JOINT PETITION FOR THE APPOINTMENT OF AN AUDITOR
AND NOW COME the Accountant, Lawrence C. Hull, and the Objectant, Tracy A.
Hull, by and through their respective attorneys undersigned, and jointly petition for the
appointment of William A. Duncan, Esquire, as Auditor and Master, to hear and
determine the Objections and Petition for Surcharge lately filed in this matter, in
response to the Second Interim Account of Lawrence C. Hull, executor of the Estate of
Herbert L. Hull, and state in support the following:
1. The Court appointed William A. Duncan, Esquire as master and auditor to
hear and consider the objections to the executor's first and partial account of the said
estate, and the proceedings regarding the first account are not yet complete.
2. Subsequent to the auditor's appointment to hear and determine matters
concerning the executor's first account, the executor filed his second interim account,
and objections thereto have been filed by Tracy A. Hull.
3. The parties agree that the efficiency of administration of this matter would
be aided by appointment of the same William A. Duncan, Esquire, as master and
auditor to hear and consider the second accounting of this estate.
WHEREFORE, the Accountant and the Objectant jointly pray this Court appoint
William A. Duncan, Esquire, as master and auditor to hear and make recommendations
to this Court with respect to the Second, as well as the First, Account of the Executor of
the Estate of Herbert L. Hull.
