I represent Gerald E. Fitzgerald, proposed Administrator of the Estate of Patrick J.
Fitzgerald. I received your email dated December 17, 2008, a copy of which is enclosed
for your convenience. As per your request I have enclosed the following:
1. $15.00 check made payable to Register of Wills
2. Explanation letter from Gerald E. Fitzgerald
3. Amended Petition For Probate And Grant of Letters
My client overstated his probate estimate due to misinformation given to him regarding the
difference between what constitutes a probate and non-probate asset. The decedent had a
large pension with the State Employees' Retirement System with a beneficiary designation.
This pension was mistakenly included in his probate estimate. Please calculate probate
based on assets of $230,000.00 and issued a refund to Gerald E. Fitzgerald. In addition
please issue a new decree for bond with an amount of $460,000.00. The name also needs
to be changed on the decree for bond from the Estate of Patrick J. Fitzpatrick to Patrick J.
Fitzgerald.
