HomeMy WebLinkAbout04-1902STIPULATION AGAINST LIENS THIS AGREEMENT made the 29th day of April, 2004, by and between S&A Custom Built Homes, Inc. hereinafter referred to as Contractor, and Michael T. Bond and Beth A. Bond, hereinafter referred to as Owner, whereby the former undertook and agreed to erect and construct a custom built home on that certain lot of ground situate at 31 Coventry Drive ( Lot 76), Forgedale Crossing Section 3, Carlisle, PA 17013, South Middleton Township, Cumberland County, Pennsylvania, known as more fully described in Exhibit "A" attached hereto and made a part hereof. NOW THEREFORE, WITNESSETH: That the said Contractor, for and in consideration of the sum of ($1.00) Dollar to Contractor in hand paid by Owner, the receipt whereof is hereby acknowledged, and the further consideration mentioned in the agreement aforesaid, for themselves and their subcontractors, and all parties acting through or under them, covenant and agree that no mechanic's liens or claims shall be filed or maintained by them or any of them against the said buildings and the lot of ground appurtenant thereto for or on account of any work done or materials furnished by them or any of them under said contract or otherwise, for, towards, in, or about the erection and construction of the said buildings on the lot above described, and the said Contractor, for themselves, their subcontractors and others under them hereby expressly waive and relinquish the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any of them, and agree that this instrument, waiving the right of lien, shall be an independent covenant. Bond, husband and wife, known to me to be the persons whose names are subscribed to the within instrument, and who acknowledge themselves to be the Owners of 31 Coventry Drive ( Lot 76), Forgedale Crossing Section 3, Carlisle, Pennsylvania and that they as such owners, executed the foregoing statement for the purposes therein contained by signing their nmnes. Thompson, the Attorney in Fact for S&A Custom Built Homes, Inc., of 1060 Trindle Road, Carlisle, a Pennsylvania corporation, known to me or satisfactorily proven to be the person whose name is subscribed to the within instrument and acknowledged that he, as said Attorney-in-Fact, executed the same for the purposes therein contained. In witness whereof, I hereunto set my hand mad official seal. 3 SCHEDULE C PROPERTY DESCRIPTION The land referred to in this Commitment is described as follows: Beginning at a point, said point being located on the southern dedicated right of way line of Coventry Drive and located at the common property comer between Lot Number 76 and Lot Number 77 as depicted on the Final Subdivision Plan, Forgedale Crossing, Section Number 3 which is recorded in Plan Book 85, Page 92 in the Recorder of Deeds office of the Cumberland County Courthouse, Pennsylvania; thence along Lot Number 77, South 03 degrees 17 minutes 08 seconds East, a distance of 150.00 feet to a point located on the section line between Forgedale Crossing, Section Number 3 and Lot Number 82, (lands of Forgedale Associates); thence along said section line and Lot Number 82, South 86 degrees 42 minutes 52 seconds West, a distance of 156.23 feet to a point located at the common property corner between Lot Number 76 and Lot Number 75; thence along Lot Number 75, North 03 degrees 17 minutes 08 seconds West, a distance of 150.00 of 150.00 feet to a point located on the southern dedicated right of way line of Coventry Drive; thence along the southern dedicated right of way line of Coventry Drive, North 86 degrees 42 minutes 52 seconds East, a distance of 156.23 feet to the point of beginning. Lot Number 76's acreage is 23434.467 square feet. Lot Number 76 is subject to a 10' wide storm drainage easement along the southern property line of said lot as depicted on the aforementioned final subdivision plan. Lot Number 76 is subject to Forgedale Crossing, Section Number 2B's temporary storm drainage easement for Pond "B" until said easement is vacated as noted on the aforementioned final subdivision plan.
