PETITION TO DISMISS PERMANENT PLENARY GUARDIAN ACTION
AND NOW COME THE PETITIONERS, Danny R. Fiber and John P. Ricci, by and through
their attorney, Lindsay D. Baird, Esquire, who represent and aver as follows:
The Petitioners are Danny R. Fiber, Husband to Ms. Ricci-Fiber, an adult residing at 242
Stonehenge Lane, Mechanicsburg, PA 17055, and John P. Ricci, Father to Ms. Ricci-
Fiber, an adult residing at 2234 Cypress Cross Loop, Lakeland, Florida 33810.
2. The alleged incapacitated person is Christine J. Ricci-Fiber, age 35, is currently being
treated at Johns Hopkins Hospital. There she is making marked improvement. She is off
the ventilator for half of each day and is alert and able to communicate. She is able to
make decisions regarding her medical treatment and her financial affairs.
3. A Durable Power of Attorney is being prepared for her to sign.
4. Petitioners believe and, therefore aver, that Christine J. Ricci-Fiber no longer has need of
the appointment of Permanent Plenary Guardians of her Person and Estate.
WHEREFORE, Petitioners requests that Hearing scheduled for Apri12, 2009, be
cancelled, the emergency order of March 10, 2009, be vacated and the petition filed March 4,
2009, be dismissed without prejudice.
