adequate arrangements for his care. His daughter also had several mental health hospitalizations, including some out of state. On May 13, 2004 the Cumberland County Office of Aging was appointed permanent Guardian of Person. Mr. Crull continues to reside at Thornwald Home. At the time of his admission, Mr. Crull was diagnosed with dementia, hypertension and congestive heart failure. Since then he has been diagnosed with hypercholesterolemia and most recently aphasia. His medications currently include atenolol 50 mg QD, furosemide 40mg QD, lipitor 10mg QD, lisinopril 5 mg QD, Tylenol 325mg 2 every 4 hours PRN. And tubersol intradermal soluctiioon 5 unit/.01 ml. Mr. Crull adjusted well to the nursing home. He continues to ambulate and usually walks along with the staff person delivering the mail. He needs cueing with most of his activities of daily living. The at latest care plan meeting, staff advised that there have been no major changes in his care needs, although he needs a little more help with transferring in and out of bed. His weight is stable at 200.2 pounds and he eats about 90% of his meals. He is considered a fall risk and has fallen several times this past year receiving small skin tears but no major injuries. There have been no significant changes in behavior and he still occasionally taunts certain staff and residents. According to the social worker's notes he does not actually attend group activities but comes in after they start and sits in the chair right inside the door observes. In his most recent mini-mental exam he scored 9 out of 30 which is two less correct than the last time. The Office set up funeral arrangements with the Egger Funeral Home in Newville several years ago. I received one correspondence from his daughter, Sonya, requesting an update on her father which I provided by letter. It is the request of the Cumberland County Office of Aging that the agency retains Guardianship of Person for Lee Crull. The Thornwald Home has demonstrated an adequate quality of care for his medical and mental problems. Guido appointed the Cumberland County Office of Aging temporary Guardian of Person for Lee Crull. Following this appointment, Mr. Crull returned to the Thornwald Home where he had been admitted on April 16, 2005. He was admitted to the Thornwald Home because he could no longer care for himself. His daughter, Sonya Crull, had been his caregiver but left the area for several months without making adequate arrangements for his care. His daughter also had several mental health hospitalizations, including some out of state. On May 13, 2004 the Cumberland County Office of Aging was appointed permanent Guardian of Person. Mr. Crull continues to reside at Thornwald Home. At the time of his admission, Mr. Crull was diagnosed with dementia, hypertension and congestive heart failure. Since then he has been diagnosed with hypercholesterolemia and aphasia. In October, Lee began to experience medical problems including diarrhea and loss of appetite. The doctor ordered tests for liver and gall bladder and they were negative. On October 14, 2009 Lee presented with symptoms of a blood clot in his leg and he was hospitalized at the Carlisle Regional Center. He returned to the Home on October 15t" but was readmitted to the hospital with a gastro-intestinal bleed on October 22nd. They diagnosed the bleed was from the medication to reduce the blood clot. He returned to the Home and his doctor there told me that he felt believed the symptoms are pointing to an intestinal mass. Upon his recommendation, we approved comfort measures only. Lee Crull passed away October 29, 2009. We notified the family via his sister Ruth Stambaugh. Subsequently the Office of Aging became Mr. Crull's Representative Payee for his social security and Fiduciary for the Veteran's Administration. At the time of the guardianship, the Office of Aging closed Mr. Crull's personal checking account and opened a guardian checking account at M&T. Balance at the beginning of May 2008 was $1315.97. His monthly income during 2008 was $222.00 from social security (May -Dec 2008) and $240 (Jan -May 2009), $117.00 (May - Dec 2008) and now $12300 from Jan -May 2009) in Veterans Administration Compensation, $992.34 (From May-Dec 2008) and $1039.94 (Jan -May 2009) in Federal Civil Service Pension and $90.94 in Public School Pension. The total per month is currently $1494.00. The balance at the end of April 2009 was $2354.82. On October 29, 2009 Lee Crull passed away. Since the financial guardianship report in April, funds were spent on room and board at the nursing home, guardianship fees, glasses and some clothing items. His funeral arrangements were pre-paid. Attached is a financial summary of Lee Crull's income and expenses. Also attached is a spread sheet representing his checking account register. His final balance was $2587.03. The nursing home had already received their payment for October.
