HomeMy WebLinkAbout94-0809 IN THE MATTER OF IN THE COURT OF COMMON PLEAS OF JACK ALSPAUGH CUMBERLAND COUNTY, PENNSYLVANIA ~ ORPHANS COURT DIVISION an alleged incompetent NO. 21-94-809 ORPHANS' COURT ORDER OF COURT AND NOW, this 22nd day of September, 1994, upon review of the Petition For Emergency Guardianship filed by Robert L. O'Brien, Esquire, Solicitor for the Cumberland/Perry County Mental Health/Mental Retardation Office, and following a hearing, the Court finds by clear and convincing evidence that an emergency guardian of the person and the estate of the allegedly incapacitated person, Jack Alspaugh, is necessary in that it appears that Mr. Alspaugh lacks capacity, that he is in need of such a guardian, and that a failure to make such appointment will result in irreparable harm to Mr. Alspaugh and his estate. Consequently, it is further ordered and directed that June Alspaugh is appointed emergency guardian of the person and estate of Jack Alspaugh with a view toward arrangement of his admission to the Cumberland County Nursing Home and discharge from Lancaster osteopathic Hospital. Upon application, this Order may be extended for an additional period of 20 days. If the appointment of a permanent guardian is requested, counsel is asked to contact the office of the undersigned judge for the scheduling of a hearing and for the purpose of providing notice to the allegedly incapacitated person in accordance with the Probate, Estates and Fiduciaries Code.
