James L.D. Monroe, hereinafter referred to as Owner, whereby the former undertook and agreed to erect
and construct a single family dwelling on that certain lot of ground situate in
Lot 11 The Manor at Fair Oaks,, Mechanicsburg, Lower Allen Township, Cumberland, PA.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for and in
consideration of the sum of ($1.00) Dollar to lacono Company in hand paid by Owner, the receipt whereof
is hereby acknowledged, and the further consideration mentioned in the agreement aforesaid, for
themselves and their subcontractors, and all parties acting through or under them, covenant and agree
that no mechanic's liens or claims shall be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on account of any work done or materials
furnished by them or any of them under said contract or otherwise, for, towards, in, or about the erection
and construction of the said buildings on the lot above described, and the said Contractor, for themselves,
their subcontractors and others under them hereby expressly waive and relinquish the right to have, file,
and maintain any mechanic's liens or claims against the said buildings or any of them, and agree that this
instrument, waiving the right of lien, shall be an independent covenant.

ALL that certain tract or parcel of land being situate in Lower Allen Township, Cumberland
County, Pennsylvania, more particularly bounded and described as follows:
BEGINNING at a point on the northern right-of-way line of Hart Crossing, said point also being
common property corner of Lot 10 and Lot 11 the hereinafter referenced Final Subdivision Plan;
thence along the western right-of-way of Hart Crossing by a curve to the left having a radius of 50
feet, an arc length of 52.36 feet, a chord bearing of South 08 degrees 25 minutes 15 seconds
East and a chord length of 50.00 feet to a point; thence along the same South 21 degrees 34
minutes 44 seconds West a distance of 71.17 feet to a point, said point being a common property
corner of Lot 11 and Lot 13 of there hereinafter referenced Final Subdivision Plan, thence along
the northern boundary line of Lot 12 and Lot 13 of the hereinafter referenced Final Subdivision
Plan, North 68 degrees 25 minutes 16 seconds West a distance of 280.15 feet to a point, said
point being a common property corner of said Lot 11 and said Lot 13; thence along the same
boundary line of Lot 13 North 12 degrees 52 minutes 56 seconds West a distance of 33.09 feet to
a point on the southern property line of lands now or formerly of American Real Estate
Investment, L.P., said point being a common property corner of said Lot 11 and said Lot 13;
thence along said American Real Estate Investment, L.P., lands and along the southern boundary
line of lands now or formerly of Szeles Real Estate Development Company North 54 degrees 30
minutes 00 seconds East a distance of 103.87 feet to a point, said point being a common
property corner of said Lot 11 and said Lot 10; thence along the southern boundary line of said
Lot 10 South 68 degrees 25 minutes 15 seconds East a distance of 217.42 feet to a point, the
point and place of BEGINNING.
THE FORGOING legal description is in conformance with the Phase 1 Final Subdivision Plan for
The Manor at Fair Oaks, dated April 22, 2002, last revise August 30, 2002, Project Number
210544, recorded in the Office of the Recorder of Deeds of Cumberland County, Pennsylvania in
Plan Book 86, Page 1 and designated as Lot No. 11 thereon.
UNDER AND SUBJECT to any and all conditions, restrictions, easements, rights-of-ways,
agreements and covenants of record and that a physical inspection of the property would
disclose, including but not limited to a 30 foot wide Drainage/Landscape Easement extending
along the northwestern boundary line of the property.
BEING PART OF THE SAME PREMISES which R. Hart Enterprises, Inc., a Pennsylvania
Corporation, by deed to be recorded simultaneously herewith, in the Office of the Recorder of
