Vanhoy, husband and wife, Michael Manning and Associates, a Pennsylvania General Partnership, IN THE COURT OF COMMON PLEAS CUMBERLAND COUNTY, PENNSYLVANIA STIPULATION AGAINST LIENS WHEREAS, Mark D. Vanhoy and Heather A. Vanhoy, husband and wife, of Cumberland, Pennsylvania, is about to execute contemporaneously herewith, a contract with Michael Manning and Associates, a Pennsylvania General Partnership of Cumberland County, Pennsylvania, for the erection of a dwelling upon a lot of land situate as follows: ALL THAT CERTAIN piece or parcel of land situate in the Township of East Pennsboro, Cumberland County, Commomvealth of Pennsylvania, more fully described as follows: BEGINNING at a point, said point being located on the dedicated right-of-way line of Golfview Drive at the dividing line of Lot No. 86 and Lot No. 87; thence by the same, South 87 degrees 09 minutes 21 seconds West, a distance of 124.41 feet to a comer common to Lot No. 85, Lot No. 86, Lot No. 88 and Lot No. 87; thence by the same North 11 degrees 05 minutes 58 seconds West, a distance of 150.56 feet to a point on the dedicated right-of-way line of Golfview Drive; thence by the same the following (3) courses and distances: 1) by a curve to the right having a radius of 125.00 feet, an arc distance of 196.35 feet to a point; 2) South 11 degrees 05 minutes 58 seconds East, a distance of 17.34 feet to a point; 3) by a curve to the right having a radius of 181.67 feet, a distance of26.18 feet to a point on the dedicated right-of-way line, the Place of BEGINNING. BEING Lot No. 87, containing 16,583.6 square feet as shown on the Final Subdivision Plan of Hickory Ridge, Phase III- Revised, recorded in Plan Book 88, Page 88 and being subject to all easements of record. NOW, the ~ ~ day of April, 2004, at the time of and immediately before the execution of the principal contract, and before any authority has been given by the said Mark D. Vanhoy and Heather A. Vanhoy, husband and wife, to the said Michael Manning and Associates, a Pennsylvania General Partnership to commence work on the said building, or purchase materials for the same in consideration of the making of the said contract with Michael Manning and Associates, a Pennsylvania General Partnership and the further consideration of One Dollar, to Michael Manning and Associates, a Pennsylvania General Partnership paid by Mark D. Vanhoy and Heather A. Vanhoy, husband and wife, it is agreed that no lien shall be filed against the building by the contractor, or any sub-contractor, nor by any of the material men or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived.
