Myers & Son, Inc., by and through its undersigned counsel, files the following Complaint against Defendant, Olde Forge Builders, Inc.: 1. Plaintiff is John H. Myers & Son, Inc., a Pennsylvania corporation which has a principal office and place of business at 2200 Monroe Street, York, York County, Pennsylvania 17404. 2. Defendant is Olde Forge Builders, Inc., a Pennsylvania corporation which has an office and place of business at 9 Keystone Drive, Mechanicsburg, Cumberland County, Pennsylvania 17050. 3. During the months of June, July and August, 2008, Defendant ordered building materials and supplies from Plaintiff. 1 4. Pursuant to Defendant's requests, Plaintiff supplied the building materials and delivered them to various construction sites, where the material was received without complaint and incorporated into the construction projects. 5. At or about the time of the deliveries, Plaintiff submitted its invoices for the building materials ordered and received by Defendant, true and correct copies of which are attached and made a part hereof as Exhibit A. 6. The invoices attached as Exhibit A describe in detail the building materials delivered and the prices thereof. 7. The prices set forth on the invoices total $32,830.78, which amount is fair and reasonable, accorded with the customary prices charged for such building materials, and are the prices Defendant agreed to pay. 8. As set forth on the invoices, the terms of payment are net 10th prox, and service charges accrue on past due amounts. 9. Defendant has failed and refused and continues to fail and refuse to pay the balance rightfully due to Plaintiff, which is the sum of $35,921.53, including service charges, as more fully set forth on the statement of account attached and made a part hereof as Exhibit B. 10. Plaintiff's claim is within the jurisdictional limit requiring arbitration in Cumberland County, Pennsylvania. Count 1 - Breach of Contract 11. Plaintiff incorporates by reference paragraphs 1 through 10 above. 2 12. Defendant's failure to pay for the materials received constitutes a breach of the parties' agreement. 13. As a result of Plaintiff's breach, Defendant has suffered a loss in the amount of $35,921.53. WHEREFORE, Plaintiff, John H. Myers & Son, Inc., demands judgment in its favor and against Defendant, Olde Forge Builders, Inc., in the amount of $35,921.53, plus interest as allowed by law and costs of suit. Count 2 - Unjust Enrichment 14. Plaintiff incorporates by reference paragraphs 1 through 13 above. 15. Defendant would be unjustly enriched if it were permitted to retain the benefits conferred on it by Plaintiff without paying Plaintiff the fair and reasonable value of the building materials received, the sum of $35,921.53. WHEREFORE, Plaintiff, John H. Myers & Son, Inc., demands judgment in its favor and against Defendant, Olde Forge Builders, Inc., in the amount of $35,921.53, plus interest as allowed by law and costs of suit. Count 3 - Account Stated 16. Plaintiff incorporates by reference paragraphs 1 through 15 above. 17. By reason of Defendant's failure to tender full payment, the amounts owed by Defendant to Plaintiff have become an account stated. WHEREFORE, Plaintiff, John H.
