HomeMy WebLinkAbout09-1424STIPULATION AGAINST LIENS Carl Peter Carlucci, Jr. and Patricia Sharon ) In the Court of Common Pleas Carlucci, husband. and wife, Owners ) County of Cumberland, Pennsylvania VERSUS ) Capezio Building & Remodeling, LLC, ) Contractor ) Number ~ 4a ~ M ~ Term 2009 WHEREAS, Cazl Peter Carlucci, Jr. and Patricia Sharon Cazlucci, husband and wife, Owners, of 1105 Fleetwood Drive, Carlisle, Pennsylvania, are about to execute contemporaneously herewith, a contract, with Capezio Building & Remodeling, LLC, Contractor, of 3133 Druck Valley Road, York, PA 17406, for the construction and erection of a two-story addition and certain exterior and interior improvemenl~s to a single family residence existing on a parcel of land having the above address, said parcel being situate in the Borough of Carlisle, Cumberland County, Pennsylvania, more fully bounded and described on Exhibit A attached hereto and made part hereof. NOW, 2004, at the time of and immediately before the execution of the principal contract, and before' any authori has been given by the said Owners to the said Contractor to commence work on the said building or purchase materials for the same in consideration of the making of the said contract with Contractor and the further consideration of one dollar, to Contractor paid by Owners it is agreed. that no lien shall be filed against the building by the contractor, or any sub-contractor, nor by any of the maUerial men or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived. Cazl Peter Cazlucci, Jr., Owner atricia Shazon Cazlucci,.9wner Capezio B 'ding & modeling, LLC By: ark Cape ,Managing Member i EXHIBIT A ALL that certain tract of land with the improvements thereon erected situate in the Third Wazd of the Borough of Cazlisle, Cumberland County, Pennsylvania, bounded and described as follows: BEGINNING at a point on the Northern side of Fleetwood Drive on the dividing line between Lots Nos. 75 and 76 on the hereinafter mentioned Plan of Lots; thence by said dividing line, North 10 degrees, 29 minutes 56 seconds West 164.44 feet to a point; thence North 71 degrees 42 minutes 38 seconds East 18.09 feet to a point; thence North 82 degrees 41 minutes 48 seconds East 105.22 feet to a point on the dividing line between Lots Nos. 76 and 77; thence along the latter, South OS degrees 57 minutes 53 seconds East 165.90 feet to a point on the Northern side of Fleetwood Drive; thence along the latter in a Westerly direction by a curve to the left, having a radius of 1,390 feet, an azc length of 110 feet, to the Place of BEGINNING. BEING Lot No. 76 on the Plan of Section 2 of Nottingham, as recorded in the Office of the Recorder of Deeds for Cumberland County in Plan Book 23 ,page 2. BEING improved with atwo-story brick dwelling known as No. 1105 Fleetwood Drive , Cazlisle. BEING the same premises which Eugene S. Schlosnagle and Ethel S.
