Sager, Guardian for Robert McLaughlin, by and through his attorneys acting as local counsel, Mark W. Allshouse and the Pennsylvania State University: The Dickinson School of Law Elder Law Clinic. The petition of the undersigned respectfully represents that: 1. Your petitioner, Marcel A. Sager, who is 18 years of age or older, and the guardian of Incapacitated Person, Robert MacLauchlan, a/k/a Robert MaLLaughlin, a/k/a Robert McLaughlin, age 81, who resides at The Holliswood Care Center, 195-44 Woodhull Ave. Rm. 226C, Hollis, NY 11423. 2. Robert MacLauchlan's next of kin is non-marital daughter, whose whereabouts are unknown. 3. Petitioner was appointed Substitute Guardian in New York State on February 13, 2007. 4. On November 7, 2008, Petitioner filed an Affidavit of Foreign Fiduciary and an exemplified copy of his New York Appointment as Guardian with the Recorder of Wills in Cumberland County, pursuant to 20 Pa. C.S. 4101. 5. Petitioner applies to this court for approval to sell the unimproved parcel of land that exists in Dickinson Township, Cumberland County, Pennsylvania, which is owned by Robert MacLauchlan and is located on Pine Road at Map No. 08-12- 0334-066. 6. The New York Court has given the proper authorization for Petitioner to seek permission from the Orphan's Court in Cumberland County to sell the above mentioned property. A copy of said permission is attached as Exhibit "B." 7. Title to said land was acquired by Robert MacLauchlan by transfer in FEE SIMPLE on Apri13, 1980 from the estate of Florence Edith Carothers MacLauchlan, a/k/a Florence E. MacLaughlan. A copy of the deed is included as Exhibit "A." 8. Petitioner is not otherwise authorized to sell the above mentioned property in the Commonwealth of Pennsylvania. 9. The property was assessed in 2004 by the Cumberland County Assessment Office at X79,200.00. 10. A copy of the legal description of the real property to be sold is attached as Exhibit "C." 11. The sale is desired and will benefit Robert MacLauchlan so that he and his estate may use the proceeds to pay for his care in New York. 12. Petitioner conducted a diligent lien search, and to the best of petitioner's knowledge there are no liens on the property that would affect Mr. MacLauchlan's sale of it. A copy of the search is attached as Exhibit "D." WHEREFORE it is respectfully requested by your Petitioner that he be granted approval to sell the above mentioned parcel of land on behalf of Robert McLaughlin.
