is three (3) percent (72 P.S. §9116 (a) (1.1) (i)J.
For dates of death on or after January 1, 1995, the tax rate imposed on the net value of transfers to or for the use of the surviving spouse is zero (0) percent
p2 P.S. §9116 (a) (1.1) (ii)]. The statute does not exempt a transfer to a surviving spouse from tax, and the statutory requirements for disclosure of assets and
filing a tax return are still applicable even if the surviving spouse is the only beneficiary.
For dates of death on or after July 1, 2000:
The tax rate imposed on the net value of transfers from a deceased childtwenty-one years of age or younger at death to or for the use of a natural parent, an
adoptive parent, or a stepparent of the child is zero (0) percent [72 P.S. §9116(a)(1.2)].
The tax rate imposed on the net value of transfers to or for the use of the decedent's lineal beneficiaries is four and one-half (4.5) percent, except as noted in
72 P.S. §9116(1.2) [72 P.S. §9116(a)(1)J.
The tax rate imposed on the net value of transfers to or for the use of the decedent's siblings is twelve (12) percent [72 P.S. §9116(a)(1.3)]. Asibling isdefined, under
Section 9102, as an individual who has at least one parent in common with the decedent, whether by blood or adoption.

County, Penna., having been duly filed and confirmed by the Court,
along with the Distribution Account acid the proposed schedule of
distribution distributing to William EF Bender, Wilbur L. Bender and
Robert Bender, each, a one-third interest to property located in
the Borough of Carlisle, Cumberland County, Pennsylvar_ia, and the
same having been approved, it is ordered, adjudged and decreed that
the said 1/3 interest to each of the aforesaid persons in the
following real estate is hereby awarded to William E. Bender,
Wilbur L. Bender and Robert Bender, their heirs and assigns, as
follows:
ALL that certain tract of land situate in the First Ward of
the Borough of Carlisle, Cumberland County, penna., bounded and
described as follows:
BEGINNING at a-point on the Northern side of Mulberry Avenue,
said point being 100 feet 8 inches measured westwardly along the
Northern side of Mulberry Avenue from the Western side of North
East Street; thence in a Northerly direction along the Western side
of a private alley 15 feet wide, and parallel with North East
Street, 100 feet to a point, the Southwestern corner of two private
alley 15 feet wide; thence in a Westerly direction along the
Southern side of the second private alley 15 feet wide, 56 feet to
a point; thence in a southerly direction 100 feet to a point on the
Northern side of Mulberry Avenue; thence in an Easterly direction
along the Northern side of Mulberry Avenue, 56 feet to the place of
beginning.
SUBJECT to the right of Robert L. Myers, Jr., and Evelyn M. Myers,
their heirs and assigns, to maintain and use a sewer line over said
land, extending from property No. 161 Mulberry Avenue to and being
connected with a common sewer line located ont he property known as
No. 34 North East Street. The Grantees, their heirs and assigns,
shall have the right to use said sewer line located on said land
herein conveyed in common with the owners and occupiers of said
property No. 161 Mulberry Avenue for residential uses only, and
subject to the payment of a pro rata share of the cost of
maintaining said sewer line and the common sewer with which the
same is connected jointly with the owners and occupiers of the
other properties connected with and using the same.

BEING THE SAME premises which Robert L. Bender and Mary E.Bender,
his wife, granted and conveyed unto Catharine E. Bender, a/k/a
Catherine E. Bender, by deed dated May 3, 1978, and recorded in the
j Cumberland County Recorder of Deeds Office in Deed Book 27 V 399.
i The said Catherine E.Bender died intestate on September 27, 1990,
and Letters of Administration were granted to her Administrator,
William E. Bender, on February 11, 19.91. Under the laws of the
State of Pennsylvania, this property passes to her only heirs, her
three brothers, William E.Bender, Wilbur L. Bender and Robert
Bender.
THE RECORDER OF DEEDS is directed to record this Order among
the records of deeds in his official custody and to index the same
in the Grantor index against the name of Catharine E. Bender, a/k/a
Catherine E.Bender, and to index the same in the grantee index
under the names of William E. Bender, Wilbur L. Bender and Robert
Bender.
