RICHARD L. CAMPBELL, JR. ("Petitioner"), by and through his counsel, METTE, w
EVANS & WOODSIDE, hereby petitions the Orphans' Court Division of the Court of Common
Pleas of Cumberland County, Pennsylvania, for the purpose of dispensing with administration of
the Estate of Richard L. Campbell, Sr., deceased, and to issue a Decree of Distribution directing
the distribution of the entire balance of Decedent's estate as hereinafter set forth, pursuant to 20
Pa. C.S.A. §3102, and in support thereof avers:
Petitioner is Richard L. Campbell, Jr., an adult individual residing at 3137 Old
Oak Drive, Ellicott City, Maryland 21042. Petitioner is a son of the Decedent.
2. Decedent, Richard L. Campbell, Sr., resided at 507 Miller Road, Mechanicsburg,
Pennsylvania, Cumberland County, Pennsylvania, at the time of his death.
3. Decedent died on January 11, 2008, at 507 Miller Road, Monroe Township,
Cumberland County, Pennsylvania. He was 69 years old. See Certificate of Death attached
hereto as Exhibit A.
4. No petition for the appointment of a personal representative for the Decedent's
estate is pending or has been granted.
The gross value of all property owned by the Decedent at the time of death
(exclusive of real estate and of property payable under the section of the Probate, Estates and
Fiduciaries Code relating to payments to family and funeral directors, but including personal
property claimed as the family exemption) does not exceed $25,000.
6. Decedent's entire probate estate consists of Checking Account #0512085820 at
Commerce Bank with a balance of $4,305.22 as of September 19, 2008 and a 2004 Pontiac
Bonneville vehicle having a value of $4,025.00. See copy of Commerce Bank statement and
Kelly Blue Book valuation attached hereto as Exhibit B.
7. Petitioner did not have any interest in Decedent's probate assets. Petitioner
herein is a son of Decedent. Petitioner is one of six children of Decedent. Petitioner paid his
deceased father's bills for the year prior to Decedent's death, totaling $64,500.00, thus being
Decedent's only creditor.
8. Decedent, Richard L. Campbell, Sr., died intestate
9. Decedent was not survived by a spouse. The Decedent was survived by six
children.
10. A Pennsylvania Inheritance Tax Return has been filed by Petitioner. The
Pennsylvania Inheritance Tax Return indicates an insolvent estate with no inheritance tax being
owed to the Commonwealth of Pennsylvania by Decedent's estate.
11. Petitioner, Richard L. Campbell, Jr., has incurred the following expenses related
to the funeral, rent, administrative and other expenses on behalf of Decedent's estate:
Myers-Harner Funeral Home, Camp Hill, PA -
Funeral expense $ 4,600
Theo's Restaurant -Funeral meal 2,500
Mette, Evans & Woodside -Legal fees 1,000
Last 6 Months Rent for Decedent 7,500
Subtotal Administrative, Rent and Funeral Expenses
(priority claims) 15,600
Prior 6 Months Rent for Decedent 7,500
Miscellaneous bills and payoff of credit cards 45,000
Subtotal Debts of Decedent 52,500
TOTAL $68,100
12. Petitioner requests that Commerce Bank Checking Account #0512085820 and
the proceeds from the sale of the 2004 Pontiac Bonneville be paid to Petitioner, Richard L.
Campbell, Jr., as reimbursement toward the above-referenced expenses provided to
Decedent's estate. Further, Petitioner requests the Court grant him the authority as
representative of his father's estate to execute the title to Decedent's 2004 Pontiac Bonneville in
order to be able to transfer the title and retain the proceeds from the sale of said vehicle as
reimbursement toward the above-referenced expenses provided to Decedent's estate.
WHEREFORE, Petitioner respectfully requests the Court to direct distribution of the
entire distributable balance of the Decedent's estate consisting of Commerce Bank Checking
Account #0512085820 in the amount of $4,305.22 and the proceeds from the sale of the 2004
Pontiac Bonneville to Richard L. Campbell, Jr. as reimbursement to him for his payment of the
above-referenced funeral, rent and administrative expenses provided to Decedent's estate,
which are priority disbursements, and further requests authorization to Richard L. Campbell, Jr.,
Petitioner to execute the title to the 2004 Pontiac Bonneville and retain the proceeds from the
sale of said vehicle to help satisfy the reimbursement of the above-referenced priority expenses.
