COMPLAINT- CIVIL ACTION
AND NOW, comes the Plaintiff, Wells Fargo Bank, N.A., a National Banking
Association by and through its attorneys, Anthony S. Posa, Esquire, and Payne, Welsh &
Klingensmith, and files the within Complaint in Civil Action and in support thereof avers as
follows:
1. Plaintiff is a corporation with an office located at 301 E. 58~' Street North, Sioux
Falls, SD 57104 and is engaged in the business of consumer and commercial credit.
2. Defendant, Gerald Willwerth, is an adult individual believed to be residing at 720
Orchard Court, Chambersburg, Pennsylvania 17201.
3. Defendant applied for an Education Loan in the amount of $9,480.00 from Plaintiff on
or about February 7, 2001. A true and correct copy of said Application & Promissory Note and
Truth-In-Lending Disclosure Station are attached hereto and marked as Exhibit "A" and is
incorporated by reference.
4. Plaintiff approved said application and issued a Loan bearing account number
2670704 in the amount of $9,480.05 plus an origination fee of $498.95 totalling $9,979.00 to
Defendant on Mazch 6, 2001.
5. The terms of the loan issued by Plaintiff to Defendant was for the aforesaid amount of
$9,979.00, at a variable interest rate of 10.754% variable rate, payable in monthly installments of
principal and interest.
6. The Defendant made use of said loan and currently has a principal balance of
$8,179.93 with ongoing interest at an interest rate of 10.754% variable rate as evidenced by an
Affidavit signed by an agent of Plaintiff. A true and correct copy of said Affidavit is attached
hereto and made pazt hereof and mazked as Exhibit "B".
7. Defendant is in default of the terms of the extension of credit, having not made
payment to Plaintiff as promised thereby rendering the entire unpaid balance immediately due
and payable.
9. Through the acceptance and use of this loan, Defendant became bound by the terms of
the Agreement.
10. Plaintiff avers that per the Agreement the Defendant will pay Plaintiff s attorney's
fees.
11. Plaintiff avers that such attorney's fees will amount to $1,500.00 should this matter
proceed to trial.
12. Although repeatedly requested to do so by Plaintiff, Defendant has willfully failed
andlor refused to pay the principal balance of these loans, finance chazges, attorney's fees or any
part thereof owed to Plaintiff regazding this account.
13. Plaintiff has suffered damages in the amount of $10,171.67 plus ongoing interest
which is accruing, plus fees and costs as a result of the breach by Defendant.
WHEREFORE, Plaintiff, Wells Fazgo Bank, demands Judgment in its favor and against
the Defendants in the amount of $10,171.67 with continuing finance charges on the principal
amount plus interest to date of judgment, plus costs, fees and any other relief this Court deems
proper.
