Petition To Authorize Distribution Pursuant to Family Settlement Agreement in
Accordance with 20 Pa. C.S.A. §3323, and it appearing to the court that the
petition seeks court approval of a distribution of the assets of the estate and
discharge of the petitioner/executor and counsel pursuant to a family settlement
agreement by utilizing a section of the Probate, Estates and Fiduciaries Code
intended to apply only to settlement of controversies by or against estates, the
court is constrained to deny the petition.
