In the case of securities of close or family corporations, the values reported. are as far as possible substantiated by financial statements of the corporations, showing the assets and liabilities thereof as of the date of death. The schedule also sets forth the interest of decedent at the time of death in any co-partnership or business, and in support of the value of such interest there is annexed to said schedule, financial statements showing the assets and liabilities of said co-partnership or business. A copy of the co-partnership agreement, (if oral, a statement setting forth the nature of the agreement) together with a statement setting forth the character of the business, its location, and such other facts pertaining to the business as may be pertinent to a fair and ,just appraisal of the decedent's interest therein mtLSt be submitted. It should also set forth in itemized form, together with the fair market value thereof, any other property owned or bequeathed by the decedent at the time of death. The Schedu/e C attached hereto and made part hereof sets forth a true answer to each inquiry contained therein and in the case of transfers of property, real or personal, within two years of decedent's death, in contemplation of decedent's death, or intended to take effect in possession or enjoyment at or after death, said schedule sets forth the nature and value of such property, to whom transferred, the relationship of the transferees to the decedent, the proportionate share received by each transferee and all other facts of a pertinent nature regarding said transfers. In the case of transfers intended to take effect in possession or enjoyment at or after death, there is also attached to the schedule a copy of the deed, trust agreement or other instrument creating the trust. There is also set forth in said schedule a list of all property, real and personal, with its value, which passes at decedent's death by virtue of the exercise by decedent, either individually, or jointly with another, or any power of appoint- ment vested in decedent, either individually or jointly, by the will, deed, or other instrument of another, with a copy of the instruument creating such power attached to the schedule. That Schedule D attached hereto and made part hereof sets forth the names and addresses of all persons beneficially interested in this estate at the time of decedent's death, the nature of their res- pective interests, their relationship, if any, to the decedent, together with the ages at the time of decedent's death of all minors, annuitants and beneficiaries for life under decedent's Will. It also contains a statement showing which of the beneficiaries named in the decedent's will, if any, died prior to decedent, the dates of their death, their issue, and the relationship of such issue to the beneficiary. That Schedule E attached hereto and made a part hereof sets forth all property, real and per- sonal, owned by the decedent jointly with another or others, including intangible, standing in the name of the decedent and others, plus the date and place of record of instruments effecting the vestiture of real estate and the date of acquisition of personalty, plus the name, address and relationship, if any, of co-owners to the decedent. That Schedu/e F attached hereto and made a part hereof sets forth fully and in detail all debts and deductions claimed for and on behalf of this decedent's estate, including funeral expenses paid; family exemption, where applicable; costs of administration of this estate; counsel fees and fudiciary's commissions paid or to be paid; cost expended for burial trusts, tombstones or gravemarkers, and reli- gious services, in consequence of the death of the decedent; debts and claims owing and unpaid at time of death; taxes accrued chargeable for period prior to decedent's death (except those allowed under Section 851 of the Inheritance and Estate Tax Act); together with a statement of collateral pledged for obliga- tions, if any. N0. 21-70-625 AUDITOR'S REPORT James R. Humer, Esquire, Auditor appointed by your Honorable Court in the above entitled matter, makes the following report. Pursuant to his appointment on August 22, 1972, your Auditor assumed his duties on August 24, 1972 and held a hearing on October 16, 1972 at 1:30 P.T1. in Court Room No. 3, Court House, Carlisle, having previously given notice thereof to William F. P•~artson, Esquire, attorney for accountant, to Bruce A. Dorsey, cousin of decedent, to Ruth E. Shepler Bowman, cousin of decedent, and her attorney James L. Bowman, Esquire, a notice posted on the Bulletin Board in the Office of the Register of Wills, and by advertisement in The Evening Sentinel and Cumberland Law Journal once a week for three successive weeks, a copy of which, accom- panied by certified mail return receipt cards and proofs of pub- lication is attached hereto. At the stated time and place the Auditor held a hearing at which the accountant and her attorney, and Ruth B. Shepler Bowman and her attorney were present, and at which were offered two affidavits prepared for Bruce A. Dorsey, cousin of decedent and a resident of California, by his attorney. Since it appeared from both the affidavit of Bruce A. Dorsey and the testimony pre- sented that a cousin of decedent John Dorsch died apparently leaving issue in the Philippines, the Auditar caused notices to be publised in two newspapers of general circulation in the city of Manila, Republic of the Philippines, which resulted in a letter of inquiry from Sister Fidelis Dorsch who in subsequent corres- pondence stated that she was not related to the John Dorsch in question, EO!'", ~_~i~ FAGc ~'~ Because of the additional time consumed in advertising to ascertain possible next of kin in the Philippines, the Auditor on November 14, 1972 requested an extension of 90 days within which to file his report, which was granted by your Honorable Court, extending the time of the Auditor's commission until February 26, 1973. The notes of testimony and exhibits, copies of notices with proofs of publication, and in the case of notices in the Philippines, copies of correspondence accounting for the extra delays encountered, affidavits of Bruce A. Dorsey and correspondence with Sister Fidelis Dorsch are attached hereto and made a part hereof. FINDINGS OF FACT 1. Paul W. Lutz died on November 19, 1970, a resident of Upper Allen Township, Cumberland County, Pennsylvania, unmarried, without surviving issue, and intestate. 2. The parents of Paul W. Lutz were Henry Lutz and T1ary Dorsch; both of whom are deceased, and who were the parents of I~enry Lutz who was married and died without issue; Paul W. Lutz, decedent herein; and Marian Lutz Sopensky who was married and died without issue. 3. The paternal grandparents of Paul W. Lutz were Carl Lutz and Margaret Lufftinger Lutz, both of whom are deceased, and who were the parents of Dora Lutz who died unmarried and without issue; Lena Lutz Walters who was married and died without issue; Carl Lutz who died unmarried and without issue; William Lutz who died un- married and without issue; Elizabeth Alma Lutz Shepler who was married and died May 28, 1972 survived by one daughter, Ruth Elizabeth Shepler, now by 14tarriage Ruth Elizabeth Shepler Bowman, a claimant -2- hereunder; and Henry Lutz who was married and the father of three children, all of whom died without issue, to wit Henry Lutz and Marian Lutz Sopensky, and Paul W. Lutz, decedent herein, as set forth in finding of fact no. 2. 4. The maternal grandparents of Paul W. Lutz were Lawrence Dorsch and P~lary Dorsch, both of whom are deceased, and who were the parents of Barbara Dorsch who died unmarried and without issue; Magdalena Dorsch who died unmarried and without issue; Mary Dorsch who was married to Henry Lutz, both of whom were the parents of Henry Lutz, Paul W. Lutz, decedent herein, and P•larian Lutz Sopensky; Joseph Dorsch who died survived by one son as his sole next of kin, Joseph F. Dorsch, who is administrator of the estate herein; Harry Dorsch, also known as Anton or Anthony Dorsch, later changed to Harry Dorsey, who died survived only by a son, Bruce A. Dorsey as his next of kin; and John Dorsch who is reported to have been married and to have died a widower in the Philippines about 1920. No claimant has appeared who claims to be a lineal descendant of John Dorsch in response to advertisements in two newspapers of general circulation published in the Philippines, although one letter of inquiry was received by the Auditor in response to the advertisement, and this claim has been abandoned. 5. At the time of his death, November 19, 1970, Paul W. Lutz was survived by neither his paternal nor his maternal grandparents. 6. At the time of his death, Paul W. Lutz was survived by an aunt Elizabeth Alma Lutz Shepler, who has since died on Tlay 28, 1972 and whose interest is represented by her daughter, Ruth E. Bowman as administratrix of her estate, and by the children of two deceased uncles, to wit: Joseph Dorsch, a deceased uncle survived by his only child Joseph F. Dorsch, and Furry Dorsch, sometimes known ;~~K ~ ~f0 ~AC~ '~ ~ sC~ -3- as Anton or Anthony Dorsch, later changed to Harry Dorsey, a deceased uncle survived by his only child Bruce A. Dorsey. 7. One-third of the sum available for distribution is properly distributable to Ruth E. Bowman, Administratrix of the estate of Elizabeth Alma Lutz Shepler; one-third to Joseph F. Dorsch, a child of a deceased uncle, and one-third to Bruce A. Dorsey, a child of a deceased uncle. CONCLUSIONS OF LAW 1. All parties in interest are properly before your Honorable Court either by personal appearance or by submission of affidavit. 2. No claimant has appeared either personally or otherwise purporting to be a child or issue of John Dorsch, late of the Philippines. 3. Due and adequate notice of this proceeding was give by publication in two newspapers of general circulation published in T~lanila, The Philippines. 4. Distribution is properly made pursuant to the Intestate Act of 1947, April 24, P. L. 80 ~ 3, 20 P.S. 1.3(5), one-third to the estate of decedent's aunt, Elizabeth Alma Lutz Shepler, since deceased; one-third to Joseph F. Dorsch, child of a deceased uncle; and one-third to Bruce A. Dorsey, child of a deceased uncle. DISCUSSION All parties are in agreement expressed either in their testimony or by affidavit as to the next of kin known to be entitled -4- to share in distribution of this estate. The principal area of doubt is the possible existence of issue of John Dorsch who died about 1920, a widower, in the Philippines. Following the hearing, the Auditor endeavored to give notice in newspapers of general circulation in Manila, Republic of the Philippines, only to find that both intended newspapers were out of business. Alternates were located and the Advertisements run, although belatedly. ~Jne letter of inquiry was received in response to the advertisements, from a Sister Fidelis Dorsch who upon further correspondence with the Auditor concluded that "There is no John Dorsch among our relatives". The Auditor is of the opinion that all reasonable effort has been made to locate issue of John Dorsch and that further efforts would be a waste of both time and money. Turning to the question of distribution, since the decedent was not survived by spouse, issue, parents or grandparents, his nearest next-of-kin was his aunt Elizabeth Alma Lutz Shepley, who has since died; also he was survived by two first cousins, each a child of a deceased uncle. The Intestate Act of 1947, which is applicable, provides in Section 1.3 (5), 20 P.S. ~ 1.3 (5) as follows: "(5) Uncles, aunts and their children. If no grandparent survives the decedent, then to the uncles and aunts and the children of deceased uncles and aunts of the decedent." Humer, Esquire, respectfully represents that: 1. On August 22, 1972, your Honorable Court appointed James R. Humer, Esquire, as Auditor in the above estate, and on August 24 he assumed his duties. 2. Pursuant to said appointment he held a hearing on October 16, 1972, which was attended by all parties known to be parties in interest either personally or by Affidavit setting forth the basis of their claim of relationship to the decedent. 3. That during the course of said hearing it became apparent that one John Dorsch, an uncle of decedent, lived in the Philippine Islands. and died about 1920, and was survived by some issue. In January, 1945, I visited my father's sister, Mary Dorsch Lutz, now deceased, and stayed for awhile as her house guest in Pitts- ~~urgh, Pennsylvania. While there, I several times saw and talked with Joseph F. Dorsch; he many times there referred to rig father as his "Uncle Harry". During that time Mary Dorsch referred to my father as her brother. In May, 1946, for two weeks I, aain, was the house guest of Mary Dorsch Lutz. At the end of that time I immediately stayed as a house guest at the home of Joseph F. Dorsch for another two weeks. Immediately thereafter I returned to my home in California, taking Carl Dorsch with me. He stayed with me in my home for about four weeks; during his stay he often re- ferred to r~1y father as "Uncle Harry". In 1957, my father visited Joseph F. Dorsch in Pittsburgh. One is called the Manila Times, printed every morning with a circulation of over 225,000. The other is called Taliba and it is printed every morning with a circulation of 147,000. There is no legal journals has we know them in the state of Pennsylvania. There is one newspaper called the Philippine Law Decisions which is published monthly but with a very small circulation of X75 copies. I am sending you this letter so that you can decide for yourself whether or not you want to use one daily paper or two daily papers. I don't believe the monthly law paper would do you any good.
