AND NOW, comes the Plaintiff, CHRISTOPHER A. BLOUSE, by and
through his attorneys, SHOLLENBERGER & JANUZZI, LLP, and respectfully
represents tie following:
FACTS APPLICABLE TO ALL COUNTS
1. Plaintiff, CHRISTOPHER A. BLOUSE, is an adult individual who
currently resides at 1106 Laurel Avenue, Camp Hill, Cumberland County,
Penn
2. Defendant, COURTNEY A. BAKER, is an adult individual whose
last known address is 6603 Salem Park Circle, Mechanicsburg, Cumberland
County, Penhsylvania.

3. ! The facts and circumstances hereinafter set forth took place on
February 21, 2009 at or about the intersection of Walnut Street and East Main
Street, Mechanicsburg, Cumberland County, Pennsylvania.
4. At the aforesaid time and place, Plaintiff, CHRISTOPHER A.
BLOUSE, as the owner and operator of a 1977 Harley Davidson motorcycle
bearing Pe nsylvania Registration Number BAW77.
5. At the aforesaid time and place, Defendant, COURTNEY A.
BAKER, w s the operator of a 1999 Nissan Altima, owned by Jay R. Baker, and
bearing Pe nsylvania Registration Number GYM0834.
6. At the aforesaid time, there existed a traffic control signal at the
aforesaid intersection which governed all directions of travel and included a turn
arrow gove ning left turns from southbound Walnut Street onto Eastbound East
Main
7. Immediately prior to the collision, Plaintiff, CHRISTOPHER A.
BLOUSE, had stopped the 1977 Harley Davidson motorcycle in the southbound
lane of Walnut Street and was waiting for the green left turn arrow before he
made a left turn onto the Eastbound lane of East Main Street.
8. At the aforesaid time and place, Defendant, COURTNEY A.
BAKER was operating the 1999 Nissan Altima northbound on Walnut Street.
9. At the aforesaid time and place, Plaintiff, CHRISTOPHER A.
BLOUSE, a er having received a green turn arrow, was completing his left turn
from the southbound lane of Walnut Street onto the eastbound lane of East
Market Street when Defendant, COURTNEY A. BAKER, entered the intersection
against a steady red light and struck the right side of the motorcycle, including

Plaintiff, CHRISTOPHER A. BLOUSE's right leg, with the front right of her 1999
Nissan AIW,na, causing Plaintiff, CHRISTOPHER A. BLOUSE and his motorcycle
to fall to the left.
10. The aforesaid collision was the direct and proximate result of the
negligence of the Defendant, COURTNEY A. BAKER, in operating the 1999
Nissan Altima in a careless, reckless manner as follows:
a. Failing to stop the 1999 Nissan Altima before entering the
when facing a steady red traffic control signal in violation of
§3112 (a) (3) (i) of the PA Motor Vehicle Code;
b. Driving at a speed greater than was reasonable and prudent under
the c nditions and without regard to the actual and potential hazards then
and/or at a speed greater than would have permitted her to bring
her vehicle to a stop within the assured clear distance ahead in violation of
3361 of the PA Motor Vehicle Code;
c. Driving the 1999 Nissan Altima in careless disregard for the safety

or property in violation of Section 3714 of the PA Motor Vehicle
In failing to observe Plaintiffs motorcycle in the intersection;
In failing to operate the 1999 Nissan Altima in accordance with
traffic conditions and traffic controls; and
f. In failing to exercise the high degree of care required of a motorist
an intersection.

1i. As a result of the aforesaid collision, Plaintiff, CHRISTOPHER A.
BLOUSE, has suffered serious and permanent injuries, including but not limited
to the following:
a. Second metatarsal neck fracture of the left foot;
b. Third metatarsal neck fracture of the left foot;
C. Fourth metatarsal neck fracture of the left foot;
d. Fifth metatarsal neck fracture of the left foot;
e. Open tibia fracture of the right leg;
f. Segmental fibula fracture of the right leg;
g. Comminuted transverse fractures through the distal tibia and fibula;
h. Acute anterior talofibular ligament tear of the right ankle;
i. Two lacerations to the right leg, below the knee; and
j. Traumatic tear of the medial head of the gastrocnemius muscle of
the right leg
12. As a direct and proximate result of the aforesaid injuries, Plaintiff,
CHRISTOPHER A. BLOUSE, has undergone and in the future will undergo great
pain and su ering for which damages are claimed.
13. As a further result of the aforesaid injuries, Plaintiff,
CHRISTOP? ER A. BLOUSE, has sustained a permanent diminution in his ability
to enjoy life nd life's pleasures for which damages are claimed.
14. As a direct and proximate result of the aforesaid injuries, Plaintiff,
CHRISTOPF ER A. BLOUSE, has sustained scarring and disfigurement for which
damages ar4 claimed.

15. As a further result of the aforesaid injuries, Plaintiff,
CHRISTOPHER A. BLOUSE, has suffered and may continue to suffer a loss

earnings fojr which damages are claimed.
16. As a further result of the aforesaid injuries, Plaintiff,
CHRISTOF HER A. BLOUSE, has and/or may in the future incur a loss of earning
capacity fort which damages are claimed.

17. 1 As a further result of this collision, Plaintiff, CHRISTOPHER A.
BLOUSE, has and/or may incur reasonable and necessary medical and
rehabilitative costs and expenses in excess of the amounts paid or payable
pursuant to Subchapter B of the Pennsylvania Motor Vehicle Financial
Responsibility Law, Workers' Compensation or any program, group contract, or
other arran ement for payment of benefits as defined in 75 Pa. C.S.A. Section
1719.

As a further result of the aforesaid injuries, Plaintiff,
CHRISTOPHER A. BLOUSE, has incurred or may hereinafter incur financial
expenses a0d losses which exceed sums recoverable under the limitations and
exclusions c f the Pennsylvania Motor Vehicle Financial Responsibility Law for
which damages are claimed.
19. As a result of the collision, there was physical damage to Plaintiffs
1977 Harley Davidson motorcycle for which damages are claimed.
20. Plaintiff, CHRISTOPHER A. BLOUSE, was occupying a motorcycle
at the time of the collision, which is not a private passenger motor vehicle.
Therefore, Plaintiff, CHRISTOPHER A. BLOUSE, remains eligible to claim

compensation for non economic loss and economic loss sustained in this
collision pursuant to applicable tort law.
WHIEREFORE, Plaintiff, CHRISTOPHER A. BLOUSE, demands judgment
against De endant, COURTNEY A. BAKER, for compensatory damages in an
amount in xcess of the amount requiring compulsory arbitration.

AND NOW, comes the Plaintiff, Christopher Blouse, by his attorneys,
Shollenberger and Januzzi, LLP and does respectfully represent the following:
1. The above captioned action was initiated by complaint that was served on
the Defendant on March 12, 2009.
2. Interrogatories and a Request for Production of Documents were served
with the Complaint.
3. Objections to some of the Interrogatories and Requests were filed on
April 2, 2009. A copy of the objections are attached hereto and incorporated by
reference herein as Exhibit A.
4. A discovery deposition of the Defendant is scheduled to go forward on
May 13, 2009.
5. If the Defendant does not provide answers and responses prior to the
deposition they are effectively denying the Plaintiff the right to conduct discovery
in such order as he deems appropriate in contravention of the spirit of Pa. R.C.P.
4007.3.
6. Answers and responses were overdue on April 13, 2009. Prior to filing
this Motion, counsel for the Plaintiff contacted Defense counsel by phone on
April 23, 2009. During that call, Defendant's counsel promised to check with his
paralegal regarding the status of discovery and to make sure that the discovery
was provided in advance of the deposition of his client.
7. No other Judge has ruled on any matter relating to this case.
8. The Plaintiff has provided a true and accurate copy of this Motion to
counsel for the Defendant via electronic mail dated Thursday, May 07, 2009 and
advised Defendant's counsel by phone on that date that it was being emailed.
WHEREFORE, the Plaintiff respectfully requests this Court enter an Order
compelling the Defendant to have in Plaintiff's counsel's possession answers to
the Interrogatories and responses to the Requests for Production of Documents
on or before Monday, May 12, 2009.

documents that are violative of defendant's right to privacy. Defendant will

defendant's right to privacy. Furthermore, the request seeks "information" that is
