THIS AGREEMENT made the 23rd day of April, 2004, by and between Douglas Thomas,
fid/b/a/ Thomas Building & Renovations, hereinafter referred to as Contractor, and Jason E.
Richwine and Kelly A. Richwine, hereinafter referred to as Owner, whereby the former undertook
and agreed to erect and construct a custom built home on that certain lot of ground situate at Lot 29
Prickly Pear Drive, Carlisle, North Middleton Township, Cumberland County, Pennsylvania, known
as more fully described in Exhibit "A" attached hereto and made a part hereof.
NOW THEREFORE, WITNESSETH: That the said Contractor, for and in consideration of
the sum of ($l.00) Dollar to Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the agreement aforesaid, for themselves
and their subcontractors, and all parties acting through or under them, covenant and agree that no
mechanic's liens or claims shall be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on account of any work done or materials
furnished by them or any of them under said contract or otherwise, for, towards, in, or about the
erection and construction of the said buildings on the lot above described, and the said Contractor,
for themselves, their subcontractors and others under them hereby expressly waive and relinquish
the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any
of them, and agree that this instrument, waiving the right of lien, shall be an independent covenant.

Jason E. Richwine and Kelly A. Richwine, husband and wife, known to me to be the persons whose
names are subscribed to the within instrument, and who acknowledge themselves to be the Owners
of Lot 29 Prickly Pear Drive, Carlisle, Pennsylvania and that they as such owners, executed the
foregoing statement for the purposes therein contained by signing their names.

ALL THAT CERTAIN unimproved tract of land situate in North Middleton Township, Cumberland County, Pennsylvania, being more
fully bounded and described according to a Final Subdivision Plan for Pkase I of Hillcrest Farms West, prepared by R. J. Fisher &
Associates, Inc., being recorded in the Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania, in Plan Book 86,
Page 57, as follows:
BEGINNING at a point along the southern side of Prickdy Pear Drive, a 50.00 foot wide right-of-way, at the dividing line between Lots
Nos. 29 and RI (which is land reserved for future development as Phase II of Hillcrest Farms West) of the hereinafter mentioned
subdivision plan; thence continuing along the same, South 76 degrees 02 minutes 45 seconds East, a distance of 239.I0 feet to a point
along the dividing line between Lots Nos. 28 and 29 of the hereinafter mentioned subdivision plan; thence continuing along the same,
South 11 degrees 15 minutes 12 seconds West, a distance of 218.47 feet to a point along the southern side of said Prickly Pear Drive;
thence continuing along the same by a curve to the right, having a radius of 235.00 feet, an arc length o f 367.80 feet, with a chord bearing
of Noah 34 degrees 51 minutes 34 seconds West, and a chord distance of 331.40 feet to a point along the southern side of said Prickly
Pear Drive at the dividing line between Lots Nos. 29 and RI, the point and place of BEGINNING.
