The child is presently in the custody of Defendant Stacy M. Shank, who resides at 210 East Garfield Street, Shippensburg, Cumberland County, Peunsylvania 17257. Plaintiff has no information of a custody proceeding concerning the child pending in a court of this Commonwealth. Plaintiff does not know of a person, not a party to the proceedings, who has physical custody of the child or claims to have custody or visitation rights with respect to the child. The best interest and permanent welfare of the child will be served by granting the relief requested because: A. The child desires to reside with Plaintiff; B. Plaintiff is better able to care for the educational, emotional needs of the child. Each parent whose parental rights to the child have not been terminated and the person who has physical custody of the child have been named as parties to this action. Father had partial physical custody of the child in the summer for two weeks and such other times as the parties agreed. 4. By mutual agreement, Father was receiving additional overnights during the week until child's grades began dropping. Recently Father was receiving alternating weekends. A Conciliation Conference was held July 27, 2004 with the fo/lowing individuals in attendance: The Father, Brian P. Murray, with his counsel, Richard L. Webber, Esquire, and the Mother, Stacy M. Shank, with her counsel, Galen Waltz, Esquire. 3. The Honorable Edgar B. Bayley previously entered an Order of Court dated June 1, 2004 providing for Mother to have sole legal custody and the parents to have shared physical custody on a week on/week off basis beginning June 13, 2004. 4. Mother's position on custody is as follows. She seeks sole legal and primary physical custody with Father having alternating weekends. The only issue is whether shared physical custody would be advantageous to the child's education. The child failed two subjects this past school year while i ~ ' ' n Moth,~r s primary care. Mother registered her for summer school. Mother maintains that the, summer experiment of week on/week off has not worked and cites numerous failures of Father regarding uncompleted homework assignments and missed teacher appointments for' summer school. She asserts that Father told the child sumrner school is not important. She complains that Father leaves the child at home alone during work hours; that he let the child drive a car on back roads, albeit supervised, and purchased an excessively short skirt for her. Lastly Mother complains that she could not reach the child by phone on several occasions and that the phone was shut off. She does admit that Father abided by the drop off and pick up times of the Order. 5. Father's position on custody is as follows: Father seeks shared legal and shared physical custody on a week on/week offbasis. Father maintains that the summer experiment of week on/week off has worked. He asserts that the child is happy with the arrangement. He denies Mother's allegations that he did not monitor homework completion and did not get the child to the teacher reviews. He claims the teacher reviews were not mandatory and homework was on no set schedule. He claims that Mother let the child wear the skirt complained of. His cell phone did experience difficulty, but that the child has a cell phone that Mother could have reached her on. Father maintains that he took the summer school seriously and shared physical custody with him during the school year would be beneficial to the child. Father claims that the child is left home when Mother is at work to baby sit her eleven-year old half sibling. 6. The Conciliator recommends an Order in the form as attached scheduling a Hearing and maintaining the week on/week off schedule. It is expected that the Hearing will require one-half day. (2) Brian P. Murray and Stacy M. Shank shall have joint legal custody of Ashley R. Murray, born April 26, 1990. (3) During the school year, the mother shall have primary physical custody of Ashley. The father shall have periods of temporary physical custody as follows: (a) Every other Thursday from after school until Monday at the beginning of school. (b) During the week preceding the weekend in which Ashley is with her mother, every Wednesday from after school un~til Thursday at the beginning of school. (4) During the summer school vacation period Ashley shall spend alternate weeks with each parent with exchanges on Sunday evenings.
