Sanderson, your Petitioner, files this Petition for Settlement of a-Sall Est,~e _- - under the provisions of Section 3102 of the Probate, Estates and Fiduciaries Code d in supp~•t ,-, __~~ thereof avers that: ~' (1) Your Petitioner, Marie A. Sanderson, is a competent adult residing at 136 North Spring Garden Street, Carlisle, Pennsylvania 17013 ,and is the daughter of the above decedent. (2) Briton F. Forney (Decedent), father of the Petitioner, died on February 22, 2008, at the age of 90 years, but prior thereto lived and was domiciled at 136 North Spring Garden Street, Carlisle, Pennsylvania 17013, Pennsylvania, Cumberland County, Pennsylvania. He died with a Will and no letters Testamentary have been issued. (3) Petitioner is the sole heir and next of kin to the Decendent. (4) Petitioner is the named Executor of Decedent's Last Will and Testament. (5) Briton F. Forney had no probate estate when he died other than the following: $ 5057.11 in cash on deposit at M&T Bank $ 90.01 in cash in personal account at HCR Manor Care, Carlisle. (6) Following Decedent's death, Decedent's estate received an economic stimulus check in the amount of $592.00. (7) On the date of Decedent's death, Petitioner formed a part of Decedent's household, and the Petitioner is the person entitled to the family exemption. (8) All of Decedent's property is taxable at 4.5% as transfers to his sole heir for purposes of the Perulsylvania inheritance tax, and no federal estate tax is due. (9) All fluleral and burial expenses, medical bills for HCR Manor Care and attorneys fees, have been paid in full. (10) Subsequent to the payments above in paragraph (9) approximately $4757.00 remained in the estate of the Decedent. (11) Your Petitioner avers that there are no creditors of the Decedent and no claims unpaid known to your Petitioner other than an estate recovery claim by the Department of Public Welfare who shall receive any amounts within the estate account a ier paynielit of debts in excess of the $3500.00 fa-Wily exer~iption. (12) Your Petitioner avers that the $3500.00 family exemption will be paid through the decedent's estate to Petitioner and will be distributed according to the Last Will and Testament of the Decedent. WHEREFORE, your Petitioner respectfully requests that an Order be made authorizing Petitioner to act on behalf of the estate and complete the distribution pursuant to Section 3102 of the Probate, Estates and Fiduciaries Code.
