COMPLAINT
The Plaintiff, NOLAND COMPANY, by its attorneys, KODAK & IMBLUM, P.C.,
brings this action of Assumpsit against the Defendants to recover the sum of TWENTY
THOUSAND THREE HUNDRED SEVENTY-SIX DOLLARS AND FIFTY-FOUR CENTS
($20,376.54), along with interest thereon at the statutory rate from March 25, 2009, upon
a cause of action of which the following is a statement:
The Plaintiff, NOLAND COMPANY, is a corporation organized and existing under
the laws of the State of Maryland, having its principal office and place of business
at 1350 Wesel Boulevard, Hagerstown, Maryland 21740.
2. The Defendant, MOUNTAIN AIRE MECHANICAL CONTRACTING, INC., is a
corporation having an office and place of business at 87 Hoover Road, Carlisle,
Cumberland County, Pennsylvania 17013.
3. The Defendant, JEFFREY R. GETTYS, personal guarantor for Mountain Aire
F;\USER\ROBIN\CCP&DJ CMPS\CCP COMPLAINTS\NOLAND COMPANY\NOLAND 35484.wpd
Mechanical Contracting, is an adult individual with an address of 87 Hoover Road,
Carlisle, Cumberland County, Pennsylvania 17013.
4. Mountain Aire Mechanical Contracting, Inc., is a corporation organized and existing
under the laws of the Commonwealth of Pennsylvania, as more fully set forth on
the Pennsylvania Department of State Corporation Bureau print out attached
hereto, marked Exhibit "A" and made a part hereof.
5. On or about August 1, 2008, Defendants submitted a Credit Application and
Personal Guaranty to Plaintiff, which credit was granted to Defendants, a true and
correct copy of which is attached hereto, marked Exhibit "B" and made a part
hereof.
6. On the dates, in the amounts, and for the prices set forth in a true and correct copy
of the Plaintiffs Statement of Account hereto attached, marked Exhibit "C" and
made a part hereof, Plaintiff, at the special instance request of the Defendant(s),
sold and delivered goods, wares and merchandise of the kind and description set
forth on said Exhibit to the total amount of Sixteen Thousand Three Hundred One
Dollars and Twenty-Three Cents ($16,301.23).
7. The prices charged for said goods, wares and merchandise were just and
reasonable, were the legal and market prices therefor and were the prices which the
Defendants promised and agreed to pay to Plaintiff.
8. The balance due and owing by Defendants to Plaintiff is the sum of Sixteen

Thousand Three Hundred One Dollars and Twenty-Three Cents ($16,301.23), as
appears by Exhibit "B" hereto.
9. Plaintiffs Invoices are not attached to this pleading due to the voluminous nature
of same and, further, have previously been provided to Defendants.
10. Due to the default of Defendants, and pursuant to the terms and conditions of the
Credit Application and Personal Guaranty executed by Defendants hereto attached
as Exhibit "B", attorney's fees in the total amount of Four Thousand Seventy-Five
Dollars and Thirty-One Cents ($4,075.31) have been added to said account.
11. Plaintiff frequently demanded payment from Defendants of said amount due and
owing as aforesaid, but Defendants refused and neglected and still refuse and
neglect to pay said amount or any part thereof.
WHEREFORE, Plaintiff brings this suit to recover from Defendants the sum of
TWENTY THOUSAND THREE HUNDRED SEVENTY-SIX DOLLARS AND FIFTY-FOUR
CENTS ($20,376.54), together with interest as set forth herein.
