STIPULATION AGAINST LIENS
THIS AGREEMENT made the~.~_.~'~'day of (~. ,~Jbc/ by and between lACONO
COMPANY, Contractor,
AND
Ralph lacono and Elizabeth lacono, hereinafter referred to as Owner, whereby the former undertook and
agreed to erect and construct a single family dwelling on nat certain lot of ground situate in
Lot 12, In the Manor at Fair Oaks, MeohanicsDurg, Lower Allen Township, Cumberland, PA.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for and in
censiderefion of the sum of ($1.00) Dollar to IACONO COMPANY in hand paid Dy Owner, the receipt
whereof is hereby acknowledged, and the further consideration mentioned in the agreement aforesaid, for
themselves and their subcontractors, and all parties aoting through or under them, covenant and agree
that no mechanic's liens or claims shall be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on account of any work done or materials
furnished by them or any of them under said contra~t or otherwise, for, towards, in, or about the erection
and construction of the said buildings on the tot above described, and the said Contractor, for themselves,
their subcontractom and others under Ihem hereby expressly waive and relinquish the right to I~ave, file,
and maintain any mechanic's liens or ~laims against the said buildings or any of them, and agree that this
instrument, waiving the right of lien, shall be an independent covenant.

ALL THAT CERTAIN tract or parcel of land being situate in Lower Allen Township, Cumberland
County, Pennsylvania, more particularly bounded and described as follows:
BEGINNING at a point on the northern right-of-way line of Hart Crossing, said point also being
common property corner of Lot 11 and Lot 12 of the hereinafter referenced Final Subdivision
Ptan; thence along the western right-of-way of Hart Crossing South 21 degrees 34 minutes 44
seconds West a distance of 4.94 feet to a point; thence along the same by a curve to the left
having a radius of 275.00 feet, an arc length of 83.50 feet, a chord bearing of South 12 degrees
52 minutes 50 seconds West and a chord length of 83.18 feet to a point; thence along the same
by a curve to the right having a radius of 25.00 feet, an arc length of 35.08 feet, a chord bearing
of South 44 degrees 23 minutes 07 seconds West and a chord length of 32.27 feet to a point on
the northern right-of-way of Maple Leaf Court; thence along the northern right-of-way of Maple
Leaf Coud South 84 degrees 35 minutes 17 seconds West a distance of 95.00 feet to a point,
said point being a common property corner of Lot 12 and Lot 13 of the hereinafter referenced
Final Subdivision Plan; thence along the eastern boundary line of said Lot 13 North 05 degrees
24 minutes 43 seconds West a distance of 179.59 feet to a point on the southern boundary line of
said Lot 11, said point being a common property corner of said Lot 12 and said Lot '13; thence
along the southern boundary line of said Lot 11 South 68 degrees 25 minutes 16 seconds East a
distance of 166.09 feet to a point, the point and place of BEGINNING.
THE FORGOING legal description is in conformance with the Phase 1 Final Subdivision Plan for
The Manor at Fair Oaks, dated April 22, 2002, last revised August 30, 2002, Project Number
210544, to be recorded in the Office of the Recorder of Deeds of Cumberland County,
Pennsylvania in Plan Book 86, Page 1 and designated as Lot No.12 thereon.
UNDER AND SUBJECT to any and all conditions, restrictions, easements, rights-of-ways,
agreements and covenants of record and that a physical inspection of the property would
disclose, including but not limited to a portion of a 50 foot wide Pipeline Right-of-Way and
Easement across the southern portion of the property.
BEING PART OF THE SAME PREMISES R. Hart Enterprises, Inc., a Pennsylvania Corporation,
by deed to be recorded simultaneously herewith, in the Office of the Recorder of Deeds of
Cumberland County, granted and conveyed unto Ralph lacono and Elizabeth lacono.
