CIVIL ACTION/MORTGAGE FORECLOSURE
1. Plaintiff is Financial Freedom SFC, a corporation duly organized and doing business at the
above captioned address.
2. The Defendant is Keith Sultzbaugh, Co-Executors of the Estate of Caroline W. Sultzbaugh
Deceased Mortgagor and Real Owner., who is the mortgagor and real owner of the mortgaged property
hereinafter described, and his/her last-known address is 806 Briarwood Lane, Camphill, Pennsylvania
17011.
3. The Defendant is L. Carl Sultzbaugh II, Co-Executor of the Estate of Caroline W.
Sultzbaugh, Deceased Mortgagor and Real Owner., who is the mortgagor and real owner of the mortgaged
property hereinafter described, and his/her last-known address is 38 Big Dam Road, Dillsburg, Pennsylvania
17019.
4. Title of said premises is vested in the name of Caroline W. Sultzbaugh.
5. On February 13, 1998, Caroline W. Sultzbaugh and Lloyd Sultzbaugh made, executed and
delivered a mortgage upon the premises hereinafter described to FTM Mortgage Company which mortgage
is recorded in the Office of the Recorder of Cumberland County in Mortgage Book 1444, Page 920.
6. On April 9, 1998, the aforesaid mortgage was thereafter assigned by FTM Mortgage
Company to Wendover Funding, Inc. , by Assignment of Mortgage, recorded in the Office of the Recorder
of Cumberland County in Assignment of Mortgage Book 573, page 107.
7. On August 16, 2001, the aforesaid mortgage was thereafter assigned by Wendover Finanical
Services Corporation to Lehman Capital, A Division of Lehman Brothers Holdings, Inc, by Assignment of
Mortgage, recorded in the Office of the Recorder of Cumberland County in Assignment of Mortgage Book
680, page 1315.
8. On January 3, 2005, the aforesaid mortgage was thereafter assigned by Financial Freedom
Senior Funding Corporation Acting as Attorney-In-Fact for Lehman Capital, A Division of Lehman Brothers
Holdings, Inc. to Financial Freedom Senior Funding Corporation , Plaintiff herein, by Assignment of
Mortgage, recorded in the Office of the Recorder of Cumberland County in Assignment of Mortgage Book
714, page 1137.
9. On October 19, 1998, Lloyd Sultzbaugh departed this life leaving title vested solely to
Caroline W. Sultzbaugh.
10. On November 22, 2006, Caroline W. Sultzbaugh departed this life. Letters Testamentary
were granted to Keith Sultzbaugh and L. Carl Sultzbaugh II Co-Executors of the Estate of Caroline W.
Sultzbaugh.
11. The premises subject to said mortgage is described in the mortgage attached as Exhibit "A"
and is known as 2749 Lisburn Road, Camp Hill, Pennsylvania 17011.
12. The mortgage is in default because defendant is deceased.
13. The following amounts are due on the mortgage:
Principal Balance $ 99,725.51
Interest through March 31, 2009 $ 78,851.66
(Plus $18.53 per diem thereafter)
Attorney's Fee $ 1,300.00
Corporate Advance $ 7,675.07
Escrow Advance $ 1,850.00
GRAND TOTAL $ 189,402.24
14. Notice of Intention to Foreclose as required by Act 6 of 1974 (41 P.S. §403) and notice
required by the Emergency Mortgage Assistance Act of 1983 as amended under 12 PA Code Chapter 13, et
seq., commonly known as the Combined Notice of Delinquency has been sent to Defendant by regular mail
with a certificate of mailing and by certified mail, return receipt requested.
15. Plaintiff does not Defendants personally liable on this cause of action and releases her from
any personal liability. This action is being brought to foreclose their interest in the aforesaid real estate only.
WHEREFORE, Plaintiff demands an in rem Judgment against the Defendant in the sum of
$189,402.24, together with interest at the rate of $18.53 per diem and other costs and charges collectible
under the mortgage and for the foreclosure and sale of the mortgaged property.
