Box 2371 Bloomington, IL 61702-2371 VS Brian T Ericson 267 Notch RD Duncannon, PA 17020 :Cumberland County, Pennsylvania :Civil Action Law No: O 9 - 5-36, 0, .1 -r«- COMPLAINT 1) Plaintiff State Farm Mutual Automobile Insurance Company is an insurance carrier licensed and authorized to conduct business in the Commonwealth of Pennsylvania and having as one of its principal places of business the above captioned address. 2) Andrew Grace an adult individual insured with Plaintiff State Farm Mutual Automobile Insurance Company on 03/05/2008. 3) Defendant Brian T Ericson is an adult individual residing at the above captioned address. 4) On or about 03/05/2008, Plaintiff State Farm Mutual Automobile Insurance Company insured Andrew Grace with personal automobile policy, claim number -38-L424 227 said policy covering a 2004 Nissan and carrying with same, collision coverages. 5) On or about 03/05/2008 at or near the intersection of Creekview Rd., Hampden Twp, Cumberland County, PA, Defendant Brian T Ericson while operating a 2007 Ford bearing PA tag YVL 6245,did negligently or recklessly strike/collide into Plaintiff's insured's 2004 Nissan causing damages to same in the amount of $21,545.06. 6) The negligence of the Defendant consisted of: a) failing to yield right of way; b) being inattentive; c) striking another motor vehicle lawfully upon the roadway; 411. d) failing to give due regard to the rights, safety point and position of Plaintiffs insured's vehicle; e) failing to maintain control of said vehicle so as to be able to stop within the assured clear distances ahead; f) improper turning methods, g) failing to give proper signal h) improper methods of passing: i) other such negligence that may be developed through continuing discovery and trial of this matter. 7) The aforesaid collision resulted solely from the negligent acts and/or failure to act on part of Defendant named herein and was due in no manner whatsoever to any act and/or failure to act on part of Plaintiff's insured. 8) As a result of the aforesaid collision, Plaintiff State Farm Mutual Automobile Insurance Company settled the collision claim of Andrew Grace in the amount of $21,545.06 (said figure includes the first party deductible) representing fair and reasonable reimbursement for the damages sustained. 9) Pursuant to the aforesaid policy of insurance, State Farm Mutual Automobile Insurance Company is subrogated to Andrew Grace for this loss. WHEREFORE, Plaintiffs demand judgment against the Defendant in the amount of $21,545.06 together plus costs, interest and such other relief this Court finds equitable and just. /?iBrian J. Ericson, by and through his attorneys, Goldberg, Miller and Rubin, P.C., file the within Joinder Complaint, joining Additional Defendant, Andrew Grace with New Matter Property Damage Claim and in support thereof, aver as follows: Plaintiff, State Farm Insurance Company, has filed a Complaint in the above- captioned matter, the terms and language of which are incorporated herein and made apart hereof by this reference, and any and all averments of liability directed to defendant, Brian T. Ericson is denied. A true and correct copy of plaintiff's Complaint is incorporated herein and made apart hereof as Exhibit 'A" . 2. In plaintiff, State Farm Insurance Company's complaint, State Farm alleges property damages of $21,545.06 in subrogation to their insured, additional defendant, Andrew Grace, for a motor vehicle accident Mr. Grace was involved in on March 5, 2008 with defendant, Brian T. Ericson. See Exhibit "A. " COUNT I- BRAD COCHRAN 3. At all times material, Andrew Grace, residing at 1123 Sandpiper Court, Mechanicsburg, Pennsylvania, owned, possessed and/or controlled a 2004 Nissan Maxima on or about March 5, 2008 at or near Creekview Road in Cumberland County, Pennsylvania. A true and correct copy of the police report is incorporated herein and made a part hereof as Exhibit "B ", 4. On or about March 5, 2008, additional defendant, Andrew Grace, was operating his 2004 Nissan Maxima on Creekview Road and negligently struck the 2007 Ford Ranger vehicle being operated Brian T. Ericson. 5. The collision was due solely to the actions of Additional Defendant, Andrew Grace, who was negligent, careless and reckless in regard to the operation of said vehicle causing damage to defendant's vehicle in the following respects: a. failing to keep his motor vehicle under proper and adequate control; b. operating said vehicle without due regard to the rights, safety and position of the vehicle in which Brian T. Ericson was operating; failure to keep a proper and adequate lookout; d. failure to look for or see the vehicle in which Brian T. Ericson was operating when he should have seen said vehicle; e. failing to yield the right of way to Brian T. Ericson's vehicle in the roadway; f. failing to maintain an assured clear distance ahead; g. driving at an excessive and unsafe speed; h. violating applicable ordinances and provisions of the Motor Vehicle Code of the Commonwealth of Pennsylvania and other statutes and case law governing the operation of motor vehicles on the streets and highways; and i. other acts of negligence and carelessness as may be adduced through discovery or at trial. 6. The aforementioned acts of negligence of additional defendant, Andrew Grace, caused plaintiff, State Farm Insurance Company, to incur any and all property damages as alleged in their Complaint. 7. If the averments of plaintiff s Complaint or certain of them are proven true and correct at the trial of this matter, then the plaintiff s damages were caused by the carelessness and/or negligence or other culpable conduct of additional defendant, Andrew Grace. Additional defendant, Andrew Grace, is therefore alone liable to plaintiff, jointly and severally liable with joining defendant, Brian T. Ericson, or liable over to joining defendant, Brian T. Ericson, on the cause of action declared upon the plaintiff s Complaint, the existence of any liability on the part of the defendant, Brian T. Ericson, being hereby expressly denied. WHEREFORE, defendant, Brian T. Ericson, prays that this Honorable Court enter judgment against additional defendant, Andrew Grace, and find additional defendant, Andrew Grace, solely liable for any and all damage sustained by plaintiff. Alternatively, defendant, Brian T. Ericson, prays that this Honorable Court enter judgment against additional defendant, Andrew Grace, as jointly and severally liable for any and all liability. Any such liability on the part of defendant, Brian T. Ericson, be specifically denied, in which case additional defendant, Andrew Grace, is liable over to defendant, Brian T. Ericson, for full indemnity and/or contribution including reimbursement of the damages, costs, legal expenses and fees. COUNT II - PROPERTY DAMAGE 8. Andrew Grace is an adult individual insured with State Farm Mutual Automobile Insurance Company. 3. Defendant Brian T Ericson is an adult individual residing at the above captioned add_c•ss. 4. Defendant Making the Dough, Inc t/a Domino's Pizza is a business entity having as one of its principle places of business the above captioned address. 5. On or about 03/05/2008 Plaintiff State Farm Mutual Automobile Insurance Company insured Andrew Grace with a personal auto policy, claim number -38 L 424 227 said policy covering a 2004 Nissan- and carrying with same collision and rental coverages. 6. On or about 03/05/2008, Defendant Brian T Ericson was acting as agent, servant, employee and/or workman and/or for the common purpose of Defendant Making the Dough, Inc t/a Dominos Pizza while he was operating a 2007 Ford bearing PA tag YVL 6245 registered to same when he was delivering a pizza and or other food products from Dominos Pizza. 7. On or about 03/05/2008 at or near the intersection of Creekview Rd., Hampden Twp., Cumberland County, Pennsylvania. Defendant Brian T Ericson, Nhile operating the aforesaid 2007 Ford did negligently, carelessly and/or recklessly, strike/collide into Plaintiff's insured's 2004 Nissan causing extensive damages to same. 8. The negligence of the Defendants consisted of: a) negligent entrustment; b) failing to exercise due care; c) being inattentive; d) failing to maintain proper lookout; e) failing to maintain control of said vehicle so as to be able to stop within the assured clear distances ahead; f) failing to yield right of way; g) being inattentive, h) improper use of turn signals; i) disregarding a posted stop sign; g) improper lane change h) failing to give due regard to the right, safety, point and position of plaintiffs property: 9. The aforesaid collision resulted solely from the negligent acts and/or failure to act on part of Defendants named herein and was due in no manner whatsoever to any act and/or failure to act on part of Plaintiff's insured. 10.
