Petitioner is Sheryl R. Gabel, who resides at 253 South 4th Street, Steelton, Dauphin County, Pennsylvania 17113, and is the successor plenary guardian of the person and successor plenary guardian of the Estate of Nancy Gertrude Bretz, duly appointed by decree of the above named Court, made on August 31, 1999. 2. Nancy Gertrude Bretz was adjudged an incompetent after a hearing, by Final. Decree of Clinton R. Weidner, J., dated August 28, 1975, In the Matter of the Estate of Nancy Gertrude Bretz, Cumberland County Orphan's Court Division, No. 446 Orphan's 1975. 1 3. In 1975, Clark Edward Bretz, Sr., was appointed guardian of the Estate of Nancy Gertrude Bretz, by final decree set forth above. 4. Nancy Gertrude Bretz is a patient residing at Camp Hill Nursing Home, Camp Hill, Cumberland County, Pennsylvania. 5. Nancy Gertrude Bretz is fifty-six (56) years of age, has been institutionalized receiving nursing home care since 1975 as a result of complications stemming from brain surgery, and is never expected to return to her home or be released from full-time nursing home case. 6. Prior to her incapacitation, Nancy Gertrude Bretz, and her husband Clark Edward Bretz, Sr. acquired title to premises located at 3845 Sullivan Street, Mechanicsburg, Cumberland County, Pennsylvania, as tenants by the entireties from Ovidio Acri and Edith Acri, his wife, by deed dated September 23, 1970, recorded in the Office of Recorder of Deeds, Cumberland County, Pennsylvania, in Deed Book "V", Volume 23, Page 317, a copy of which is attached hereto and marked Exhibit "A". 2 7. Nancy Gertrude Bretz resided at the property with her husband, Clark Edward Bretz, Sr. until she was permanently incapacitated in 1975. 8. Clark Edward Bretz, Sr., died on June 16, 1999. 9. On December 24, 1998 Clark Edward Bretz, Sr., granted a mortgage to AccuBank Mortgage Corporation in the principal amount of $53,000, which mortgage was to be a first lien on the property. 10. In conjunction with obtaining the loan and encumbering the property with the mortgage lien, Clark Edward Bretz, Sr. conveyed title in the property from himself and his wife Nancy Gertrude Bretz to himself individually. 11. Clark Edward Bretz, Sr. signed the deed on behalf of himself and on behalf of his wife, as her court appointed Guardian of the Estate. Said deed was signed on December 24, 1998, and recorded in the Office of Recorder of Deeds of 3 Cumberland County, Pennsylvania in Deed Book 192, Page 1. A copy of said deed is attached hereto and marked Exhibit "B". 12. Said deed was prepared by an attorney who served as settlement agent and title agent for the refinancing transaction. Subsequent to the settlement, the title insurance company refused to issue a title insurance policy in favor of AccuBank Mortgage Corporation because of the possible defect in title. 13. Under §5521(b) Probate Estates and Fiduciaries Code (PEF Code), 20 Pa. C.S.A. §5521(b), the powers, duties, and liabilities of guardians of incapacitated persons' estates shall be the same as those provisions relating to the powers, duties, and liabilities of persons representative of the decedent's estate. 14. Under provisions of §5521 (b) PEF Code, the provisions of §3356 PEF Code are incorporated and applicable to guardians of incapacitated persons' estates. §3356 PEF Code provides as 4 follows, with respect to a personal representatives right to purchase real estate from a decedents estate: "In addition to any right conferred by a governing instrument, if any, the personal representative, in his individual capacity, may bid for, purchase, take a mortgage on, lease, or take by exchange, real or personal property belonging to the estate, subject, however, to the approval of the Court, and under such terms and conditions and after such reasonable notice to parties in interest as it shall direct. The Court may make an Order directing a co-fiduciary, if any, or the Court's clerk to executive a deed or other appropriate instrument to the purchasing personal representative." (emphasis added) 15. Carl Edward Bretz, Sr. failed to obtain Court approval for the conveyance of title in the property to himself, and hence the transfer is void. 16. The interest of Nancy Gertrude Bretz in said real estate is therefore that of sole surviving tenant in fee. 17. As a result of the refusal of the title insurance company to issue a title insurance policy on the premises, GMAC Mortgage Corporation, the assignee of AccuBank Mortgage Corporation has advised the guardian, Sheryl R. Gabel of its intention to pursue a foreclosure action. GMAC Mortgage Corporation has also notified the guardian that the foreclosure 5 action has been placed on hold, pending closing of the property located at 3845 Sullivan Street. 18. The pay-off balance owed to GMAC is $53,818.31, which amount is good through August 15, 2001. A copy of a letter from counsel for GMAC documenting same, is attached hereto and marked Exhibit ~~C" 19. Nancy Gertrude Bretz receives Medical Assistance for her long-term medical care, which is paid by Pennsylvania Department of Public Welfare. 20. The determination of qualification of Medical Assistance by the Pennsylvania Department of Public Welfare was based partly upon the size of the institutionalized person's estate at the time of applying for assistance. 21. Upon filing of her application, the Pennsylvania Department of Public Welfare determined that, given the size of her estate, Nancy Gertrude Bretz could not pay for her own long- term care and qualified for Medical Assistance. 6 22. At the time Sheryl R. Gabel petition this Court to be appointed successor guardian in 1999, the Estate of Nancy Gertrude Bretz consisted of a patient fund account, containing approximately $800.00. 23. The only income Nancy Gertrude Bretz receives is from a Supplemental Security Income (SSI) payment. 24. Subsequent to the appointment of Sheryl R. Gabel as guardian of the Estate of Nancy Gertrude Bretz, the Commonwealth of Pennsylvania, Office of Inspector General asserted a claim against Sheryl R. Gabel, individually, for failure to file an election against the Wi7.1 of Clark E. Bretz, Sr. The claim of the Commonwealth is approximately $27,333.33. A copy of the Commonwealth notice to the guardian is attached hereto and marked Exhibit ~~D". 25. The fair market value of said real estate with the improvements thereon as of June 7, 2001 is $130,000.00, as appears more fully i.n the affidavit of Sheryl R. Gabel sworn to 7 the 2ND day of July, 2001, a copy which is attached hereto, and marked Exhibit "E", and made a part hereof by reference. 26. Attached hereto and marked Exhibit "F" is a copy of a duly executed contract of sale, for said premises, at a price of $130,000.00, which is payable as follows: $2,000.00 down and the balance of $128,000.00 in cash, cashiers or certified check, to be paid at settlement on or before August 15, 2001. Under said contract, the petitioner will receive a sum equal to the value set for the above, less the balance of the outstanding mortgage to GMAC Mortgage Corporation, the claim of the Commonwealth of Pennsylvania and settlement expenses. Petitioner believes the price set forth in the contract is fair, and is the highest offer received for the premises. 27. So far as can be ascertained with due diligence, the names and addresses of all persons interested in this proceeding who are required to be cited upon this Petition or concerning whom the Court is required to have information are as follows: (A) Sheryl R. Gabel, daughter of Nancy Gertrude Bretz; 8 (B) Clark E. Bretz, Jr., son of Nancy Gertrude Bretz; and (C) Brian J. Bretz, son of Nancy Gertrude Bretz, who constitute all of the natural heirs of Nancy Gertrude Bretz, an incapacitated person. 28. There are no persons other than those mentioned interested in this proceeding. 29. Neither the Guardian nor said incapacitated person has aliened or encumbered said real estate or interest therein except as aforesaid. 30. Proceeds of the sale shall be paid over to the Guardian for the account of the incapacitated person. 31. No previous application has been made for the relief sought herein. 9 32. Under the PEF Code ~552i(b), the guardian of the estate must obtain approval of Court for the sale or transfer of real estate. WHEREFORE, Petitioner seeks approval of this Honorable Court to convey the property pursuant to the Agreement of Sale dated June 7, 2001, as provided in PEF Code, 20 Pa. C.S.A. ~5521(b). Following an investigation into the nature of the referral, a claim has been established for overpayment of medical assistance paid to Camp Hill Nursing Center on behalf of Nancy Bretz during the period of July 1, 1999 through July 3 1, 2000. Nancy Bretz was authorized to receive medical assistance benefits at Camp Hill Nursing Center on September 1, 1976. Her medical assistance eligibility has been affected by the discovery of the overpayment. The overpayment is the result of Ms. Bretz's failure to elect against her husband Clark's estate. Clark E. Bretz passed away on June 16, 1999. The settlement of his estate is being handled by the law offices of Johnson, Duffie, Stewart & Weidner. The only asset that was entered into the estate was the resident property located at 3845 Sullivan Street, Mechanicsburg, PA 17055. The property is valued at $135,000.00. On December 24, 1998, Mr. Bretz took out a mortgage against the property in the amount of $53,000.00, leaving the property with an equity value of $82,000.00. On July 1, 1999, the estate papers were filed, making the estate open to any elections. As his spouse, Nancy Bretz was entitled to 1/3 of her husband's estate and could elect against it in order to obtain her share of the assets. Ms. Bretz would have had to file for election within six months following the date that the estate was opened. On Au ust 31, 1999, you, Ms. Bretz's daughter, were appointed as plenary guardian of the estate of ancy Bretz. As her guardian, you had a responsibility to act in her best interests and make an election against Clark Bretz's estate on her behalf. The above noted claim of $27,333.33 represents the amount that Ms. Bretz would have EXHIBIT "D" Sheryl Gable -2- August 10, 2000 received from the estate had she elected to do so. As a recipient of medical assistance benefits, Ms. Bretz is required to pursue any and all available resources in order to avoid the Commonwealth having to expend public funds on her behalf. An applicant/recipient shall take reasonable steps to obtain and make available resources to which he is, or may be, entitled unless he can show good cause for not doing so. 55 Pa. Code § 178.1 (g) The Commonwealth paid $37,588.53 to Camp Hill Nursing Center on behalf of Ms. Bretz during the period of July 1, 1999 through July 31, 2000. Had Ms. Bretz obtained the $27,333.33, during the period in which she should have elected to receive the available funds, the Cumberland County Assistance Office would have determined her to be ineligible to receive medical assistance benefits because her resources would have exceeded the allowable limits regulated by the Department of Public Welfare.
