Kirkpatrick and Dawn E. Kirkpatrick, by and through their attorneys, Friedman & King, P.C., and aver as follows: 1. The Plaintiffs are Timothy J. Kirkpatrick, residing at 517 Herrin Dr., Enola, Cumberland County, Pennsylvania 17025, and Dawn E. Kirkpalrick, residing at 237 Cumberland Road, Camp Hill, Cumberland County, Pennsylvania 17011. 2. The Defendant is Daniel T. Piscioneri, t/d/b/a Piscioneri Rentals, with a business address of 3315 Market Street, Camp Hill, Cumberland County, Pennsylvania 17011. 3. On or about October 23, 2002, the parties entered into a Residential Lease Agreement in which the Plaintiffs agreed to lease from Defendant certain real property located at 215 Green Lane Drive, Camp Hill, Cumberland County, Pennsylvania 17011. A copy of the Residential Lease Agreement is attached hereto, marked as Exhibit "A", and incorporated herein by reference. 4. Pursuant to the Lease Agreement, the Plaintiffi; did pay to the Defendant a security deposit in the amount of $1,295.00. 5. The Lease Agreement between the parties naturally terminated on or about October 31, 2003. 6. Pursuant to 68 P.S. §250.512(e) the Plaintiffs did provide to the Defendant landlord their new address in writing upon termination of the lease and surrender of the property. 7. By way of correspondence dated November 25, 2003, the Defendant landlord did correspond with the Plaintiffs, in which correspondence the Defendant landlord indicated that he was deducting $747.15 from the security deposit, and in which he enclosed a check for the balance of $547.85. A copy of the correspondence is attached hereto, marked Exhibit "B", and incorporated herein by reference. 8. In the correspondence dated November 25, 2003, the Defendant landlord indicated that the Plaintiffs/tenants were responsible for the grass, shrubbery and clean up, which averment is denied by the Plaintiffs. It is further averred by the Plaintiffs that the lawn of the rented property was mowed prior to surrender of possession, and the landscape was in as good or better condition than on the date that they moved in. 9. The Defendant landlord, in his correspondence dated November 25, 2003, averred that his inspection of the home when the Plaintiffs vacated resulted in the landlord having to paint the three bedrooms and living room, and the Plaintiffs deny that through any action or inaction of the Plaintiffs was there any need to paint the home, and Plaintiffs further aver that the condition of the interior paint was the same as on the day in which they moved in, other than normal "wear and tear". 10. In his letter dated November 25, 2003, the Defendant landlord averred that the window in the family room was not broken prior to the Plaintiffs' occupancy, which averment is denied by the Plaintiffs. The Plaintiffs further aver that the window was broken when they first inspected the property, and also on the date in which they began their tenancy, and was never fixed or replaced by the landlord during the Plaintiffs' tenancy. 11. Pursuant to 68 P.S. §250.512(c), "If the landlord fails to pay the tenant the difference between the sum deposited ... and the actual damages to the leasehold premises caused by the tenant within thirty days after termination of the lease or surrender and acceptance of the leasehold premises, the landlord shall be liable in assumpsit to double the amotmt by which the sum deposited in escrow.., exceeds the actual damages to the leasehold premises caused by the tenant as determined by any court of record or court not of record having jurisdiction in civil actions at law." 12. It is believed, and therefore averred, that there were no actual damages to the leasehold premises caused by the tenants during their tenancy. 13. Pursuant to 68 P.S. §250.512(c), "The burden of proof of actual damages caused by the tenant to the leasehold premises shall be on the landlord." 14. Prior to the filing of the instant Complaint, tl~te Plaintiffs initiated an action at the district justice level, in which they incurred costs of $70.50, and the Plaintiffs have further incurred filing costs of $55.25, for a total of $125.75. WHEREFORE, the Plaintiffs respectfully request this Honorable Court to award them damages in the amount of $1,494.30, which amount equals double the amount (as allowed by statute) wrongfully withheld by the Defendant landlord, plus costs incurred by Plaintiffs in this action in the amount of $125.75, for a total of $1,620.05, plus all other relief as this Court deems appropriate, plus interest.
