COMPLAINT
Plaintiff, GMAC, by its attorneys, Lavin, O'Neil, Ricci, Cedrone & DiSipio, briri s'tlus action
against defendant, Gary Lee Kauffman, of which the following is a statement:
1 • Plaintiff GMAC, an entity organized under the laws of Delaware and registered to do
business in the Commonwealth of Pennsylvania. For purposes of this action only, GMAC's business
address is 2902 W. Agua Fria Frwy., Suite 1095, Phoenix, Arizona 85027.
2. On information and belief, defendant, Gary Lee Kauffinan, is an adult individual who resides
it 1006 Belle Vista Drive, Enola, Pennsylvania 17025.
3. On or about August 1, 2008, defendant, Gary Lee Kauffinan, entered into a Retail Installment
)ale Contract (the "Contract") with Frederick Certified Pre-Owned (the "Dealer") for the purchase of a 2004
WW 330CI, VIN#WBABW53414PL41999 (the "Vehicle"). The Contract was subsequently assigned to
GMAC and defendant became obligated to GMAC under the terms of the Contract. A true and correct cop
of the Contract is attached hereto as Exhibit "A."
4. The Contract grants GMAC a security interest in the Vehicle which was duly perfected b,
endorsement on the Vehicle's Certificate of Title. A copy of the Vehicle's Certificate of Title is attache(
hereto as Exhibit "B."
5. Under the terms of the Contract, defendant, Gary Lee Kauffman, was required to make sixty
(60) payments in the amount of $763.54 each, due on the 1 St day of each month beginning September 1,
2008.
6. Pursuant to the Contract, failure to make payment when due is a default.
7. Pursuant to the Contract, defendant, Gary Lee Kauffman, has failed to make the monthl
payments as required by the Contract on September 1, 2008, and all payments accruing thereafter. In
addition, accrued late charges in the amount of $45.81 are owed to GMAC.
8. Defendant, Gary Lee Kauffman, is.in default of the Contract as a result of his failure to make
payments when due and to maintain insurance on the Vehicle as required by the Contract.
9. Pursuant to the Contract and applicable law, GMAC is entitled to possession of the Vehicle in
the event of default.
10. Upon information and belief, defendant has possession of the Vehicle.
11. Several demands for payment or return of the Vehicle were made by GMAC to the defendant.
12. The aforementioned demands for payment or return of the Vehicle have been refused or
gnored.
13. Defendant refuses to surrender the Vehicle to GMAC.
14. While the Vehicle remains in defendant's possession, it loses value and is subject to damage

15. At the present time, the retail value of the Vehicle is $21,625.00. The Affidavit of Value c
Brian Kirchgessner is attached hereto as Exhibit "C."

16. GMAC incorporates paragraphs 1 through 15 of this Complaint as if set forth fully herein.
17. As a result of the above, GMAC is entitled to a judgment for possession of the Vehicle.
WHEREFORE, GMAC requests the entry of a judgment against the defendant, Gary Lee Kauffman,
declaring that GMAC is entitled to possession of the Vehicle or if the Vehicle cannot be seized for its value
in the amount of $21,625.00, and costs of this action, together with attorney's fees, and such other and
further relief as this Court deems appropriate.
COUNTII
18. GMAC incorporates paragraphs 1 through 17 of this Complaint as if set forth fully herein.
19. The Contract provides that failure to make a payment when such payment is due is a default.
20. Defendant, Gary Lee Kauffman, has failed to make the payment due to GMAC on September
1, 2008 and all payments accruing thereafter.
21. Pursuant to the Contract, GMAC can demand payment in full on default.
22. The balance due to GMAC is $32,049.12.
23. The Contract also permits GMAC to recover reasonable attorney's fees.
24. GMAC claims interest at the highest lawful rate.
WHEREFORE, GMAC demands judgment in its favor and against defendant, Gary Lee Kauffman, for
a total amount of $32,049.12, plus attorney's fees, interest, costs, and such other and further relief as this
Court deems appropriate.

4. The value was obtained from the N.A.D.A. Official Used Car Guide-January 2009 edition. This

5. The vehicle is in the possession of the defendant and cannot be inspected for a more detail&
appraisal of same.
