No. QQ - l AfGL JURY TRIAL DEMANDED MECHANICS' LIEN CLAIM 1. Claimant Womex, Inc. ("Claimant") is a Pennsylvania corporation with a registered address of 201 South Filey Road, Dillsburg, Pennsylvania 17019, and hereby files this mechanics' lien as general contractor. 2. The current owner or reputed owner of the property subject to the lien is Gettys Ventures Family Limited Partnership, a Pennsylvania Limited Partnership, with a registered address of 1558o Kinross Circle, Fort Myers, Florida 33912 ("Owner") 3. The Owner also has a business address of 1950 Chestnut Court, Camp Hill, Pennsylvania 17011. 4. The owner of the property subject to the lien at the time Claimant commenced its work on the subject property was Fred A. Gettys and Yvonne W. Gettys d/b/a Gettys Development. 5. On October 26, 2007, Fred A. Gettys and Yvonne W. Gettys d/b/a Gettys Development conveyed the subject property to the Owner for the consideration of $1.oo. (A true and correct of copy of the Deed, dated October 26, 2007, is attached hereto as Exhibit A) 6. The date on which Claimant completed the work for which the claim is made was December 18, 2008. 7. Claimant files this claim pursuant to two (2) written contracts with Gettys Development. The first written contract, dated December 6, 2006 ("Contract I"), is for certain erection and construction work, including labor and materials, furnished by Claimant on a new improvement, i.e., the Outfall Sewer System of a residential development project entitled The Village at North Ridge, located in North Middleton Township, Cumberland County ("Project"). (A true and correct copy of Contract I is attached hereto as Exhibit B) The second written contract, dated December 12, 20o6 ("Contract II"), is for certain erection and construction work, including labor and materials, furnished by Claimant on a new improvement, i.e., Phase I of the Project. (A true and correct copy of Contract II is attached hereto as Exhibit C) 8. Claimant also files this claim pursuant to certain additional and/or extra erection and construction work, including labor and materials, furnished by Claimant on the Project that was orally requested and promised to be paid for by Owner and/or Fred A. Gettys and Yvonne W. Gettys d/b/a Gettys Development. 2 9. The total amount claimed to be due is $318,783.18. 10. The property claimed to be subject to the lien is that certain lot, parcel or tract of land located in North Middleton Township, Cumberland County, Pennsylvania, beginning at or near the centerline of Cranes Gap Road (T-531), and is more particularly bounded and described in the legal description contained in the Deed attached hereto as Exhibit A.
