WHEREAS, David A. Bouton and Sheila L. Bouton of Blue Ridge School, St. George, VA
22935, is about to execute contemporaneously herewith, a contract, with Artistech, Inc. of
1087 Country Club Road, Camp Hill, PA, for the erection of a building upon premises
commonly known as Lot #E-9, 3 East Red Gold Circle, Township East Pennsboro,
Cumberland County, Pennsylvania, as set forth in the deed dated ,recorded at , in the
Recorder's Office for Cumberland County, Pennsylvania, as more specifically described in
Exhibit "A" which is incorporated herein and attached hereto.
NOW, February 12, 2009, at the time of and immediately before the execution of the
principal contract, and before any authority has been given by the said Owner to the said
Contractor to commence work on the said building, or purchase materials for the same in
consideration of the making of the said contract with Contractor and the further
consideration of One Dollar ($1.00), to contractor paid by Owner, it is agreed that no lien
shall be filed against the building by the Contractor, or any subcontractor, nor by any of the
materialmen or workmen or any other person for any labor, or materials purchased, or extra
labor or materials purchased for the erection of said building, the right to file such liens
being expressly waived.
WITNESS, our hands and seals the day and year aforesaid.

ALL THAT CERTAIN tract or parcel of land being situate in East Pennsboro
Township, Cumberland County, Pennsylvania, more particularly bounded and described as
follows:
BEGINNING at a point located on the southern right-of--way line of East Red Gold
Circle (50-foot right-of--way) at the northeast corner of Lot E-8; thence along the southern right-
of-way line of East Red Gold Circle, South 80 degrees 07 minutes 00 seconds East, a distance of
145.05 feet to a point, thence along the southern right-of--way line of East Red Gold Circle by a
curve to the right having a radius of 17.00 feet and an azc length of 22.34 feet to a point; thence
along same said East Red Gold Circle by a curve to the right having a radius of 50.00 feet and an
arc length of 53.00 feet to a point at the northwest corner of Lot E-10; thence along the western
boundary line of Lot E-10, South 24 degrees 26 minutes 50 seconds West, a distance of 138.43
feet to a point along Community Open Space; thence along said Community Open Space, North
65 degrees 57 minutes 00 seconds West, a distance of 64_..$7 feet to a point at the southeast corner
of Lot E-7, thence along the eastern boundary lines of Lot E='7 and Lot E-8, North 21 degrees 00
minutes 00 seconds West, a distance of 194.00 feet to a point, the point and place of
BEGINNING.
BEING Lot No. E-9 on the Final Subdivision Plan of Floribunda, Phase I, Section 9 and
recorded in the Cumberland County Recorder of Deeds Office in Plan Book 90, Page 40-B.
