hereinafter referred to as Contractor,

referred to as Owners, whereby the contractor undertook and agreed
to erected and construct a dwelling on the certain lot of ground
situate in the ~er Alle~ T~wnship, ~,mherland County,
Commonwealth of Pennsylvania, and more fully described in Exhibit
"A" which is attached hereto and made a part hereof known as Lot 9.

NOW T~W~FO~%E, THI~ AGH~EMENT W~TNE~SETH: That the said
Contractor, for an in consideration of the sum of ($1.00) Dollar to
Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for itself, himself or themselves and its, his
or their subcontractors, and all parties acting through or under
them, covenant an~ agree that no mechanic,s liens or claims shall
be filed or main=dined by them or an~ of =hem a~ainst the said
buildings and the lot of ~round appurtenant thereto for or on
account of any work dons or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and construction of the said buildings on the lot
above described, and the said Con=factor, for itself, himself or
themselves, its, his or their subcontractors nnd others under them,
hereby expressly waive and relinquish the right to have, file, and
maintain any mechanic's liens or claims against the said buildings
or an}, of them, and a~ree =ha= this instrument, waiving the right
of lien, shall be an independent covenant.

Ail that certain tract or parcel of land situate in Upper Allen Township, Cumberland
County, Pennsylvania, being more partiealarly hounded and described as follows, to wit:
BEGINNING at a point on the dividing line between Lot Nos. 2-4 and 2-3 on the hereinafter
mentioned Plan of Lots; thence along said boundary line, North 56 degrees 19 minutes 00
seconds East, one hundred three and sixty one-hundredths (103.60) feet to a point on the
southern dedicated right of way line of Harvest Lane; thence continuing along same on a
curve to the left having a radius of fifty and zero one-hundredths (50.00) feet, an arc length
of one hundred thirty and ninety one-hundredths (130.90) feet to a concrete monument
located on the southern dedicated right of way line of Harvest Lane; thence continuing
along same, North 56 degrees 19 minutes 00 seconds East, six and seventy-one hundredths
(6.70) feet to a point on the dividing line between Lot Nos. 2-4 and 2-5 on the hereinafter
mentioned Plan of Lots; thence along said dividing line, South 33 degrees 41 minutes 00
seconds East, two hundred fifty-seven and ninety-nine one-hundredths (257.99) feet to a
point on the dividing line between Lot Nos. 2-4 and 2-6 on the hereinafter mentioned Plan of
Lots; thence along said dividing line, South 86 degrees 56 minutes 37 seconds West, two
hundred thirty-three and fifty eight one-hundredths (233.58) feet to a point; thence North
34 degrees 35 minutes 13 seconds West, one hundred sixty-two and thirteen one-
hundredths (162.13) feet to a point on a dividing line between Lot Nos. 2-4 and 2-3 on the
hereinafter mentioned Plan of Lots, the place of BEGINNING.
BEING Lot No. 2-4, on the Final Subdivision Plan for Deer Haven Phase II, said plan being
recorded in the Cumberland County Recorder of Deeds Office in Plan Book 72, Page 101.
