WHEREAS SARAH A. SHERIFF entered into a contract with
SARAH A. SHERIFF AND N?A ,
to provide materials and/or to perform labor necessary for the construction and erection or the alteration and repair of
(a) building(s) upon those certain pieces or parcels of land situated in NORTH NEWTON TOWNSHIP ,
('TTMB .RT.AND County, Pennsylvania, being more particularrly bounded and described as follows:
Deed from Jamie L. Freberg and Matthew D. Freberg Dated 1~~9~~~ and intended to be
recorded preceding the recording of this stipulation to Sarah A. Sheriff.
NOW, THEREFORE, it is hereby stipulated and agreed by and between the said parties, as part of the said
contract and for the consideration therein set forth, that neither the undersigned contractor, any sub-contractor or
materialman, nor any other person furnishing labor or material to the said contractor under this contract shall file a lien,
commonly called a mechanic's lien, for work done or materials furnished to the said building or any part thereof.
This stipulation is made and intended to be filed with the County Prothonotary within ten (10) days after date, in
accordance with the requirements of Act of Assembly of Pennsylvania, in such case provided (49 P.S. 1402).

r ALL that tract of land in North Newton Township, Cumberland County, Pennsylvania,
being more particularly described as follows:
BEGINNING at an existing axle on the western right-of--way line of Heim Court at
corner of land now or formerly of John D. and Ann B. Zimmerman; thence in and along
the western right-of- way line of Heim Court, South 03 degrees 51 minutes 59 seconds
West, 59.83 feet to an iron pin set; thence continuing along the western right-of--way line
of Heim Court, by a curve to the right on a circle having a radius of 175.00 feet, an arc
distance of 88.94 feet, and a long chord bearing of South 18 degrees 25 minutes 33
seconds West, 87.98 feet to an iron pin set; thence in and along the same, South 32
degrees 59 minutes OS seconds West, 25.05 feet to an iron pin set; thence in and along the
same, by a curve to the right on a circle having a radius of 30.00 feet, an arc distance of
3.14 feet, and a long chord bearing of South 35 degrees 59 minutes 00 seconds West,
3.14 feet to an iron pin set at corner of Lot 9 on the hereinafter described subdivision
plan; thence by said Lot 9, North 57 degrees 00 minutes 55 seconds West, 160.51 feet to
an iron pin set on line of land now or formerly of John D. Zimmerman; thence by said
land now or formerly of John D. Zimmerman, North 66 degrees 26 minutes 40 seconds
East, 198.50 feet to an existing axle, the place of BEGINNING.
The above description was taken from a final subdivision plan for W. Irvin Nelson and
Jason E. Garner, dated August 19, 2005, and revised December 1, 2005, prepared by Eric
L. Diffenbaugh, Professional Land Surveyor, which plan is recorded in the Office of the
Recorder of Deeds in and for Cumberland County, Pennsylvania in Plan Book 92, at page
40. The above described lot is identified as Lot 10 on said Plan.
