Costopoulos, William C. Costopoulos, John C. Costopoulos, Paul C. Costopoulos, and Virginia Schmitt; WHEREAS, we are the children of Katherine Costopoulos, a widow, who died March 19, 2006, having first made her Last Will and Testament dated May 7, 1997; WHEREAS, each of us has personally examined the aforesaid Last Will and Testament, which was admitted to probate before the Office of the Register of Wills, Cumberland County, Pennsylvania, and filed to estate No. 2006-0324; WHEREAS, James C. Costopoulos and William C. Costopoulos have been duly appointed the personal representatives of the Estate of Katherine Costopoulos ("the Estate"); WHEREAS, the personal representatives have gathered the assets of the Estate consisting of both real property and personal property; WHEREAS, the debts and deductions, including but not limited to the payment of all taxes, have been paid by the personal representatives; WHEREAS, the balance for distribution has been distributed in accordance with the germs of the Last Will and Testament; NOW, THEREFORE, KNOW YE, that we, James C. Costopoulos, William C. Costopoulos, John C. Costopoulos, Paul C. Costopoulos, and Virginia Schmitt, being the children of Katherine Costopoulos and heirs under her Last Will and Testament, and being those persons entitled to inherit thereunder, do hereby, each of us, acknowledge that we have received. from the personal representatives, in full satisfaction and payment of all sum or sums of money, legacies, bequests, and devises as are given, devised and bequeathed to each of us respectively by the aforesaid Last Will and Testament, the amounts due us thereunder; AND, each of us does hereby stipulate that in order to avoid the expense and time involved in the filing of a formal account and schedule of distribution, we each agree that no formal accounting to the Court is necessary, and we further agree that the informal account and distribution made by the personal representatives hold the same force and effect as if confirmed by the Court. THEREFORE, we and each of us do hereby remise, release, quitclaim and forever discharge the personal representatives, their heirs, executors, and administrators and assigns, of and from the said estate and from all actions, suits, payments, accounts, reckonings, claims, and Page 1 of 2 demands whatsoever for or by reason thereof, or for any other use, matter, cause or thing whatsoever touching upon the Estate, and each of us do further hereby covenant and agree that should any liability come due to the Estate after the signing of this agreement, we and each of us do hereby covenant and agree with each other and the personal representatives that we will contribute pro rata our share of the Estate to satisfy any and all claims, demands, suits, or causes of action which may be successfully prosecuted against the said Estate or the personal representatives after the signing, sealing and delivery of this agreement.
