COMMISSIONER AND CONSTABLE
AND NOW, come the Petitioners Nathan P. Silcox ("Silcox") and Melvyn C. Finkelstein
("Finklelstein") (collectively "Petitioners"), and file the following petition to set aside the nomination
petitions of Respondent Craig A. Gentler ("Gentzler" or "Respondent"), in this matter, and in support
thereof aver as follows:
1. Petitioner Nathan P. Silcox is an adult individual who resides at 1427 Inverness Drive, Hampden
Township, Mechanicsburg, PA 17050 and is a qualified and registered Republican voter in
Hampden Township.
2. Petitioner Melvyn C. Finkelstein is an adult individual who resides at 4710 Delbrook Road,
Hampden Township, Mechanicsburg, PA 17050 and is a qualified and registered Republican
voter in Hampden Township.
3. Respondent Craig A. Gentzler, upon information and belief is an adult individual who resides at
6025 William Drive, Hampden Township, Mechanicsburg, PA 17050 who also is a registered
and qualified Republican voter.
4. On March 6, 2009, Respondent Gentzler field two separate nomination petitions with the
Cumberland County Election Bureau for officers to be nominated at the Primary election on May
19, 2009.
5. Section 976 of the Election Code, 25 P.S. §2936, provides in part that "[n]o nomination petition
.. shall be permitted to be filed if - (a) it contains material errors or defects apparent on the face
thereof... or (b) it contains material alterations made after signing without the consent of the
signors...."
A. The Commissioner Petition
6. One of the petitions filed by Gentzler was for the office of "Cumberland County Commissioner".
A copy of that petition is attached hereto as Exhibit "A".
7. Upon presenting the petition for "Cumberland County Commissioner" at the offices of the
Cumberland County Election Bureau (the "Election Bureau"), it is averred upon information and
belief that the office stated as "Cumberland County Commissioner" was stricken by an employee
of the Election Bureau, and in its place the office of "Twp. Commissioner - 4 year term" was
inserted on the face of the petition by the Election Bureau employee.
8. In the May 19, 2009 primary, no office for "Cumberland County Commissioner" is to appear on
the ballot. The Respondent's petition on its face incorrectly stated the office for which it is
believed the Respondent desires to petition as a candidate in the May primary. It is believed that
the Respondent desired to petition to appear on the primary ballot for the office of "Hampden
Township Commissioner".
9. It is further averred that the change in the office stated from "Cumberland County
Commissioner" to "Twp. Commissioner - 4 year term" was done after the elector signatures
were secured that appear on the face of the nomination petition.

10. The office stated on the petition as "Cumberland County Commissioner" is a material error or
defect that requires that the petition be set aside.
B. The Constable Petition
11. The other petition filed by Gentzler was for the office of "Pennsylvania State Constable". A copy
of that petition is attached hereto as Exhibit B".
12. Upon presenting the petition for "Cumberland County Commissioner" at the offices of the
Election Bureau it is averred, upon information and belief, that the office stated as "Pennsylvania
State Constable" was stricken by an employee of the Election Bureau, and in its place the office
of "Constable - 6 year term" was inserted on the face of the petition by the Election Bureau
employee.
13. In the May 19, 2009 primary, no office for "Pennsylvania State Constable" is to appear on the
ballot. The Respondent's petition on its face incorrectly stated the office for which it is believed
the Respondent desires to petition as a candidate in the May primary. It is believed that the
Respondent desired to petition to appear on the primary ballot for the office of "Hampden
Township Constable".
14. It is further averred that the change in the office stated from "Pennsylvania State Constable" to
"Constable - 6 year term" was done after the elector signatures were secured that appear on the
face of the nomination petition.
15. The office stated on the petition as "Pennsylvania State Constable" does not exist and is a
material error or defect that requires that the petition be set aside.
WHEREFORE, the Petitioners pray that this Court enter an order setting aside the petitions field by
the Respondent for the offices of "Cumberland County Commissioner" and "Pennsylvania State
Constable" be set aside and that the Respondent's name not appear for either the office of Hampden
Township Commissioner or Hampden Township Constable in the May 19, 2009 primary election.
