SHEAFFER, of 341 Garland Drive, Carlisle, Cumberland County, Pennsylvania, being of sound mind, memory and disposition, do hereby make, publish and declare this to be my Last Will and Testament, in manner and form following, hereby revoking and making void all wills by me heretofore made. FIRST: I order and direct that all my just debts and funeral expenses be fully paid and satisfied as soon as convenien~ ly may be after my decease. SECOND: I give, devise and bequeath, absolutely, all of my property, real, personal and mixed, of whatsoever kind and nature, and wheresoever situate, to my wife, BARBARA L. SHEAFFER. THIRD: In the event that my said wife predeceases me ol fails to survive me by sixty (60) days, I then, give, devise and bequeath all my said estate, absolutely, to my children, TERRY LYNNE SHEAFFER and PAMELA SUE SHEAFFER. FOURTH: In the event that any of my said children are b~neficiaries under this my Last Will and Testament, and have not reached the age of twenty-one (21) years, I then give, devise and bequeath, absolutely, their interest in my estate to DAUPHIN DE- POSIT TRUST COMPANY, Carlisle, Cumberland County, Pennsylvania, as Trustee with the following powers: · A. The power to pay the income of the said minor's estate towards the care, comfort, maintenance, support, health and education of the said minor. B. The power, within the discretion of the said Trustee, to pay out of the principal those amounts necessary for the care, comfort, maintenance, support, health and education of the said minors. C. The power to pay the balance of each beneficiaries interest to her upon her attaining the age of twenty-one (21), without the necessity of a formal ac- counting to the proper Orphan's Court but upon said Trustee receiving a proper receipt therefore. FIFTH: Ail principal and income shall, until actual distribution to any beneficiary be free of the debts, contracts, alienations, anticipations of such beneficiaries and the same shall not be liable to any levy, attachment, execution, or se- questration while in the possession of the Executor, Trustee, or Guardian. SIXTH: If my wife shall predecease me, but one or more of my children survives me, I hereby nominate, constitute and appoint my brother, W. CARL SHEAFFER, Guardian of said child or children. SEVENTH: I direct that my Executrix, hereinafter named, shall have full power in her discretion to do any and all things necessary for the complete administration of my estate, including the power to sell at public or private sale, and with- out any Order of Court, any real or personal property belonging to my estate, and to compound, compromise, or otherwise settle or adjust any and all claims, debts, charges, and demands upon or in favor of my estate as fully as I could do if living. I further direct that my Executrix, hereinafter named, shall have full power in her discretion to retain any investments made or possess~ by me. and to sell, to vary and to change the investments and re- investments without being limited to such investments as are or may be authorized by law for the investment of estate funds. EIGHTH: I nominate, constitute and appoint my wife, BARBARA L. SHEAFFER, to be the Executrix of this my Last Will and Testament; and if she is unable or unwilling to assume the duties of Executrix, I then nominate, constitute and appoint my children TERRY LYNNE SHEAFFER and PAMELA SUE SHEAFFER, if they have at- tained the age of majority. In the event they have not attained the age of majority, I then nominate, constitue and appoint my brother, W. CARL SHEAFFER, to be the Executor of this my Last Will and Testament. ( SEAL ) 3 NINTH: I direct that the Executrix and Executor, here- in named, shall not be required to give any bond or security for the faithful performance of their duties. TENTH: If my wife and I die simultaneously or in cir- cumstances which make it difficult to determine which of us died first, I direct that my wife shall have been deemed to have sur- vived me for the purpose of this Will, and I further direct that the provisions of this Will shall be construed upon that assump- tion irrespective of any provisions of law establishing a con- trary presumption or requiring survivorship for a fixed period as a condition of taking Droperty by inheritance.
