practicable after my decease all my just debts and the expenses of my
last illness and burial.

and mixed -,whatsoever and wheresoever situate, .unto my husband, Ward
W. Fenstermaker, absolutely.

Should my said husband, Ward W. Fenstermaker, predecease me, then
and in that event, I give, devise and bequeath my said estate unto my
daughters, . Rita E. Fenstermaker and Linda K. Fenstermaker, equally, share
and share alike.

I hereby nominate, constitute and appoint my said husband, .Ward
W. Fenstermaker, executor of this my last Will and Testament. Should my
said husband, Ward W. Fenstermaker, .fail to qualify or cease to act as
executor, I appoint my daughters, Rita E. Fenstermaker and Linda K.
Fenstermaker, and the survivor of them, as executrices of this my last Will
and Testament.

surviving spouse is 3% [72 P.S. ~9116 (a) (1.1) (i)].

[72 P.S. ~9116 (a) (1.1) (Ii)). The statute does not exemot a transfer to a surviving spouse from tax, and the statutory requirements for disclosure
of assets and filing a tax return are still applicable even if the surviving spouse is the only beneficiary.

The tax rate imposed on the net value of transfers from a deceased child twenty-one years of age or younger at death to or for the use of a natural

DEFINITION OF MARKET VALUE: The most probable price which a property should bring in a competitive and open market
under all conditions requisite to a fair sale, the buyer and seller, each acting prudently, knowledgeably and assuming the price is not
affected by undue stimulus. Implicit in this definition is the consummation of a sale as of a specified date and the passing oftitle from
seller to buyer under conditions whereby: (1) buyer and seller are typically motivated; (2) both parties are well informed or well advised,
and each acting in what he considers his own best interest; (3) a reasonable time is allowed for exposure in the open market; (4) payment
is made in terms of cash in U.S. dollars or in terms of financial arrangements comparable thereto; and (5) the price represents the normal
consideration for the property sold unaffected by special or creative financing or sales concessions. granted by anyone associated with the
sale.
.Adjustments to the comparables must be made for special or creative financing or sales concessions. No adjustments are necessary for
those costs which are normally paid by sellers as a result of tradition or law in a market area; these costs are readily identifiable since the
seller pays these costs in virtuaily all sales transactions. SpeciaJ or creative financing adjustments can be made to the comparable property
by comparisons to financing terms offered by a third party institutional lender that is not already involved in the property or transaction. Any
adjustment should not be calculated on a mechanical dollar for dollar cost of the financing or concession but the dollar amount of any
adjustment should approximate the market's reaction to the financing or concessions based on the Appraiser's judgment.
STATEMENT OF LIMITING CONDITIONS AND APPRAISER'S CERTIFICATION
CONTINGENT AND LIMITING CONDITIONS: The appraiser's certification that appears in the appraisal report is subject to the
following conditions:
1. The appraiser will not be responsible for matters of a legal nature that affect either the property baing appraised or the title to it. The
appraiser assumes that the title is good and marketable and, therefore, will not render any opinions about the title. The property is appraised
on the basis of it being under responsible ownership.
2. The appraiser has provided a sketch in the appraisal report to show approximate dimensions of the improvements and the sketch is
included only to assist the reader of the report in visualizing the property and understanding the appraiser's determination of its size.
3. The appraiser has examined the available flood maps that are provided by the Federal Emergency Management Agency (or other data
sources) and has noted in the appraisal report whether the subject site is located in an identified Special Flood Hazard Area. Because the
appraiser is not a surveyor, he or she makes no guarantees, express or implied, regarding this determination.
4. The appraiser will not give testimony or appear in court because he or she made an appraisal of the property in question, unless specific
arrangements to do so have been made beforehand.
5. The appraiser has estimated the value of the land in the cost approach at its highest and best use and the improvements at their
contributory value. These separate valuations of the land and improvements must not be used in conjunction with any other appraisal and
are invalid if they are so used.
6. The appraiser has noted in the appraisal report any adverse conditions (such as, needed repairs, depreciation, the presence of hazardous
wastes, toxic substances, etc. ) observed during the inspection of the subject property or that he or she became aware of during the normal
research involved in performing the appraisal. Unless otherwise stated in the appraisal report, the appraiser has no knowledge of any hidden
or unapparent conditions of the property or adverse environmental conditions (including the presence of hazardous wastes, toxic
substances, etc. ) that would make the property more or less valuable, and has assumed that there are no such conditions and makes no
guarantees or warranties, express or implied, regarding the condition of the property. The appraiser will not be responsible for any such
conditions that do exist or for any engineering or testing that might be required to discover whether such conditions exist. Becausethe
appraiser is not an expert in the field of environmental hazards, the appraisal report must not be considered as an environmental assessment
of the property.
7. The appraiser obtained the information, estimates, and opinions that were expressed in the appraisal report from sources that he or she
considers to be reliable and believes them to be true and correct. The appraiser does not assume responsibility for the accuracy of such
items that were furnished by other parties.
8_ The appraiser will not disclose the contents of the appraisal report except as provided for in the Uniform Standards of Professional
Appraisal Practice.
9. The appraiser has based his or her appraisal report and valuation conclusion for an appraisal that is subject to satisfactory completion,
repairs, or aiterations on the assumption that completion of the improvements will be performed in a workmanlike manner.
10. The appraiser must provide his or her prior written consent before the lender/client specified in the appraisal report can distribute the
appraisal report (including conclusions about the property value, the appraiser's identity and professional designations, and references to

without having to obtain the appraiser's prior written consent. The appraiser's written consent and approval must also be obtained before
the appraisal can be conveyed by anyone to the public through advertising, public relations, news, sales, or other media.

Gentlemen:
Attached you will find the FINAL PAYMENT on the inheritance tax on the Katherine R.
Fenstermaker estate. In my humble opinion, these inheritance taxes should have been paid by
the estate, but that is not how Mr. Schorp, Esq. (the estate attorney) chose to handle the estate.
Then when the tax Amnesty Program was instituted in 2010, I was told there were no further
taxes due on this estate other than the $200 + amount which I paid at that time. The contacts
made through Senator Pat Vance's office netted no positive results. However, I want you to
know that even though I am paying the balance due now, I am going to continue to call this type
of INCOMPETENCE of the Department of Revenue, Bureau of Inheritance Taxes to the
attention of anyone and everyone at the Department of Revenue as well as other contacts I
have.
I think this type of incompetence is disgraceful and when 1 brought this situation to the attention
of Crystal Caraway who wrote the November 1, 2013 letter to me, my sister and the estate
attorney, her attitude was "why didn't YOU follow up on it more frequently?" Since when is it the
taxpayer's responsibility to make sure that state workers are doing their jobs properly??? As
you can see from the note my sister wrote at the top of the November 1 letter on
November 14, 2013, someone named Yvonne told my sister that the estate was settled in
January 2005 and there was NO BALANCE DUE on mothe�'s estate!!! Where is the
thread of truth in all of these interactions we've had with employees of the Department of
Revenuel??
This kind of incompetence and misinformation is the same thing t ran into in 2010 when I paid
the $200 + amount. To say that I am NOT PLEASED is a VAST UNDERSTATEMENT and as I
said, I am not going to let this matter rest until I get an apology and a refund check for the
interest levied on this amount since the 2010 Amnesty Program.
I am paying this amount under protest for the above reasons.

I followed up on our telephone conversation and contacted the Department. Their reply is attached:
This joint bank account is an account with John Hancock, account number 21-2765843, which was
created on 7-15-1983. The value at the date of death was $51,742.76, since the account was made
joint prior to a year from the individual's death, the taxable value is $25,871.38. This amount was
taxed at the lineal rate of .045%, resulting in a tax due of $1,164.21. The original information notice
was dated 2-2-2005; since there was no response, an assessment was issued on 1-24-2006 with a
liability in the amount of $ 1,228.43. There was no response to this notice, so the account tracked into the
enforcement stage. Calls began on 8-16-2006 from our call center, and then the account was referred to Amnesty;
although there were two accounts with liabilities,the taxpayer only applied under amnesty for one account which
was not the one in question. The taxpayer made a $100.00 payment and today's balance is$1,587.35 consisting
of:

INTEREST+ 523.14
PAYMENTS- 100.00
CURRENT BAL= $ 1,587.35
There was a bit more back-and-forth with the Dept., but nothing concrete to share. 1'm left with the impression,
based on the above reply and what we discussed,that in 2010 you were given accurate information but not the
complete picture. The $200+/-you paid at that time of Amnesty probably did satisfy the account the case worker
was looking at. But,the second account referenced above either was overlooked by the case worker or was not
properly explained to you. Thus, it remains.
I know this is not the news hoped for. As frustrating as it is, since you are now on the repayment plan the best
advice we can offer is to stick with that schedule until the final$1587.35 is satisfied. In the meantime, keep a copy
of all payments, paperwork and ultimately obtain a letter/email indicating that the account is satisfied and closed.

Any notice issued after the tax becomes delinquent will reflect an interest calculation to 15 days
beyond the data of the assessment. If payment is made after the interest computation date shown on the
notice, additional interest must be calculated.
