Of 2002 PETITION FOR ADJUDICATION OF INCAPACITY AND APPOINTMENT OF PLENARY GUARDIAN OF THE ESTATE AND PERSON TO THE HONORABLE JUDGE OF THE COURT OF COMMONPLEAS: 1. Petitioners are the natural parents of Erin Michelle Hinaman, the alleged incapacitated person. 2. Erin Michelle Hinaman was born on November 22, 1973, is 28 years of age, whose address is 1917 Esther Drive, Carlisle, PA 17013. 3. The following persons are to the best of petitioner's knowledge, information and belief the only living next-of--kin of the alleged incapacitated person: A. Kathryn L. Hinaman who resides at 1917 Esther Drive, Carlisle, PA 17013 B. David N. Hinaman, Jr. who resides at 1917 Esther Drive, Carlisle, PA 17013 C. Rebecca A. Hinaman who resides at 3000 Woodrow Street, Portsmouth, VA D. David N. Hinaman, Sr. and Alice C. Hinaman who resides at 637 Shoulder Road, Williamsport, PA 17701. E. Richard J. Case who resides at 2390 W. Southern Avenue, Williamsport, PA 17701 4. Erin Michelle Hinaman is currently living with petitioners at 1917 Esther Drive, Carlisle, PA 17013. They previously lived in Carlisle, PA, moved to Maryland and returned to Carlisle on June 22, 2002. She has lived with petitioners for all of her life. 5. To the extent known by petitioners, the value of the assets of the alleged incapacitated person are approximately $500.00 of personal property. 6. Petitioners state the alleged incapacitated person's income to be $390.74 per month from SSI benefits and a Pa. stipend. These funds are received each month by petitioner and are expended on her behalf. 7. The alleged incapacitated person was not a member of the armed services of the United States and is not receiving benefits from the United States Veterans' Administration. 8. The alleged incapacitated person has suffered from Cerebral Palsy disease and Mental Retardation since she was 14 months of age, more than 26 years. She is currently under the care of Kimberly Young, M.D., whose office is located at the Dunham Army Health Clinic, U.S. Army War College in Carlisle, Pennsylvania. She is receiving services through the Cumberland County Mental Health/Mental Retardation office and is scheduled to be accepted at the Center for Industrial Training. 9. Because of her impaired mental condition, the alleged incapacitated person is totally unable to manage her financial affairs, property and business and to make and communicate responsible decisions relating thereto, including the ability to communicate her need for assistance in these areas. She is non-verbal. 10. Because of her impaired mental condition, the alleged incapacitated person lacks the capacity to make or communicate any and all responsible decisions concerning her person. 11. No other alternatives exist other than the appointment of a guardian of the estate and the person of Erin Michelle Hinaman. 12. The severity of the alleged incapacitated person's mental condition and the lack of viable, less restrictive alternatives necessitate that a plenary guardian of her estate be appointed to manage and handle all aspects of Erin Michelle Hinaman's person and estate, specifically including, but not limited to medical decisions and financial decisions regarding her financial affairs and property. 13. The proposed plenary guardians of the person of the alleged incapacitated person are her natural parents, David N. and Kathryn L. Hinaman who reside at 1917 Esther Drive, Carlisle, PA 17013. 14. The proposed plenary guardians of the person are a) her father, David N. Hinaman, date of birth 11/23/47, who is currently not employed, but retired as Sergeant Major with the United States Army, having graduated high school and Pennsylvania State University. b) her mother, Kathryn L. Hinaman, date of birth 11/9/48, employed as a critical care nurse at Pinnacle Health, Harrisburg Hospital, having graduated high school and Williamsport, PA and Anne Arundel, MD Community Colleges. 15. The proposed plenary guardians of the estate of the alleged incapacitated person are her parents David N. Hinaman, Jr. and Kathryn L. Hinaman. 16. The proposed plenary guardian has no interest adverse to the alleged incapacitated person. 17. The consent of the proposed plenary guardians is attached as Exhibit "A". 18. No other guardian has been appointed for the estate or person of the alleged incapacitated person, to the best of petitioner's knowledge. BA CKGROUND INFORMATIO N R ELEVANT TO THI A E MENT A . Historical Evaluation Data and Information: Erin currently is receiving Intensity V Special Education Services within this Special Center. Her previous assessment completed in December, 1991 under the supervision of this psychologist determined Erin's cognitive functioning to be at the 23 month level while she was 18 years of age. A psychological consultation and assessments were provided by Anne Arundel County School psychologists during July 1980, April 1981 May 1983 September 1983 and December 1991. While her family lived in Harrisburg a psychological assessment was completed there during May 1984 and December 1987. Erin has also attended schools through the Department of Defense in Germany. Since her return to Anne Arundel County, Erin has attended the Marley Glen School and is now attending Ruth Eason for the third year. B. Additional Background Information: Erin resides with her parents. She is currently receiving services with a medical diagnosis of Cerebral Palsy with accompanying developmental delays in cognitive limitations and speech delays. Erin's speech delay is compensated by nonverbal communication in the form of sign language and gestures. There is no additional reported information that would suggest that Erin has any other health, hearing or vision problems that would impact upon her learning and assessment performance. C . METHODS OF ASSF4c~rF vT. Based on previous assessments and current screening information, the following selection of instruments was determined to be valid measures to assess Erin's educational needs: Battelle Developmental Inventory (BDI) California Adaptive Behavior Scale (CABS) Observation Teacher Interview IV. BEHAVIORAI ~B RVATTnNS Erin was observed in her classroom engaging in a game of Bingo with her classmates. Upon seeing the examiner, Erin spontaneously signed the words mom and dad twice. Erin appears to require a great deal of prompting in order to participate in the game. When she was aware that she could cover a square, she would look at the teacher for approval. This eye contact with whomever is nearest, seems to make Erin more aware of what is occurring and also more motivated. She appears to be very receptive to verbal praise and uses eye contact and signs to expressive her feelings. VI. DISCUSSION OF ASSF,SSI~I .NT R SiJi TS• According to performance on these assessment instruments Erin's cognitive ability continues to fall within the mentally deficient range of intellectual functioning. On the Battelle Developmental Inventory, Erin's BDI total age equivalent was at the 31 month level. Relative strengths on this measure include personal social development where Erin's abilities fell near the four year old level. Specifically, Erin's expression of feelings and peer interaction abilities are very appropriate for her developmental level. Also, Erin's cognitive abilities have improved since the previous assessment using the BDI. Scores at that time report Erin's cognitive functioning was measured at the 27th month level while the current intellectual assessment places her at the 36th month level. The California Adaptive Behavior Scale also assesses relative strengths in the area of personal responsibility assisting at toileting and sustaining interest group activities for up to 90 minutes. All of these skill levels are at the four year old level. Wealrnesses continue to persist for Erin in the area of expressive language and independence at moving around the community. Mrs. Schuh was interviewed to give information relevant to this assessment. Mrs. Schuh has been Erin's teacher for three years and feels that Erin has improved in her independent work skills and maturity level. Erin continues to be easily distracted and still has severe communication delays. Erin was recently evaluated at the Kennedy-Krieger Institute to become eligible to receive augmentative communication devices. Other methods which have been implemented to assist Erin in expressing herself have not been effective. Mrs. Schuh reports that Erin is eager to learn new tasks and will work for reward, social praise as reinforcement. Erin is eager to please others and can blend in with students of other ability levels. She often attempts to help others and seems to enjoy receiving positive feedback for her efforts. VII. CONCLUSIOt~IS: Erin presented with the following characteristics: Her sub average intellectual and adaptive functioning continues to impact on her ability to learn and complete vocational tasks. This suggests that Erin continues to meet the eligibility for mental retardation. This information will be used in conjunction with other assessment findings to determine the extent of her educational disability and need for related services. The assessment results and future ARD analysis of the results are in compliance with Federal, State and County guidelines. It is recommended that this information be utilized during Erin's ARD meeting so that transitioning to opportunities outside of the school system should be available to Erin upon graduation in June, 1995. Her cognitive abilities continue to be measured within the profound range of mental retardation. Although Erin is clearly able to interact with the world around her particularly attuned to social interaction. Social skills are assessed at the four year old level. Medical diagnoses include cerebral palsy and developmental delays which have resulted in cognitive limitation and speech delay. Since her return from the Department of Defense Schools in Germany in.1980, Erin has received intensive special instruction within special centers. Psychological consultations and assessments were provided by Anne Arundel County school psychologists during July 1980, April 1981, May 1983, and September 1983. Erin and her family moved to the Harrisburg,. Pennsylvania, area where psychological assessments were completed during May 1984 and December 1987. Upon her return to Anne Arundel County, Erin initially attended the Marley Glcn School and eventually entered Ruth Eason School during January 1991. Psychological data was again requested to determine Erin's current cognitive functioning. ~iI~HAVIORA OBSERVATIONS: Observations and test results were obtained by Mrs. Sarah Eichhorn, psychometrist. Additional consultation and conferencing was provided by this writer. In preparation for the assessment, Erin was slightly reluctant to leave her classroom setting but quickly complied. She displays spontaneous signs which include "mother," "father," "drive," and "apple." She was also heard to say, "mom" and "daddy." During the assessment, she attempted to assist by turning the pages of the test bookies but often seemed to grasp more than one page at a time. This may suggest some fine motor difficulties with Erin. The Peabody Picture Vocabulary Test (PPVT) requires a pointing response from the student. On items which were considered within I~er level of ability, Erin was clear in her pointing response. However, as test items became more difficult she was observed to point impulsively, sometimes before the word had even been mentioned. Gesturing is also within Erin's repertoire. For example, on this Peabody test where receptive vocabulary is measured, Erin demonstrated a stretctrirtg before potnring to the picture depicting that activity. Even with the demonstration of the matching activity required to complete the Leiter, Erin appeared unable to match, even at the two-year-old level. Some interference of perseveration and misunderstanding of task may also have interfered with her performance of matching. For example, Erin would consistently place the blocks in the same sequence as presented by the examiner. This sequence, of course, would be incorrect. She would smile when praised by the examiner and would indicate her acceptance of this praise by clapping her hands. For the most part, Erin was cooperative on test activities. Consistency of performance has been documented by use of the Battelle and Vineland interviewing tnstruments. Relative strengths are noted in the personal/social domain, which places Erin's skills at the four- year-old level on the Battelle. However, the same socialization skills are measured at the two-year~ld level with the Vineland. - Erin has been with her current classroom teacher since September 1991. Behaviorally, Erin is described as pleasant and cooperative and seems to enjoy working. Actually, tf given a chancy to take a break or work, Erin will generally choose working. She can work on familiar routine tasks independently. For example, at the National Security Agency (NSA) where the school maintains a work training location, Erin was successful at her task at removing food trays from the dishwasher and stacking them. The reader is advised that one side of the tray had diagonal corners which made their stacking more difficult. At another location, Erin was successful with atowel-folding activity. She required only a small amount of shaping and continued prompts for her to successfully complete that activity. At another work location, Erin was trained to remove clothing garments from their shipping boxes and place them onto a rack. With some additional supervision to encourage her to always pick the top garment rather than one below in the stack, Erin was successful with this task as well. Erin is basically nonverbal, although she utilizes gestures and some sign effectively. However, some of her verbalization, while clear and distinct, are inappropriate. Goals on the IEP have presently been established to decrease the inappropriate verbalizations. Receptive skills, as measured by testing instruments, are samewhat higher than expressive skills. Furthermore, Erin is also able to determine nonverbal receptive communication. For example, Erin will respond correctly to a discouraging look from her classroom teacher. In addition to her gesturing and signing, Erin also utilizes a communication book with pictures if prompted. Erin displays good peer relationships and shows preferences for specific persons in her class. However, some assistance is still required in the social area to reduce her periods of staring at others and reaching out to touch others. These points are presently being addressed through a program of cueing which provides both verbal and physical reminders for Erin to become more appropriate in ~hcse two areas. Erin willingly shares her possessions. Self-care skills are good; she is able to dress and undress but needs some assistance with fasteners, such as hooks and buttons. _ Erin resists using the bathroom at school, although at home she is reported as independent in toileting. Erin reduces her liquid intake at school as if she understands that increased fluids would result in need for urination. She is able to feed herself without assistance.
