Civil Action - Law THOMAS EDWARD HILL, Defendant Jury Trial Demanded COMPLAINT The Plaintiff, Tamara Vaughan, by and through her attorneys, SCHMIDT KRAMER PC, and hereby avers as follows: THE PARTIES 1. The Plaintiff, Tamara Vaughan, is an adult individual currently residing at 420 D Street, Carlisle, Cumberland County, Pennsylvania. 2. Defendant, Thomas Edward Hill, is an adult individual currently residing at 517 Craig Road, Carlisle, Cumberland County, Pennsylvania. FACTS 3. The facts which give rise to the cause of action occurred on or about June 26, 2007 at about 11:00 am at the intersection of East High Street and South Bedford Street, Carlisle, Cumberland County, Pennsylvania, where a collision occurred between an automobile operated by Thomas Edward Hill and an automobile operated by Albert Vaughan. 4. At the time of the above-referenced collision, Thomas Edward Hill was operating an automobile on East High Street, traveling westbound, and made an illegal left turn into oncoming traffic, thereby causing a collision between his automobile and the automobile operated by Albert Vaughan. 5. At the aforementioned time and place, Albert Vaughan was operating his automobile eastbound on East High Street and entered the intersection of High Street and Bedford Streets with a green traffic signal and with the right-of-way. 6. Tamara Vaughan was the front-seat passenger in Albert Vaughan's automobile. 7. The collision and resulting injuries and damages are in no way caused or contributed to by the Plaintiff, Tamara Vaughan, and were solely caused by the Defendant for the reasons set forth below. 2 COUNT I Tamara Vaughan v. Thomas Edward Hill NEGLIGENCE 7. Paragraphs 1 through 7 of the Complaint are incorporated herein by reference and made a part thereof as if set forth in full. 8. The negligence, carelessness, and recklessness of the Defendant, Thomas Edward Hill, consisted of the following: a. Failing to have his vehicle under proper and adequate control; C. Failing to apply his brakes in time to avoid the collision with Albert Vaughan's automobile; d. Failing to keep a reasonable lookout for other vehicles with the right-of-way; e. Failing to operate his vehicle according to existing traffic conditions; f. Operating his vehicle in a manner so as to create a dangerous situation for other vehicles on the roadway; and g. Making a left turn when it was unsafe to do so thereby violating 75 Pa.C.S.A. § 3322 Vehicle Turning Left which is negligence per se. 9. As a direct and proximate result of the collision and Defendant's negligence, Plaintiff, Tamara Vaughan, sustained injuries that may be permanent to both knees. 3 10. As a factual result of the accident, Plaintiff, Tamara Vaughan, has incurred medical expenses to date and will continue to incur medical expenses into the future, and thus, a claim for these expenses is made. 11. As a factual result of the accident, Plaintiff, Tamara Vaughan, has undergone in the past, and will continue to undergo in the future, great pain and suffering, and thus, a claim for these injuries is made. 12. As a factual result of the accident, Plaintiff, Tamara Vaughan, has been obliged to spend various sums of money and to incur various expenses for the injuries that she has suffered and may continue to incur the same in the future, and thus, a claim for these losses is made. 13. As a factual result of the accident, Plaintiff, Tamara Vaughan, suffered a loss of earnings and an impairment of her earning power and capacity in the future, and thus, a claim for these losses is made. 14. As a factual result of the accident, Plaintiff, Tamara Vaughan, suffered a permanent diminution of her ability to enjoy life and life's pleasures, and thus, a claim for these losses is made.
