COMPLAINT
1. The Plaintiff, BEVERLY BRUNGARD, is an adult individual with an
address of 1415 Valley Road, Marysville, Perry County, Pennsylvania 17053.
2. The Defendant, GARY BOWSER, is an adult individual with an
address of 5 Tiffany Drive, Carlisle, Cumberland County, Pennsylvania 17015.
3. At all times relevant herein, Plaintiff, BEVERLY BRUNGARD, was the
operator of a certain 1992 Honda.
4. At all times relevant herein, Defendant, GARY BOWSER, was the operator
of a 2000 Saturn.
5. On March 20, 2007, at or about 8:50 a.m., the Plaintiff, BEVERLY
BRUNGARD, was proceeding in her aforesaid vehicle in a westerly direction on Route
641, Trindle Road, in the Township of Hampden, County of Cumberland,
Commonwealth of Pennsylvania, approaching the intersection of the aforesaid road with
Railroad Avenue.
6. At the aforesaid time and date and approximate location, the
Defendant Bowser was stopped at a stop sign in his aforesaid vehicle at the intersection
of Brian Road and Trindle Road. The intersection of Brian Road and Trindle Road is
west of the intersection of Railroad Avenue and Trindle Road.
7. At the approximate location and time as aforesaid, the Defendant
Bowser made a sudden left hand turn pulling out from Brian Road onto Trindle
Road directly into the path of the Plaintiff's vehicle.
8. As a result of the Defendant's failure to yield the right of way onto
oncoming traffic and violation of the laws of the Commonwealth of Pennsylvania,
the Defendant's sudden and unexpected turn out from Brian Road into the
Plaintiff's vehicle's path on Trindle Road caused a sudden and violent collision to occur
between the Plaintiff s and Defendant's vehicles.
9. The aforesaid collision was caused solely by the carelessness,
recklessness, and negligence of the Defendant Bowser in that he:
a. failed to see the Plaintiff's vehicle approaching;
b. failed to wait for all traffic to pass before attempting to pull out from a
stop sign onto a thru street;
c. made a sudden and violent move directly into the path of the Plaintiff s
vehicle; and
d. violated Pennsylvania Motor Vehicle Code in that he failed to yield the
e. right-of-way to the Plaintiff.
10. Solely as a result of the Defendant's carelessness, recklessness,
and negligence, the Plaintiff suffered severe and sundry injuries to her person.
11. Solely as a result of the carelessness, recklessness, and
negligence of the Defendant, the Plaintiff is entitled to the award of both past and
future damages for the following elements of damage as recognized by the law of
the Commonwealth of Pennsylvania, to wit:
a. pain and. suffering;

b. medical bills;
c. emotional distress; and
d. loss of enjoyment of life;

BEVERLY BRUNGARD vs. GARY BOWSER
12. The Plaintiff, BEVERLY BRUNGARD, incorporates by reference
thereto Paragraph numbers 1 through 11 as if more fully set forth herein by
reference thereto.
WHEREFORE, the Plaintiff demands judgment in her favor and against
the Defendant in an amount in excess of the amount for mandatory referral to
arbitration.
COUNT II
ROY BRUNGARD vs. GARY BOWSER
13.The Defendant, ROY BRUNGARD, incorporates by reference
thereto Paragraph numbers 1 through 11 as if more fully set forth herein
by reference thereto.
14. Solely as a result of the carelessness, recklessness, and
negligence of the Defendant, the Plaintiff, ROY BRUNGARD, suffered the loss of
consortium and is entitled to the award of damages for loss of consortium.
WHEREFORE, the Plaintiff, ROY BRUNGARD, demands judgment in his
favor and against the Defendant in an amount in excess of the amount for
mandatory referral to arbitration.
