Appellant, a beneficiary in this estate matter, has filed a notice
of appeal from the September 19, 2008 order denying his motion for
recusal of the Honorable J. Wesley Oter, Jr. The subject order also
appoints a new auditor in place of the previously-appointed auditor.
An order denying a motion for recusal is interlocutory and not
appealable. See Kreig v, Kreig, 743 A.2d 509 (Pa. Super. 1999);
Kepis v, Perini Corp., 682 A.2d 845 (Pa. Super. 1996). The final
appealable order in a decedent's estate generally is the confirmation of
the personal representative's final account. Estate of Borkowski,
794 A.2d 388 (Pa. Super. 2002); Estate of Meininger, 532 A.2d 475
(Pa. Super. 1987).
Appellant is directed to show cause, within ten days of the date
this order is filed, why this appeal should not be quashed as having
been taken from an order that is interlocutory and not appealable. If,
following receipt of the response, it is determined that no action
should be taken at this time, the issue raised by this order will ~
referred to the panel assigned to decide the merits of the a I. TI
