COMPLAINT IN EOUITY
Plaintiff, Heath A. Freeland, is an adult individual residing at 2416 Rye Circle,
Mechanicsburg, Cumberland County, Pennsylvania 17055.
2. Defendants are Timothy F. Gorka and Marilyn J. Gorka, husband and wife,
residing at 650 Stoney Run Road, Dillsburg, York County, Pennsylvania 17019-9501.
3. On or about March 16, 2004, Plaintiff and Defendants entered into an agreement
for the sale of a property ("Agreement") located at 5500G Gloucester Street, Mechanicsburg,
Cumberland County, Pennsylvania 17055. Pursuant to the terms of the Agreement, Plaintiff
submitted deposits totaling $1,000 to Defendants. As required under the agreement, the deposit
is being held by Defendants' real estate broker and is believed and therefore averred to have been
placed in an interest-bearing escrow account pending the settlement. A copy of the Agreement is
attached hereto as Exhibit "A".
4. The legal description of the subject real property is attached hereto and
incorporated herein by reference at Exhibit "B".
Pursuant to the terms of the Agreement, settlement was scheduled for April 29,
2004.

Defendants failed and refused to attend the settlement and convey the subject real
property in accordance with the Agreement.
7. As a result of Defendants' wrongful conduct in revoking the Agreement with
Plaintiff and their expressed intention not to convey the property to Plaintiff, the Plaintiff has
suffered unique damages for which no adequate remedy exists at law.
WHEREFORE, Plaintiffrequests that the Court award him the following reliefi
(a) Order Defendants to perform specifically the agreement of sale between
the parties;
(b) Order Defendants to convey to Plaintiff marketable title, free of all
encumbrances;
(c) Order Defendants to sign, seal, acknowledge and deliver a deed to the
Plaintiff in proper legal form;
(d)Award to Plaintiff his costs; and
(e)Order such relief as may be appropriate.
