THIS AGi~EEMENT made the ~t~'~day of April, 2004, by and
between W. LEE ROLAND, Builder, of 123 Windrush Lane,
Mechanicsburg, PA 17055, hereinafter referred to as Contractor,
AND W. LEE ROLAND and ROSALIE H. ROLAND, husband and wife, of 104
Lavynndon Lane, Mechanicsburg, PA 17055, hereinafter referred to
as Owner, whereby the former undertook and agreed to erect and
construct a single-family residential dwelling on that certain
lot of ground situate in Upper Allen Township, Cumberland County,
Pennsylvania, being Lot No. 64, Phase I Final Subdivision Plan of
Phase I, Lindenwood, dated February 3, 1997, last revised
July 17, 1997, said plan being recorded in Plan Book 75, Page 29.
Being a part of the same premises which Fred L. Glaize, Jr. Trust
and Fred L, Glaize and Elizabeth G. Helm, Co-Executors of the
Estate of Fred L. Glaize, Jr., by Deed dated May 1, 1997 and
recorded May 2, 1997 in the Cumberland Recorder of Deeds Office
in Deed Book 156, Page 1042, granted and conveyed unto
Lindenwood, Inc. Also being the same premises which Lindenwood,
Inc., by Deed dated April , 2004 and recorded in the
Cumberland County Recorder of Deeds Office in Deed Book ,
Page granted and conveyed unto W. Lee Roland and Rosalie H.
Roland, husband and wife.
NOW THEP. EFORE, THIS AGREEMENT WITNE$SHTH~ That the said
Contractor, for and in consideration of the sum of One ($1.00)
Dollar to him in hand paid by Owner, the receipt whereof is
hereby acknowledged, and the further consideration mentioned in
the agreement aforesaid, for themselves and their subcontractors,
and all parties acting through or under them, covenant and agree
that no mechanic's liens or claims shall be filed or maintained
by them or any of them against the said buildings and the lot of
ground appurtenant thereto for or on account of any work done or
materials furnished by them or any of them under said contract or
otherwise, for, towards, in, or about the erection and
construction of the said buildings on the lot above described,
and the said Contractor, for themselves, their subcontractors and
others under them hereby expressly waive and relinquish the right
to have, file, and maintain any mechanic's liens or claims
against the said buildings or any of them and agree that this
instrument, waiving the right of lien, shall be an independent
covenant.
