James Kenneth Johnson of South Middleton Township died on February 16, 8906. B. On May 5, 2006, Letters Testamentary were granted to Kenneth R Johnson at File No. 21-06-0387 in the Register of Wills Office for Cumberland County, Pennsylvania. C. Executor has administered the estate up until the present time and has paid all debts of the estate, including Inheritance Tax owed. D. Decedent died testate, thereby vesting all rights and interest in his personal property to Kenneth R. Johnson, 106 Pennsylvania Avenue, Carlisle, PA 17013; Shirley Frisch, 206 Evergreen Road, New Cumberland, PA 17070; and Deborah Leininger, 1356 West Route 897, Denver, PA 17517. E. The estate has received assets as set forth in Exhibit A attached hereto and made a part hereof; has paid debts and expenses as set forth in Exhibit B attached hereto and is making distribution as set forth in Exhibit C attached hereto and made a part hereof. The Inheritance Office is considering the estate insolvent. F. The Estate requested return of the amount of $153.57 which has been agreed by the Inheritance Tax. G. Executor and Beneficiaries desire to forego a formal accounting and schedule of distribution and desire to conclude the estate by virtue of the filing of this document. NOW, THEREFORE, Executor and Beneficiaries, intending to be legally bound, state as follows: 1. The Executor and Beneficiaries agree that the Executor of the Estate need not file a formal accounting or schedule of distribution. lnr 2. Executor states that all costs of the estate are paid. 3. The parties agree to distribution of the assets as presented above. 4. No skate or federal income taxes are due. 5. The parties acknowledge that any distribution made by Executor pursuant to this Agreement is an "at risk" distribution pursuant to 20 P.S. 3532. Beneficiaries hereby release Executor with respect to acts or omissions in the administration and distribution of the estate and hereby agree to return such funds as were distributed under the administration of the estate as may be required for the payment of any proper claims not discharged prior to this distribution. 6. The parties designate this statement as a "satisfaction of award" and hereby authorize and direct the Clerk of Orphans' Court to make satisfied of record any award, which may subsequently be made by the Court with respect to the distribution made to the distributees in this Agreement. 7. The parties agree that this Family Settlement Statement shall be filed with the Clerk of Orphans' Court in final settlement of the Estate, subject to the provisions hereof.
