NOTICE is hereby given that the United States of America
filed an Indictment in the United States District Court for the
Middle District of Pennsylvania, in the foregoing action. The United
States of America is seeking to forfeit real property located at 565
Sandpiper Lane, New Cumberland, Pennsylvania, including all
appurtenances thereto, the legal description for which is as follows:
ALL THOSE certain lots, pieces or parcels of land situate
in Fairview Township, York County, Pennsylvania,
bounded and described as follows, to wit:
Being known and designated as Lot Numbers 59, 65, 6Fi, C9,
82, 83 and 85-92 and 94-98 as shown on a plat of jots Laid

out and surveyed by Johnston and Associates, Inc., in June
2002, and known as "BIZIARCLIFF, Final Phase I, Subdivision
Plan," said plant remains of record in the Office of the
Recorder of Deeds in ad for Fairview Township, York County,
Pennsylvania in Plan Book RR, page 1178.
Being known and designated at Lot Numbers 141, 142, 143,
144, 145, 146 and 147as shown on a plat of lots laid out and
surveyed by Johnston and Associates, Inc., in September
2003, and known as "BRIARCLIFF, Final Phase II, Subdivision
Plan," said plat remains of record in the Office of the Recorder
of Deeds in and for Fairview Township, York County,
Pennsylvania in Plan Book 1747, page 1237.
The record owners of the property are Tony and Lynda
Phan.
Title 21, United States Code, Section 853(k) states no party
claiming an interest in property subject to forfeiture may commence
an action at law or equity against the United States concerning the
validity of their interest after the filing of an Indictment.

obtained from the records of the Clerk of Court for the United
States District Court for the Middle District of Pennsylvania,
